Conroe football player killed in street racing car accident

Over Memorial Day weekend, a 17-year-old Conroe High School football star was killed in a car accident. The accident took place on Sunday, 24th, at approximately 9:40 pm.

Police believe that the accident occurred because the teens apparently were engaged in street racing. Evidence at the scene of the accident supports that the teens were driving at speeds in excess of 100 mph when the accident took place.

The car was being driven by 18-year-old Johnnie O’Neal. At some point, authorities believe the driver lost control of the vehicle, striking a culvert. Reports indicate that the car went airborne, after which it tore through a brick and wrought iron fence surrounding a yard in a residential neighborhood. The car finally came to a stop when it struck, and wrapped halfway around, a tree in the yard.

The impact was so forceful that the car’s engine and transmission flew from the vehicle and landed about 100 yards away. Pieces of the fence and culvert were also strewn about the street and yard.

The home where the accident occurred belongs to Saturnino and Martha Iracheta. At the time of the accident, the Irachetas were outside watering plants with their 3-year-old daughter. No members of the Iracheta family were injured.

17-year-old dies of injuries from fiery single-car accident

Friday morning, just before noon, a driver was killed in a fiery car accident on State Highway 6. The driver, 17-year-old Alex Reed, was pulled from the car by firefighters before the car became engulfed in flames. Reed was taken to Hillcrest Baptist Medical Center where he later died of his injuries.

The accident occurred when Reed struck an overpass support near the Speegleville Road exit. State Highway 6 was closed for several hours after the accident.

Fatal accident leads to Texas oil refinery facing 30 OSHA citations

An east Texas oil refinery has been charged with 30 safety violations after an inspection by the U.S. Department of Labor's Occupational Safety and Health Administration (OSHA). The refinery is Delek Refining Ltd., which is located in Tyler, Texas. The inspection was prompted by the death of two refinery workers and injuries to three others.

The fatal accident occurred after a Naptha discharge line ruptured at the saturated-gas unit. Flammable vapors were ignited, causing the fire that killed two and injured three.

The inspection led to OSHA finding that a willful violation was responsible for the deadly accident. The violation was failing to adequately maintain and repair the refinery’s processing equipment. According to OSHA standards, a willful violation is committed with either indifference to or intentional disregard of OSHA requirements.

Other violations for which the refinery were cited include those involving asbestos, benzene, electrical and fire extinguisher standards. These citations are an indication that OSHA believes the problems could lead to serious injury or death, and are violations which the employer either knew about or should have known about.

The refinery potentially faces penalties totaling $217,350.

Houston police officer seriously injured in car accident by drunk drivers

Houston police officer Lloyd Morrison II was critically injured in a car accident that took place over Memorial Day weekend. Office Morrison’s patrol car was struck by two separate vehicles. The collisions left him pinned against a fire truck.

The accident occurred shortly after Officer Morrison arrived on the scene of a single-car accident that took place on Interstate 45 at approximately 3:30 am on Saturday, May 23rd. While the officer was still in his patrol car, it was struck by a vehicle driven by 28-year-old Moroof Kareem.

The officer got out of his patrol car to assess the damage. He was then struck by a Ford Escort being driven by Richard Sandoval, 22. As a result, Officer Morrison was pinned between the Escort and a fire truck which was already on the scene.

Officer Morrison suffered two broken legs and serious injuries to his right arm. He appeared to respond well to the surgery he underwent on Sunday, May 24th. Officer Morrison will require extensive rehabilitation to fully recover from the injuries.

Both drivers have been accused of drunk driving. Kareem has already posted bail on a DUI charge. Sandoval is expected to be charged with intoxication assault.

Two are killed when truck crashes into used car lot

A truck crashed into a car lot early on the morning of Tuesday, May 19th, leaving two people dead. The driver apparently lost control of the vehicle, first careening off the road, then striking a curb. After striking the curb, the truck plowed through a nearby car lot.

The deceased are Sonia Salazar, who was driving the truck and Xzaiden Salazar, a passenger. Sonia and Xzaiden are 25 and 35, respectively. Xzaiden died at the scene of the accident. His wife Sonia was taken to University Hospital where she later died from her injuries.

A third passenger in the truck suffered a broken arm.

The car lot is owned by Luis Rodriguez, who says that his insurance should cover the damage to his property. According to Rodriguez, the damage totals around $15,000. Seven of the used vehicles for sale were damaged.

Jeep crashes into townhouse, injuring three

Three people have been hospitalized as a result of a Jeep crashing into a Houston townhouse. The driver of the Jeep, a 25-year-old man, lost control of his vehicle and jumped the curb in front of the townhouse. The Jeep first struck a satellite dish pole and then a tree before finally flipping and rolling into the home.

The Jeep crashed through a bedroom wall, where Betty McCurdy, who resides in the townhouse, had just gone to sleep. The impact from the crash knocked her to the floor. McCurdy says she looked up to see the Jeep headed right at her. The vehicle entered the room backwards.

McCurdy, who was suffering back pain, was taken to a hospital as a precautionary measure. A second woman who resides in the townhouse was taken to the hospital because of chest pains.

The driver of the Jeep sustained a skull fracture, as well as other serious injuries. He was taken to a hospital by Life Flight.

The precise cause of the accident is still under investigation. Police are looking into whether alcohol or speed could have been a contributing factor.

Four contractors suffer injuries in vessel accident

Four contractors were injured Wednesday morning when a vessel lined with cement rolled off its supports. The accident took place at Freeport Welding in Freeport, Texas.

All four men were inside of the vessel when it started to roll on the backside of the welding facility. Three of the contractors were taken to a Houston hospital by helicopter. The fourth was driven to Brazoport Regional Health System in an ambulance.

Good Samaritan struck by tour bus

A Good Samaritan, who has not been identified by name, witnessed a truck have a blowout and strike a center divider on I-10 West on Tuesday, May 19th. The 50-year-old man pulled over to the shoulder of the road to check on the driver of the truck. As he was waving to the driver to find out if she was alright, he was struck by a tour bus that swerved onto the shoulder.

The impact caused the Good Samaritan to be thrown backwards and collide with his own vehicle. He was taken to Thomas Hospital; the extent of his injuries are currently unknown. No other injuries have been reported.

47-year-old Killeen man killed in head-on collision

A 47-year-old Killeen, Texas, resident is dead after a head-on collision that occurred early Monday morning, May 18th. Rodrigo Enriques was killed when his car was struck head-on by a car traveling north in the southbound lane of State Highway 195, just north of Florence.

The two passengers in Enriques’ car, Vladimiro and Junior Alvardo, 46 and 23 respectively, suffered non-life threatening injuries. The driver of the vehicle who caused the accident is 21-year-old Luis Hirsh. He was in severe condition when he was taken to a nearby hospital.

3-year-old Girl Killed in Car Accident involving Sheriff's Deputy

A three-year-old girl died at the scene of a Lubbock car accident after being thrown from a 1996 Chevrolet Suburban.  Hannah Spoon was not in a car seat when the SUV ran a stop sign, colliding with a Sheriff’s patrol car. The accident took place around 10:30 am on Tuesday, May 19th.

Also thrown from the vehicle was Spoon’s sister, 2-year-old Kyra Nesbitt, who was not sitting in a car seat, either. Nesbitt was taken to the hospital in critical condition. She has since been upgraded to good condition. None of the other five people in the SUV suffered serious injuries.

Nesbitt and Spoon’s mother, Kimberly Flores, was driving the car. Her other two children, a 6-year-old boy and a 7-year-old boy, were wearing seatbelts. Neither was seriously injured.

Lubbock County Sheriff's Deputy Ken Mull, who was driving the patrol car, suffered only minor injuries. Spoon is the eighth person to die along a three-mile stretch of FM 2641 in a period of less than three months. All three of the fatal accidents were caused by a driver running a stop sign.

Texas House Bill restores the Right of Injured Contract Workers to Sue

The Texas House passed House Bill 1657, a piece of legislation that restores an injured worker's right to sue property and premises owners for negligence.  The bill was proposed in response to Entergy v. New seatbelt and cellphone laws affecting drivers may be passed by Texas legislature

The Texas legislature is considering two laws that would significantly alter the state’s rules of the road. First is a law that would require backseat passengers to wear seatbelts. Under the current Texas state law, drivers and front-seat passengers are legally required to wear seatbelts. Existing laws only require that backseat passengers aged 14 years and younger wear seatbelts.

The new law, which was passed last week in a 25-6 vote, extends the seatbelt requirement to all backseat passengers, regardless of age. It also covers the much-discussed requirement that children aged 8 years and younger be seated in safety or booster seats.

Texas Roadside Memorials Drive Home the Dangers of Drunk Driving

Small white crosses along the side of the road throughout Texas…each one represents a person killed by a drunk driver in a car accident. The construction of these memorials, which are typically put in place by the victim’s family, are governed by the Texas Department of Transportation.

Man crossing street in wheelchair is hit and killed by dump truck in Houston, Texas

A veteran hospital patient was crossing the street in a wheelchair when he was struck by an oncoming dump truck. The accident occurred while the wheelchair-bound man was crossing Old Spanish Trail in southeast Houston. The man was taken to the hospital with grave injuries where he later died.


The driver of the dump truck lost control of the vehicle after a collision with a Ford Taurus. After the accident with the Taurus, the dump truck continued to move forward, hitting the man, whose name has name has not been released, as he was rolling across the street on a crosswalk.

Building Demolition Accident Injures Worker, Police Officer

A demolition worker in Irving, Texas, suffered two broken legs as a result of a building collapsing on him. The accident took place during the afternoon of Tuesday, May 12th. A police officer called to the scene to rescue the worker also suffered a broken leg.

The accident occurred during a routine demolition of a one-story commercial building. The injured worker was inside of the building, collecting copper wiring, when the building was accidentally bumped by a bulldozer. The minor collision caused the entire building to collapse.

The worker, who has not been identified, was trapped inside of the building. He was unable to free himself because his legs were trapped under the debris. The Irving patrol officer climbed over the debris, trying to reach the worker, and broke his leg in the process.

Woman Dies in Car Crash on I-35E

Darla Dale, a 39-year-old resident of Lake Dallas, was killed in a car accident on Interstate 35E in Lewisville over the weekend of May 9th.  The accident occurred when Dale’s vehicle struck a retaining wall located near the FM 407 exit.

Alcohol and Speed Blamed for Death of Man, Two Children in Galveston Seawall Crash

On Sunday night, May 10th, a Houston man and two children were killed when an SUV crashed into a parked car.  The parked car then struck at least two of the accident victims.  Police are not able to say which two were struck. Fatal Crash Demonstrates Importance of Child Seats

House Passes Change to Booster Seat Law

Under new legislation passed by the House on Monday, May 12, children under the age of 8 would have to ride in a booster seat. The measure passed by a vote of 99-44.

Currently, booster seat requirements only apply to children under the age of 5 who are less than 36 inches in height. This new piece of legislation, which has already passed in the Senate, would extend the booster seat requirement to children under the age of 8 who are less than 4 feet 9 inches tall.

 

Supporters of the measure dismiss arguments that the legislation will pose a financial burden on parents who drive with multiple small children. These advocates counter that booster seats only cost between $15 to $40 each. Represent Allen Vaught of Dallas does not believe the legislation will be cost prohibitive for families. Says Vaught, “"We're talking about $10 for a doggone booster seat. That's too much to save a life?"

 

According to Paula Yuma, an injury prevention expert with Dell Children's Medical Center, riding in a booster seat reduces a child’s risk of being injured in a car accident by 59%. Houston teen killed in Mother's Day motorcycle accident

Mickey Cohen, Jr., 14, was riding on a motorcycle with his father, 34-year-old Mickey Cohen, Sr. when it struck an SUV. The driver of the SUV, 46-year-old Lisa Rogers, was critically injured in the collision. Cohen’s was one of five motorcycles reported to have been driving at high rates of speed about an hour before the crash. Wrong-way accident on Dallas North Tollway kills 16-year-old girl

In the early morning hours of Sunday, May 10th, 16-year-old Kara Taylor of Little Elm was killed in a car accident caused by a driver going the wrong way on the Dallas North Tollway. Taylor’s 15-year-old friend, who was also riding in the car when the accident occurred, suffered only minor injuries.

The driver who caused the accident is 24-year-old Mariza Martinez of Dallas. Martinez was driving her Ford pickup south in the northbound lanes when she hit Taylor’s SUV. As of Sunday evening, no charges had been filed against Martinez. However, Trooper Lonny Haschel of the Texas Department of Public Safety says charges could be filed later, depending on the outcome of the investigation.

Construction worker killed in water tower accident

Construction worker Rob Harrell, 34, of Grand Prairie, was killed when a trench wall collapsed at a water tower construction site.Harrell was in the 10-foot trench as he attempted to connect the new water tower to its power source. The fatal accident occurred on the morning of May 6th at the site in Arlington, which is located about two miles from the University of Texas at Arlington. Harrell was an employee of Harrell and Associates, the company which had contracted with Landmark Structures to construct the tower.  The accident is currently being investigated by the federal Occupational Safety and Health Administration (OSHA). Details of the report will not be released for at least 6 months.

A jury has sentenced 29-year-old Jason Lang Modgling to 10 years in prison for the drunk driving death of 20-year-old Adam Martinez. Modgling was also fined $10,000. The sentence comes after Modgling pleaded guilty to the crime of intoxication manslaughter.

Three young friends were drinking on a summer night in 2000 when their speeding sports car blew a tire and careered off a rural Mississippi highway, killing one and injuring the other two.

The young men's families — and a jury — blamed the accident on a faulty tire on the Chevrolet Camaro rather than excessive speed and the beer the men had been drinking.

The Mississippi Court of Appeals agreed this week and upheld a $2.1 million verdict against Goodyear Tire and Rubber Co. and Big 10 Tire Co.

Travis Kirby, who was 20, was driving nearly 90 mph with two teenage friends on Mississippi Highway 27 between Crystal Springs and Hopewell when the vehicle "left the road, rolled, clipped a tree, continued to roll, hitting another tree, and then came to rest on its side," according to court records.

Kirby was killed. Authorities said his blood alcohol level was 0.25 percent, more than three times the legal limit for an adult driver. Riley Strickland, then 18, and Sidney Odom, who was 19, were both injured.

The lawsuit alleged there was a faulty back tire on the right side of the car. A Copiah County jury found for the families and the Appeals Court upheld the verdict Tuesday.

Attorneys for the companies did not immediately respond to messages left Wednesday by The Associated Press.

Mike Allred, an attorney for Odom, said his client was in a coma for two weeks, hospitalized even longer and will have lifelong difficulties because of his injuries.

"I'm very pleased that the Court of Appeals followed the law and did the right thing in affirming the judgment" because the tire failure "was the direct cause of the accident," Allred said in a telephone interview Wednesday.

The car, which Kirby bought used from a car dealership in Jackson, had the tires replaced by the previous owner. Those tires were bought at Big 10 in Hattiesburg, which "advertised, sold and labeled the tires as being high-performance when the truth is they were ... rated for a passenger car" rather than a sports car like a Camaro, Allred said.

And, Allred said, the tire failed at 10,000 miles when it was rated for 50,000.

The car dealership that sold the vehicle settled out of court.

Goodyear and Big 10 blamed the accident on the excessive speed, Kirby's intoxication and a puncture caused by hitting something in the road, court records said.

After a two-week trial in the fall 2006 — and testimony that the tire came apart because of a defect — the jury found the companies liable and awarded the $2.1 million verdict.

Among several issues raised on appeal was juror misconduct.

Goodyear claimed that the jury forewoman and one of the plaintiffs' attorneys failed to disclose that the juror lost a child to a car accident 10 years earlier and the attorney had been a pall bearer at the funeral.

The Appeals Court found, however, that Goodyear's attorney knew that the juror's son had died in a car accident and allowed her to remain on the jury. And, the court said, the attorney served as a pallbearer at the funeral at the request of a mutual acquaintance and did not know the juror personally and later said "he could not have picked her out of a line up."

The company also claimed a plaintiffs' attorney made inflammatory statements, including during closing arguments: "It is not proper for Goodyear to tell you they can condemn people to death."

The Appeals Court said while the statement was inflammatory, the trial judge addressed it correctly by telling the jury to disregard it.

Goodyear had also asked the court to find that a culmination of errors during the trial lead to a "patently unjust verdict of over $2 million."

Statewide boating deaths at 13

Thirteen people have died in Texas boating accidents this year, one more than at this point last year.

Major Alfonso Campos, chief of marine enforcement for the Texas Parks and Wildlife Department, said the state is off to a "grim start" this boating season, in part because of strong winds.

"This is the time of the year when the wind picks up, but people want to go out because it's warm," Campos told The Dallas Morning News. "But then the wind picks up and they capsize."

Boating accidents on Dallas-area lakes led to the deaths this week of an 18-year-old man and a 37-year-old woman. In both instances, boats overturned in high winds. The wind also might have played a role in the death of a 54-year-old man whose sailboat was grounded last month on Lake Lewisville, considered one of the state's most dangerous lakes.

Sixty-one people died on Texas waterways last year. The number of deaths has steadily risen annually since 2005, when 36 were reported.

Man arrested after Fort Worth auto-pedestrian collision

FORT WORTH -- One man was in the hospital and another man was in police custody early Monday following an overnight auto-pedestrian collision.

It happened just before midnight Sunday in the 3200 block of North Main Street on the Fort Worth's north side, said Sgt. Rodney Bangs, supervisor of the traffic investigation unit.

A 48-year-old man was struck by a passing vehicle as he and his nephew were crossing the street, Bangs said.

The driver of the car slowed but then fled the scene, Bangs said. Motorists who witnessed the collision followed the car to a nearby bar two blocks away.

The witnesses said the man parked and went into the bar. They contacted officers who responded to the injured man and gave a description of the man who had gone into the bar, Bangs said.

Officers found the 19-year-old man inside, Bangs said.

"He subsequently confessed to the offense," he added, "and was taken into custody."

The man would be charged with causing the accident, but there was no evidence that the man was drunk, even though he was found in a bar, Bangs said.

The pedestrian who was injured was in critical but stable condition at John Peter Smith Hospital early Monday, Bangs said.

1 dead in auto-pedestrian accident in south Fort Worth

A woman was killed early Monday when she was struck by two vehicles on the northbound service road of Interstate 35W near Seminary Drive, police said.

The incident was reported at about 6 a.m., said Sgt. Rodney Bangs, supervisor of the Traffic Investigation Unit.

The 54-year-old woman, whose name was unavailable at 8:15 a.m., may have walking to get roadside assistance for a stranded vehicle, Bangs said in an e-mail.

"She was struck by a delivery van driver who stated that he did not see her in the roadway," Bangs said.

The woman was hit a second time by a Dodge pickup truck that was following behind the delivery van, Bangs said.

She was pronounced dead at the scene, he added.

Police declined to release her name because her family was not yet notified, but a vehicle that was registered to her was found nearby, Bangs said.

"Investigators believe that she may have been walking to seek help due to her vehicle breaking down," Bangs said. "Due to the circumstances criminal charges are not anticipated."

FDA Recalls Hydroxycut Products - 23 Liver Injuries and One Death

Today, partners at Fears & Nachawati Law Firm learned the FDA has recalled Hydroxycut products, popular dietary supplements used for weight loss.  FDA reports indicate that there has been at least one death and 23 Liver injuries linked to the products.  The Hydroxycut products are commonly used as fat burners or energy boosters.  which are also used as energy enhancers and as fat burners.  The 14 Hydroxycut products are manufactured by Lovate Health Sciences Inc. of Oakville, Ontario, and distributed by Lovate Health Sciences USA Inc. of Blasdell, New York. 

The company is voluntarily recalling the following products: Hydroxycut Regular Rapid Release Caplets, Hydroxycut Caffeine-Free Rapid Release Caplets, Hydroxycut Hardcore Liquid Caplets, Hydroxycut Max Liquid Caplets, Hydroxycut Regular Drink Packets, Hydroxycut Caffeine-Free Drink Packets, Hydroxycut Hardcore Drink Packets (Ignition Stix), Hydroxycut Max Drink Packets, Hydroxycut Liquid Shots, Hydroxycut Hardcore RTDs (Ready-to-Drink), Hydroxycut Max Aqua Shed, Hydroxycut 24, Hydroxycut Carb Control and Hydroxycut Natural.

Last year alone, Lovate sold more than 9 million units of Hydroxycut products, which were distributed widely to grocery stores, health food stores and pharmacies.

Although reports of liver damage is rare, common sypmtoms include brown urine, nausea, vomiting, fatigue, stomach pain, itching and light-colored stools.

The Dietary Supplement Health and Education Act of 1994 required manufacturers to ensure a supplement to be safe before marketing. But manufacturers still don't need to register a product with the FDA or get approval before selling a supplement.

Frequently, employees and workers do not know the reporting requirements for injuries and accidents that occur on the job.  The Texas Labor Code requires all employers in Texas that do not carry workers' compensation to notify the Texas Department of Insurance--Division of Workers' Compensation in writing .  See Texas Labor Code Section 406.004(a).  Employers that do not comply with reporting requirements are subject to penalties and administrative violations.
