Construction worker dies on the job after being run over, dragged by semi-trailer truck

A construction worker was killed Tuesday morning, June 23rd, when he was run over by a semi-trailer truck at his work site in The Colony.

 

The construction site where the accident occurred was located at the Office Creek Pump Station in the 4100 block of Main Street. The construction worker was first run over by the truck, then dragged underneath it.

 

At the time of the accident, the construction worker was under the truck performing some type of repair. The driver, who was unaware of the worker’s location, began to drive forward and away from the site. Other workers saw the man being dragged and stopped the driver.

 

CPR was performed on the worker at the scene of the accident. He was transported to a nearby hospital where he was pronounced dead.  OSHA will be conducting an investigation of the incident. No criminal charges are expected.

Woman killed in head-on collision with tractor trailer

A Burleson, Texas, woman is dead after a head-on collision with a tractor trailer on Monday evening.

The deadly accident took place about five miles south of Cleburne, Texas. The deceased victim is 24-year-old Megan Porter who was pronounced dead at the scene of the accident.

Porter, who was wearing a seatbelt, was driving on Farm Road 1434 when she entered a curve at an unsafe speed. Her car skidded left into the northbound lane where it collided head-on with a tractor trailer.  The driver of the tractor trailer was Juan Castaneda of Cleburne, Texas.

Fiery 18-wheeler accident kills one, injures two

An 18-wheeler struck two parked cars, igniting a fire and killing one woman.

 

Two cars were pulled over to shoulder of I-35 for unknown reasons when the 18-wheeler crashed into them. The accident took place just south of the George Bush turnpike in Carrollton, Texas.

 

The 18-wheeler rear-ended one of the cars, pushing it into the other. He then lost control of the truck which jackknifed and crashed through a concrete retainer wall before erupting into flames.

A 52-year-old woman, the driver of one of the two cars hit by the semi-truck, later died of injuries sustained in the accident. The driver of the 18-wheeler was burned and flown to an area hospital. A Good Samaritan who stopped to help the 64-year-old driver of the 18-wheeler also suffered burns.

The accident, which took place on Wednesday afternoon, shut down the southbound lanes of I-35 while the wreckage was cleared. The names of the victims have not yet been released.

With Chrysler and GM being granted Chapter 11 bankruptcy, hundreds of personal injury and wrongful death claims against the corporation are being dropped – and not by the plaintiffs.The upshot of a government plan to bring GM and Chrysler LLC out of bankruptcy free of debt effectively wipes out the pending suits against them.

Before June 10th, the date on which the company emerged from bankruptcy, Chrysler sold 10 millions vehicles. And now the new Chrysler can’t be held legally responsible for any incidents involving those millions of cars and trucks.

GM is set to emerge from bankruptcy as early as July – and the same rule is likely to apply to the 30 million GM vehicles currently on the road.

The so-called “new Chrysler” is owned by Fiat, which will not be held responsible for liability claims made against Chrysler before the sale. The “old Chrysler” was internally insured. When its assets were vanquished, so too were any funds for legal backing.

Critics are challenging GM’s bankruptcy plan in court, claiming it would essentially deprive consumers of their legal right to pursue a product liability claim. The bankruptcy and sale to Fiat also means that none of the Chrysler vehicles sold before June 10th will ever be recalled for defects.

Experts also say that even consumers who have already won verdicts against Chrysler and GM will likely be unable to collect on their awards.

Mother sues for change after daughter's near drowning on daycare fieldtrip

An Arlington, Texas, mother is suing a daycare center after her daughter’s near drowning last year on a daycare field trip.

 

In 2008, Kyla Shellman, now 7, went on a field trip to an aquatic center with her then daycare Children’s Palace Christian Learning Center. During the field trip, Shellman fell into a 12-foot deep pool where she nearly drowned.

 

Shellman’s mother, Kendralyn Jessie, says that she noted Shellman’s inability to swim on the field trip permission form. Jessie also adds that she was led to believe the field trip was to a “splash park.”

 

Child Protective Services says that there was a lack of supervision during the trip. CPS also adds that Shellman was “placed in a situation that could have led to [her] death.”

 

Jessie is suing for change. She wants to see daycare center violations left online for a longer period of time so that parents can make a more informed choice when selecting care for their children.  Along with Shellman’s accident, Children’s Palace Christian Learning Center has close to 30 violations.

1-year-old killed in Highland Park single-vehicle car accident

A car accident in Highland Park claimed the life of a 1-year-old boy and injured his 19-year-old uncle. The accident occurred early Sunday morning when the uncle became distracted by checking on his nephew, Julian Warren. 

 

Warren’s uncle took his eyes off the road to turn around and check on his nephew in the backseat. He then struck a curb, which sent the car into a nearby median. In order to avoid hitting a fire hydrant, the man over corrected, ultimately wedging the vehicle between a tree and a wall.

 

Warren was transported to the Children's Medical Center Dallas where he later died of his injuries.  The accident is being investigated by the Highland Park police and the Texas Department of Public Safety. No charges have been filed.

State trooper attempts to stop wrong-way driver before car accident near Dallas

Troopers were warned of a wrong-way driver on the Dallas North Tollway before an accident occurred which injured four, says the Texas Department of Public Safety. Ryan Matthew, 27, was speeding and driving south in the northbound lanes all the way from Frisco to Dallas, say authorities.

The accident took place on Sunday, June 21st near the Frankford Road exit. Matthew was driving the wrong way on the tollway for nearly seven minutes and ten miles.

Several callers alerted the authorities to Matthew’s out-of-control driving. DPS, however, says they were unable to stop Matthew, even after positioning a police vehicle in front of him. Matthew, says Lonny Haschel with DPS, simply swerved around the trooper’s vehicle and continued driving.

Eventually Matthew crashed into a vehicle, injuring the two 23-year-old women inside. Both women were taken to Parkland Memorial Hospital for treatment.  Matthew has not yet been charged with any crime.

Wrongful death lawsuit filed by family of man killed in workplace accident

The family of one of the construction workers killed in Austin, Texas, when a piece of scaffolding collapsed has filed a wrongful death lawsuit.

The wrongful death lawsuit has been filed on behalf of the wife and children of Wilson Cerritos. This lawsuit comes on the heels of a workplace accident that took place at the construction site of the 21 Rio condo project last week. Cerritos and two other construction workers were killed when the scaffold they were standing on plunged several stories.

One of the defendants named in the wrongful death lawsuit is American Mast Climbers, the manufacturer of the scaffolding. According to the lawsuit, American Mast Climbers manufactured a defective product and failed to provide adequate warnings.

In addition, the general contractor and subcontractor are accused of negligence for failing to provide Cerritos and the other men with a safe working environment.

Waco toddler dies in auto-pedestrian car accident

A Waco, Texas, toddler was killed after being struck by a truck. The toddler was at a car dealership with his parents when he ran out into the road.

The accident took place on Saturday afternoon, June 20th, at a Miller Suzuki dealership located off of I-35 in Waco. The child was hit by a Ford truck that was towing a trailer and a jet ski. Reports indicate that he was struck by the trailer, which was moving at a slow speed. Witnesses say that the child was pulled under the trailer.

The 19-month-old boy was taken to Hillcrest Baptist Medical Center for treatment. He later died of his injuries while in the hospital.

According to police, the driver was not breaking any traffic laws at the time of the accident. The accident remains under investigation.

Head-on collision in Flower Mound claims one life

On Friday, June 12th, a two-car accident claimed the life of a male driver. The driver of a Dodge Durango collided with a cement truck head-on. The accident took place in Flower Mound, Texas, at approximately 4:00 p.m. The cause of the accident remains unknown.

More than half of Texas teens admit to drunk driving

A recent survey of teen driving habits yielded some shocking statistics. Out of the 233 surveyed, more than half admitted to either drink and driving or riding as a passenger in a car being driven by a drunk driver. 

The study, which was conducted by Allstate Insurance Company, shows that a high percentage of Texas teen drivers are engaging in negligent behaviors while on the road. For example, nearly 90% of those surveyed admitted to either sending text messages or talking on the cell phone while driving.

Other disconcerting statistics include:

  • 33% were involved in an accident their first year of driving
  • 48% were stopped by police their first year of driving
  • 30% have driven so fast that they have lost control of their vehicle or have been the passenger of a teen driver who lost control of their vehicle.

Three injured when truck collides with ambulance

Early morning on Thursday, June 18th, an ambulance carrying a pregnant woman collided with a truck in Arlington, Texas. The ambulance was responding to a non-emergency call when the accident occurred. It did not have its sirens or lights on at the time of the collision. 

Two paramedics and the pregnant women who was riding in the ambulance were taken to a hospital, but were released with no injuries. Due to patient privacy laws, no details about the pregnant woman have been released.

The car accident took place at the East Arkansas Lane and South Collins Street in Arlington. The cause of the accident remains under investigation.

Tyler, Texas sees dramatic rise in hit-and-run car accidents

Father, two children killed in Plano, Texas, car accident

A Plano, Texas, father and two of his children were killed in a head-on car accident on State Highway 71. The victims are Russell Rutland, 37, and his 8-year-old-son Hunter and 4-year-old daughter Maddison. The accident occurred when the driver of the other car, 29-year-old John Wayne Horn, crossed over the double yellow lines, striking Rutland’s vehicle head on. 

The accident took place at 9 a.m. on the morning of Saturday, June 6th. The Rutlands were traveling eastbound on State Highway 71. Horn, traveling westbound, struck the left front side of Rutland’s car and drove up it like a ramp.

Horn is currently being held in Burnet County Jail on an outstanding warrants from unrelated incidents.

Rutland’s two other sons, ages 5 and 10, were transported to Dell Children’s Medical Center in Austin, Texas, with only minor injuries.

Three workers killed in construction accident

A construction accident in Austin, Texas, has left three workers dead after a scaffold collapsed beneath them, sending two men plunging 13 stories to the ground.  The victims were working on a high-rise apartment building at 21st and Rio Grande streets on Wednesday afternoon.

The three workers were standing on a piece of scaffolding when it fell from the 11th story of the building, landing on the 7th or 8th story.  The victims are Wilson Joel Irias Cerritos, 30, Jesus Angel Lopez Perez, 28, and Raudel Ramirez Camacho, 27. A fourth man who was also on the scaffold survived. 

As is standard, the accident is being investigated by the Occupational Safety and Health Administration. The reasons for the collapse are still unknown.

Texas workplace injury claims: subscriber and non-subscriber claims

In Texas, there are two types of workplace injury claims: subscriber and non-subscriber. Subscriber claims are the most common. Wrongful death lawsuit comes two years after death of teen in "car surfing" accident

A wrongful death lawsuit has been brought against a Waco, Texas, movie complex. The suit is being brought by the parents of Keon Talton, a 13-year-old boy who died from injuries as a result of “car surfing” in the theatre’s parking lot.

On June 9th, 2007, Keon Talton was riding on the roof of a Jeep Cherokee in the parking lot of the Starplex Galaxy 16 movie theater. Talton fell off the roof, resulting in serious injuries from which he died two days later in a Fort Worth hospital. 

Other defendants named in the lawsuit include the teenage driver of the car, Javonte Verzale Ross, who was 15 at the time of the accident. The owners of the Jeep, Starplex Cinemas Inc., Starplex Operating L.P. and Realty Income Texas Properties have also been named in the suit.

While Talton was riding on the roof of the car, Ross was seen swerving and coming to a quick stop, which caused Talton to fall of the roof. Ross pled guilty to manslaughter for Talton’s death and was given 5 years of juvenile probation.

Talton’s parents allege that both Ross and the theatre complex were negligent. The claim against the theatre is based on an alleged failure to provide adequate lighting and security.

Two killed in a Fort Worth car crash

A car accident in Fort Worth, Texas, has claimed the lives of two people. The female driver and male passenger were in an SUV traveling northbound on U.S. 287. For unknown reasons, the SUV struck a guardrail and rolled down a hill.

The male passenger, 25, was ejected from the vehicle. The driver, 22, was found dead inside of the SUV. She was wearing her seat belt. The names of the victims have not yet been released.

Governor of Texas injured in bicycle accident

Texas Governor Rick Perry broke his collarbone on the night of Tuesday, June 9th while riding his bicycle near his home. Perry, age 59, also suffered minor abrasions to his right elbow.

Perry was treated and released from Seton Medical Center in Austin, Texas. He was wearing a helmet at the time of the accident.

Perry has stated that the accident occurred while he was heading down a hill on a familiar biking trail. For reasons that are not completely clear, Perry went over the handle bars, landing on the backside of his right shoulder.

Perry’s injuries have delayed his trips to Corpus Christi, Galveston and South Padre Island to sign bills related to windstorm insurance reform and supplemental funding for the University of Texas Medical Branch in Galveston.

Mother of four plunges from toll road after being struck by drunk driver

 A wife and mother of four is dead after her truck plunged over the side of Hardy Toll  Road. Investigators believe that the accident was caused by a drunk driver. 

The victim is 44-year-old Cheryl Guberman. Guberman was on her way to pick up her son at the airport when the accident occurred. The accident took place late on Thursday May 28th. 

Guberman’s Dodge Dakota fell twenty feet from the southbound lane of the toll road, landing in a ditch.

The driver accused of causing Guberman’s death is 51-year-old Pamela Pugh. At 11:30 p.m., Pugh called police to report a car accident. She claimed a driver cut her off, forcing her into a wall. Pugh did not tell the police about the woman in the ditch, and the police did not observe the vehicle on their own.

Guberman’s husband and son found Cheryl at around 2 a.m. on Friday morning. The two went looking for her after she did not show up at the airport. Police were immediately called to the scene. The front bumper of Pugh’s car, with the license plate attached, was found in the ditch next to Guberman’s truck.

Pugh was arrested at the scene of the accident on suspicion of DWI. The charge will likely be upgraded to intoxicated manslaughter.

One killed, four injured in head-on collision on Texas State Highway

A head-on collision on State Highway 6 killed one person and injured four. The accident was caused by a driver crossing over the median and heading into oncoming traffic in the southbound lane.

 

The driver was 19-year-old Matias Perez whose Mustang struck a Honda civic which was carrying three people. The driver of the Civic, 53-year-old Rolando Alvarez, died at the scene.

 

His 14-year-old sister and his 3-year-old daughter were both injured and transported to area hospitals. Perez was also injured in the car accident, and was flown to a Houston, Texas, hospital.

A fourth car was also struck, and the driver suffered minor injuries.

 

The accident remains under investigation. The reason for Perez crossing the center of the highway remains unknown.

Driver going wrong way on Texas tollway kills two in head-on collision

A driver going the wrong way on the Dallas North Tollway caused a head-on collision late Monday, June 1st. The collision killed two people.

The driver of the vehicle who caused the accident was 28-year-old Jenny Hall of Dallas, Texas. Hall was driving the wrong way for more than four miles before the accident occurred.

 

The driver of the vehicle struck by Hall was 25-year-old Carl Lotspeich of Addison, Texas. The impact, according to media reports, caused a fire and an explosion. Both Hall and Lotspeich were killed in the collision. There were no passengers in either vehicle.  A third car smashed into a wall while trying to avoid Hall’s vehicle.

 

Police suspect that Hall may have been under the influence of alcohol at the time of the accident. Department of Public Safety Sgt. Robert Bernard cites the presence of alcohol in Hall’s car as the reason for the suspicion.

Three friends die in head-on collision with 18-wheeler

Three young friends were killed when they crashed into an 18-wheeler head on. The car, which contained a total of four people, was driving on Highway 181 in Wilson County, Texas, at 3:25 a.m. Sunday morning, June 7th,. The car drifted into oncoming traffic where it then struck an H-E-B big rig. Officers arrived on the scene and found the car in two pieces.

All four of the individuals in the car were thrown from the vehicle. The accident was so severe that the police have not been able to determine who was driving the car or whether the occupants were wearing seatbelts.

Three of the friends died from their injuries, while the fourth survived with critical injuries. The deceased were 20-year-old Kara Denkewalter, 20-year-old Priscilla Montoya and 18-year-old Orlando Brown.

The survivor is 21-year-old Hector Escuada. Escuada has not yet regained consciousness and remains in the intensive care unit at University Hospital.

Deadly head-on collision kills father, two children

A father and two of his children were killed in a head-on collision on Highway 71 near Spicewood, Texas. The victims are Russell Rutland and his 4-year-old daughter Maddie and 9-year-old son Hunter.

The accident occurred on Saturday morning, June 6th, when a driver crossed over the double yellow line on Highway 71, heading into oncoming traffic. The vehicle then struck Rutland’s car head on. All three victims died instantly upon impact. Rutland’s two other sons, ages 5 and 9, were also riding in the car and suffered only minor injuries.

The driver responsible for the crash is John Horn, 29. He was arrested on charges of driving without a license and without insurance. Horn has admitted to using meth on Friday night. He tested positive for the drug on the day of his arrest.  Horn will likely be charged with three counts of vehicular homicide.

Good Samaritan struck and killed while aiding disabled motorist

A Good Samaritan was struck by an out-of-control driver when he pulled over to assist a stranded motorist. The motorist’s car had stalled while he was driving on the Southwest Freeway near Hazard, Texas. His vehicle was stopped in the emergency lane. The driver of the vehicle is a disabled man.

Both drivers were standing outside of their cars when a third vehicle crashed into the back of the good Samaritan’s car, striking both men. The collision caused one of the men to become pinned between his vehicle and that of the suspect. He later died of his injuries at Memorial Hermann Hospital.

The disabled driver was thrown over the wall of the HOV lane. He is currently listed as being in serious but stable condition at Ben Taub Hospital.  The accident took place around 1:45 a.m. on Sunday, June 7th.

A man running from the scene of the accident, who police believe is the suspect, was taken into custody. He was apprehended while he was attempting to climb over a fence.  If the man is, in fact, the driver of the vehicle who caused the accident, investigators say he could be facing charges of felony evading and intoxication manslaughter.

The names of the two accident victims have not yet been released.

Underage drunk driver causes fatal 3-car accident

Cristobal Isaac, 20, was killed when the car he was riding in was rear-ended by a speeding Ford Taurus. The Ford Taurus was seen weaving in and out of traffic at speeds as high as 100 mph. The Taurus struck the car, a Honda Element, from behind, causing two of its passengers to be ejected from the vehicle.

After his car was struck, the driver lost control of the vehicle, crashing into a guardrail. The Element then flipped over the guardrail and landed on the nearby access road. Another passenger, 22-year-old Stephen Waid, was also ejected from the vehicle. Waid is in life-threatening condition after he suffered severe head trauma.  After striking the Element, the Taurus then hit a Ford Explorer. No one inside the Explorer was injured.

Police believe the underage driver of the Taurus, 18-year-old Clayton Johnson, was drunk at the time of accident, which took place on SPID on Friday night, June 5th. The car also held three passengers, all of whom are 16 years old. No one in the Taurus suffered serious injuries.

Johnson was arrested and put in jail. According to police, he will be charged with intoxication assault and manslaughter. The three underage passengers, also believed to have been intoxicated, will be charged in conjunction with alcohol use as well.  Police have not yet released the name of the deceased victim.

FDA Recall - Digoxin recalled by Caraco Pharmaceutical Laboratories

Another Digoxin recall was announced by the Food & Drug Administration (FDA) on March 31, 2009.  The digoxin lawyers at our firm, Fears & Nachawati, continue to investigate and actively pursue claims and cases where consumers have been injured by Digoxin and Digitek. 

The FDA posted information listed below about the recall.

Caraco Pharmaceutical Laboratories, Ltd. (NYSE AMEX: CPD), a generic pharmaceutical company, announced that all tablets of Caraco brand Digoxin, USP, 0.125 mg, and Digoxin, USP, 0.25 mg, distributed prior to March 31, 2009, which are not expired and are within the expiration date of September, 2011, are being voluntarily recalled to the consumer level. The tablets are being recalled because they may differ in size and therefore could have more or less of the active ingredient, digoxin. The recalled tablets were manufactured by Caraco Pharmaceutical Laboratories, Ltd. This recall is being conducted with the knowledge of the Food and Drug Administration. Digoxin is a drug product used to treat heart failure and abnormal heart rhythms. It has a narrow therapeutic index and the existence of higher than labeled dose may pose a risk of digoxin toxicity in patients with renal failure. Digoxin toxicity can cause nausea, vomiting, dizziness, low blood pressure, cardiac instability, and bradycardia. Death can also result from excessive digoxin intake. A lower than labeled dose may pose a risk of lack of efficacy potentially resulting in cardiac instability. The recalled lots of Digoxin are listed below.

Man has seizure while driving, crashes into a Wendy's

A man believed to have suffered a seizure while driving his car crashed into a Wendy’s in Killeen, Texas. The accident occurred on Thursday, June 4th at around 10:30 a.m.

The driver crashed into the rear of the building, damaging both his car and the restaurant. A hole was knocked into the freezer where all of the restaurant’s food is stored, and food was thrown everywhere, says the restaurant's general manager Becky Rodriguez. Ceiling tiles and beams also fell.

The driver’s foot was stuck on the car’s accelerator after the crash, causing the back tires to spin. Eventually the tires began to smoke, and the smoke came in through the drive-through window and filled the rear of the building.

It took the rest of the day to clear out the smoke, and the restaurant had to remain closed until 8 p.m. that night. The Wendy’s will be able to continue operating with the use of a portable refrigeration unit.

The driver, whose name has not been released, was taken to the hospital for his injuries by the Killeen Fire Department. No Wendy’s employees were hurt.

Driver flees on foot from scene of fatal car accident

A 23-year-old man was killed when his car was struck by a Chevy Silverado truck traveling the wrong direction on U.S. Highway 290. The driver of the Silverado fled the scene of the accident on foot.  The victim was Gilberto Huerta of Conroe, Texas. He and two passengers were taken to a nearby hospital where Huerta later died of his injuries. The two passengers are both in stable condition.

At a minimum, says Austin police Sergeant Richard Stresing, the driver of the Silverado will face charges of failure to stop and render aid, which is a felony in Texas. Because the driver left his vehicle at the scene, police feel confident that they have enough information to track him down.

Deadly accident in Houston, Texas, leads to two other crashes

A series of crashes which took place early Saturday morning have left one woman dead. The woman lost control of her SUV while driving on Katy Freeway, swerving across all of the lanes and eventually smashing into a concrete wall.

A second SUV hit another car, causing the SUV to flip in the middle of the freeway. An oncoming 18-wheeler then rear-ended the overturned SUV.

Neither the driver of the second SUV nor the driver of the 18-wheeler were injured.

Head-on collision caused by drunk driver kills two, injures three

Two people were killed in a head-on collision which took place on U.S. 59 early Monday, June 1st. An additional three people, including two children, were injured. The three were taken to Houston and Dallas hospital in poor condition.

The accident occurred when a pickup truck driven by 30-year-old Vicente Gonzales struck the car head-on. Gonzales was driving southbound in a northbound lane.  At the time of the accident, Gonzales had a blood alcohol level of .228, which is nearly three times the legal limit. Gonzales is expected to be charged with two counts of intoxication manslaughter.

The two deceased victims of the car accident are 29-year-old Crystal Thomas and 48-year-old Willie Lacy. Both died at the scene of the accident. Thomas and Lacy are common law spouses.

A 7-year-old, Joveair Thomas, is being treated for internal injuries and injuries to his chest. Four-year-old Christopher Gross suffered a broken neck and internal injuries.

Gonzales broke both of his legs and suffered internal injuries. He is listed in critical condition at a Houston hospital.

4 injured, including two San Antonio police officers, in two-car accident

A total of 4 people were hurt in a car accident that took place in front of the AT&T Center in San Antonio, Texas. Two of those injured in the crash were San Antonio police officers.

The accident occurred at 7:30pm on Friday, May 29h. The officers, who were driving in an unmarked patrol car with its siren and lights on, were on their way to respond to a call from another officer. The patrol car then collided with a second vehicle which was driving in the opposite direction on Houston Street.

The two other injured individuals were an elderly woman and a teenager. None of the injuries were life-threatening, and all four of those hurt in the car accident are expected to be fine.  The accident is still under investigation, but no one is currently facing charges.

One child dead, another seriously injured in car accident

A 5-year-old child is dead after a car accident that took place at a rural Terry County intersection. An 11-year-old was also seriously injured in the crash, which occurred on Friday, May 29h at around 7:30 in the morning. The cause of the accident was the driver, 26-year-old Brenda Rodriguez, running a stop sign, resulting in a collision with a pickup truck.

The accident occurred at the intersection of Road 515 and FM 1698. Natalie Rodriguez, the little girl killed in the accident, and Marci Gonzales, the injured child, were two of five children riding in the car driven by Brenda Rodriguez. State troopers say that neither child was wearing a seatbelt.  The driver of the pickup truck suffered no injuries. Neither Brenda nor the three other children in the car were seriously injured.

Facts about Texas motorcycle accidents

According to the Texas Department of Public Safety, the number one cause of motorcycle accidents is the failure of other motorists to see the motorcycle. Driver failure to detect motorcyclists accounts for more than half of all Texas motorcycle accidents, says the Department.

Two likely reasons accounting for this problem is the fact that drivers typically aren’t looking for motorcycles, as well as the fact that motorcycles in general are not as visible as cars. A third factor is the driving habits of motorcyclists, who must respond differently to road conditions, traffic and inclement weather.

Victoria boy struck by SUV while crossing the street on his bicycle

A 14-year-old Victoria, Texas, boy was hit by a car as he was crossing the street on his bike on the evening of Friday, May 22nd. The boy is Joseph Garcia, who was headed back home from a friend’s house when the accident occurred.

The identity of the woman driving the SUV that struck Garcia is not currently available. After striking Garcia, the SUV the collided with a truck being driven by 57-year-old Danny Kearney.

Garcia’s condition is unknown. The driver of the SUV, who had to be extricated from her vehicle, has since been released from the hospital.

Massive accident on highway 365 leaves one dead, five injured

Ray A. Dodson of Port Acres, Texas, age 69, was on his way to a dialysis treatment when he lost control of his truck and struck an oncoming vehicle head-on. Dodson died at the scene of the accident, and five others were injured.  The accident took place early on the morning of Wednesday, May 27th. Dodson was reportedly running late for his treatment.

The accident occurred when Dodson attempted to pass another car on highway 365 by driving on the shoulder of the road. It was then that he lost control of his Dodge Ram, veering into westbound traffic and crashing into several oncoming vehicles.

The collision caused two other accidents involving three other cars. A total of six people were involved in the crashes. All five of the other individuals were injured in the massive accident and were taken to area hospitals for treatment.

An autopsy on Dodson has been ordered because it is believed that preexisting health conditions, and not the collision itself, may have caused his death.

Police identify drunk driver who caused three accidents and led police on chase

Police have identified the man responsible for causing a major accident in Weatherford, Texas, on Tuesday, May 26th. The man is 28-year-old Joshua Alvey, who was drunk driving at the time he was involved in three separate accidents.

On Tuesday afternoon, Weatherford police officers responded to calls about a drunk driver on South Lamar Street. As the police were dispatched, more calls came in reporting two hit-and-run accidents involving the same drunk driver. Police later learned the individual was Alvey.

Police spotted the suspect vehicle and attempted to stop the driver. Alvey refused to stop, instead leading police on a winding chase to Hudson Oaks and back into Weatherford. During the pursuit, Alvey struck a Honda Accord, pushing both vehicles into the intersection of Palo Pinto Street and South Bowie Drive where a third car was struck.

The driver of the Honda was a 49-year-old father who was riding with his 8-year-old son. Both father and son suffered critical injuries in the crash and were taken to two different hospitals. The 40-year-old woman driving the third vehicle suffered non-life threatening injuries.

Alvey was transported to a Fort Worth hospital for non-life threatening injuries. Once treated, he was released into the custody of the Weatherford Police Department.  No injuries were reported in either hit-and-run accident.

South Texas car accident kills three, injures one

A head-on collision with an 18-wheeler has claimed the lives of a Manvel High School senior and her mother. The deceased victims are 40-year-old Margarita Perez and her 18-year-old daughter Elizabeth Ann Perez.

A relative of the two women, 3-year-old Isaac Joe Salas, was also killed in the accident. Elizabeth’s 21-year-old sister was injured. She was taken to a Corpus Christi hospital by a medical helicopter.

The accident took place on Saturday, May 23rd at around 7 a.m. on Highway 285.

Motorcycle accident kills one, injures three

A Houston, Texas, firefighter was killed when his motorcycle collided with an SUV on Wednesday, May 27th. The firefighter, whose identity has not yet been released, lost control of the motorcycle. He crossed the center line of FM 1486 near State Highway 105 when he then struck the SUV head on.

Also riding on the motorcycle was the firefighter’s girlfriend. She was taken to Ben Taub General Hospital in critical condition.  The driver of the SUV and an 8-year-old girl riding in the car suffered minor injuries.

Teenage siblings killed in two-car accident

A brother and sister, both teenagers, were killed when their pickup truck collided with another car in Grand Prairie, Texas. The impact caused the truck to flip, and it landed on its roof.  The two victims are 17-year-old Travaris Davis-Pitts and 15-year-old Ashley Davis-Pitts. Travaris was driving the car when he rear-ended a Ford Focus. The accident occurred late on Sunday night, May 31st.

Upon impact, both the truck and the Focus careened out of control. The truck was launched into a creek bed, when it then crashed onto the bank and eventually landed upside down. Both teens, who were wearing seat belts, were pronounced dead at the scene of the accident.

The driver of the Focus, which also landed on its roof, was Crystal Rayfield, 21, of Arlington, Texas. Rayfield suffered only minor injuries.

The accident remains under investigation, though police believe speed was the primary factor contributing to the crash.

Man ejected from vehicle in two-car accident dies at hospital

Twenty-year-old Thomas Ethridge of Ratcliff, Texas, was killed in a two-car accident on state Highway 103 West on Tuesday, June 2nd. The accident occurred when Ethridge swerved into the oncoming lane of traffic and hit a car being driven by Carol Riggs, 63.

The impact caused Ethridge to be ejected from his car. He landed on a nearby hill. Witnesses say Ethridge was swerving back and forth on both sides of the road before heading into oncoming traffic.

Ethridge was transported by ambulance to the Memorial Health System of East Texas. He died upon arriving at the hospital. Riggs suffered minor injuries and was taken to Memorial Hospital for treatment.
