12-year-old boy killed in construction site accident

 A horrible construction site accident ended in the death of a twelve-year-old boy.

The accident took place at a construction site in Azle, Texas, where a crew from American Gunite Co. was installing an in-ground residential pool in the Covered Bridge Estates subdivision.

At the scene was a truck whose bed was filled with sand. The victim and his 8-year-old brother climbed into the bed of the truck to play in the sand.

After a few minutes in the truck, says the younger brother, the boy was buried in the sand where he eventually suffocated. The younger brother was buried up to his waist in the sand mixture.

The disappearance of the two boys was not noticed until the hose used to pump out the sand became clogged. Upon realizing that the boys were stuck in the sand, workers immediately began digging the boys out with shovels and performed CPR on the victim until paramedics arrived.

The 12-year-old was pronounced dead at Cook Children’s Medical Center. The 8-year-old boy had a broken leg.

Product demonstrator suing Costco over on-the-job injury

 A product demonstrator is suing Costco after being injured by one of the store’s employee.

Charlotte Dickey was demonstrating a product at the Lewisville, Texas, Costco when a Costco employee allegedly rolled over her ankle with a flatbed. Dickey was working in one of the store’s aisles at the time of the accident.

The personal injury lawsuit was filed against Costco Wholesale Corp. on July 21st. The suit alleges that Dickey suffered injuries to her right shoulder and an injury to her left ankle requiring surgery.

In the Texas personal injury lawsuit, Dickey accuses Costco of negligence, claiming the store violated the duty it owed to her to “exercise ordinary care in the operation of its retail sales business.” She is also claiming that Costco failed to provide her with a safe work environment.

Dickey is further alleging that the worker did not properly observe the area around him before rolling out the flatbed.

In her lawsuit, Dickey is seeking damages for her medical expenses, pain and suffering, disfigurement, physical impairment, disability and mental anguish. She is also seeking compensation for lost wages and lost earning capacity.

Dickey’s husband, also a plaintiff in the Texas personal injury lawsuit, is seeking damages for loss of consortium due to his wife’s injuries.

Dickey is not an employee of Costco. She works for C.D.S Club Demonstration Services and was in the store as a representative of her employer at the time of the accident.

Bicyclist hit and killed by truck

A bicycle rider was killed Friday night after he was hit by a truck.  

The victim was 37-year-old Larry Lepley of Cleburne, Texas. Cleburne was traveling in the right lane of Burleson Boulevard, also known as the Interstate 35W service road. He was hit by a truck that was also traveling northbound on the two-lane road.

Lepley was pronounced dead at the scene of the accident. The cause of death was cited as blunt force trauma.  

Police say that Lepley’s bike had no front or rear lights. The speed at which the truck was traveling at the time of the accident is still unknown.

The accident remains under investigation.

Construction worker falls 30 feet at hotel construction site

A construction worker fell 30 feet off of a piece of scaffolding and landed on concrete while working on a hotel in north Bexar County. The worker was wearing a helmet and a harness when he fell.

The worker, whose name has not been released, was a 30-year-old man. He was working at the JW Marriott Resort construction site when the accident took place.

Emergency medical services were dispatched and arrived at the scene around 10 a.m. The worker, who was unconscious when they arrived, was airlifted to UniversityHospital.

Information about his current condition has not been released, and the cause of the construction site accident remains unclear. The construction company running the site, Austin Commercial, said only that they were investigating the incident.

According to a member of the Bexar Bulverde Fire Department, “You could tell he had some internal injuries and possibly some brain trauma as well.”

Driver traveling at 100 mph killed after rear-ending 18-wheeler

A driver traveling at a high rate of speed was killed after rear-ending an 18-wheeler. The accident took place in Arlington, Texas, early Sunday morning.

The deceased victim, 41-year-old Bradley Larson, was driving a Honda Accord eastbound on Interstate 30 at speeds up to 100 mph. He then rear-ended an 18-wheeler and struck an Interstate median.

Larson died on the scene, but the 18-wheeler driver was unhurt.

Because alcohol was found in the Honda, police believe intoxication may have been a contributing factor.

Police are currently seeking information on a second vehicle that was possibly involved in the accident. Witnesses describe seeing a “small blue car” traveling at high speeds near the Honda shortly before the accident occurred.

Jury finds in favor of homeowner in wrongful death lawsuit

On Thursday, the jury reached a decision in a Texas wrongful death lawsuit brought by the family of Joshua Chambers, who was killed by a homeowner while allegedly burglarizing the house. On each of the nine questions to be answered by the jury, they returned verdicts in favor of homeowner Terry Graham.

Chambers’ ex-wife, Amanda Whitsell, brought the wrongful death lawsuit on behalf of her and Chambers’ children, 14-year-old Austin and 10-year-old Elizabeth. Attorneys for Whitsell were asking for a total of $400,000 in damages to be divided equally between the two children.

In February of 2007, Graham shot and killed a man who was allegedly burglarizing his home. That man was Joshua Chambers. No criminal charges were ever filed against Graham as a Smith county jury declined to indict him. 

The major point of contention in the case is determining why Chambers shot Chambers as Chambers was driving away from the scene. After hearing conflicting testimony, the jury had to decide whether Chambers was fleeing from the home or trying to run Graham over with his car.

53-year-old Texas man killed in hit-and-run accident, suspect arrested

A 53-year-old man found lying in Amarillo Boulevard on Wednesday night is believed to have been the victim of a hit-and-run accident.

The victim was Earl William Peddicord. Peddicord suffered severe head injuries. He died at a local hospital a few hours later.

Witnesses to the accident say that the driver struck Peddicord while Peddicord was crossing the street. The driver then fled from the scene.

Police have located and arrested a suspect whose name has not been released. However, police have revealed that the suspect is a 26-year-old male. He has not yet been charged with the deadly hit-and-run accident. He was arrested on an unrelated charge and is being held in Potter County Detention Center.

The suspect has since admitted to driving the car that struck Peddicord after police confronted him with evidence of his guilt. Police say that the suspect will likely be charged with a third-degree felony count of an accident involving injury or death.

Teen killed after being broadsided by 18-wheeler

A 15-year-old was killed in a car accident involving an 18-wheeler. The accident took place on Tuesday evening near Muleshoe, Texas. The driver, Eric Zille, failed to yield to the right of way, which resulted in his car being broadsided by the 18-wheeler.

Zille and a passenger were traveling in a 2007 Chevy Impala when they pulled out onto U.S. 84 in the direct path of an oncoming 18-wheeler.

The victim killed in the crash was Zille’s passenger, Lizette Sandoval, also 15. Zille was flown to University Medical center. His current condition has not been released.

Denton woman sues after slip and fall on a soapy CVS floor

A Denton, Texas, woman who slipped on soap on her way out of a CVS Pharmacy is now suing for her personal injuries.

The slip and fall victim is Denton resident Vicky Avelar. The suit named both CVS Pharmacy Inc. and the owner of the property where she fell as defendants. Avelar is seeking $150,000 in damages for her injuries.

According to her personal injury lawsuit, Avelar suffered physical pain, mental anguish, disfigurement and impairment as a result of the accident. She is also suing for her medical expenses.

The suit alleges that the soap at the front entrance of the store, Little Elm CVS, created a dangerous condition. It further alleges that the defendants either knew about the soap or should have known about the soap.

In her suit, Avelar argues that the defendants had a duty to rectify the condition and to warn her that the condition existed.

One dead, one in critical condition following three-car accident

One person is dead after a three-vehicle car accident in Amarillo, Texas.

 

The accident occurred when a Nissan XTerra, which was traveling northbound on Coulter, crossed the turning lane, striking the back-end of a Buick LeSabre in the southbound lane.

 

After striking the Buick, the XTerra then hit a Ford Mustang, also in the southbound lane, on the passenger’s side. The driver of the Mustang, 29-year-old Pedro Serrano, died from the injuries he sustained in the accident.

 

The driver of the XTerra, 18-year-old Cameron Meyers, suffered non-life threatening injuries for which he is still being treated. The driver of the Buick was unharmed.

 

The accident remains under investigation, with charges against Meyers pending.

One dead, two injured after Weatherford, Texas, car accident

Weatherford police are continuing to investigate a fatal car accident that claimed the life of a Weatherford man over the weekend.

 

The victim was 51-year-old Marion Linville, who was driving westbound near the intersection of Jacksboro-Graham Road and 4th street when the accident occurred on Sunday evening. For unknown reasons, Linville crossed over into the oncoming lane of eastbound traffic, colliding head-on with a van.

 

Linville was taken to Weatherford Regional Medical Center where he was pronounced dead approximately one hour after the accident.

 

One of the occupants of the van, 59-year-old Sandra Whittlesey, suffered severe injuries and was taken by air ambulance to a Fort Worth hospital. The van’s second occupant, 22-year-old Phyllis Whittlesey, suffered minor injuries and was treated at the scene.

 

After the initial impact with the van, Linville’s truck struck a third vehicle. The driver of the third vehicle was not injured, and the car sustained only minor damage.

 

Based on their preliminary findings, investigators do not believe any criminal offenses played a role in the accident.

Two-car accident ends in security guard shooting and killing driver

What started out as a hit-and-run car accident ended with one of the drivers being shot and killed by a security guard.

The bizarre series of events started with a car crash in Austin, Texas. One of the drivers left the scene of the accident but later returned and ran over one of the passengers involved in the wreck. An apartment security guard witnessed the accident and fired several shots at the fleeing man. The man wound up dead from the gun shots.

In the early morning hours on Monday, a Chevy Tahoe struck a pickup truck at the entrance to an apartment complex. Police believe, however, that it was no accident.

The accident, says APD Sgt. Joseph Chacon, came as a result of a verbal altercation between the two drivers. After striking the pickup truck, the driver of the Tahoe, 29-year-old Gerardo Martinez, immediately drove away.

The driver of the Tahoe returned to the scene only a few minutes later. The security officer ordered the man out of the car. After the driver stopped, a passenger exited the vehicle and was run over when Martinez slammed on the gas.

The Tahoe then headed straight towards the security guard, causing the security guard, in his words, to fear for his life. He then opened fire on the Tahoe, completely unloading his clip.

After being shot at, the driver of the Tahoe left the scene for a third time and was stopped just a few blocks away by police. He had been hit by the gun shots and was taken to an area hospital where he later died.

Investigators do not currently anticipate any charges being brought against the security guard.

Two injured in Texas motorcycle accident

Two people were injured in a motorcycle accident on FM 309 in Navarro county on Saturday afternoon. The two victims were 53-year-old Donald Galloway and his passenger, 52-year-old Martha Dudley.

Galloway suffered serious head injuries, and Dudley, says a DPS trooper, possibly broke her arm.

The accident took place when the two were riding their motorcycle on FM 309, approaching the Highway 278 intersection. Investigators believe the motorcycle was traveling too fast for the curve, and the driver of the motorcycle realized too late that he was approaching a stop sign.

As a result, the motorcycle ran off the road, barreled through the intersection and eventually came to a stop on the side of the road.  Neither Galloway nor Dudley was wearing a helmet.

This most recent motorcycle accident comes only one week after the horrific crash during a charity bike ride that left three motorcyclists dead.

Woman loses control of vehicle, smashes into vacant Taco Bell

At approximately 9:45 on Thursday night, a woman crashed her Pontiac Grand Am into a vacant Taco Bell in Waco, Texas, causing significant damage to the empty building. The Taco Bell is located between Bosque Boulevard and Cobbs Drive.

The driver was 25-year-old Stephanie Whitehead. The collision knocked Whitehead unconscious, and members of the Waco Fire Department had to remove her from the vehicle by using the jaws of life. Her passenger, Tristan Harwell, 27, suffered non-life threatening injuries.

Whitehead was traveling down Valley Mills when she veered across several lanes of traffic and then struck a curb in front of the Taco Bell. Her vehicle was thrown over the low retaining wall surrounding the property and crashed into the building.

Waco police say Whitehead was traveling at a high rate of speed when the accident occurred.  The damage inflicted on the building is estimated to be around $20,000.

Jury awards nearly $10 million to injured industrial worker

In 2006, an industrial worker was doused with acid in a Texas workplace accident. The worker, Jason Jenkins, suffered severe eye damage as a result. Jenkins sued for his injuries and was recently awarded $9.6 million dollars by a Houston jury.

The accident occurred when Jenkins was adding acid through an acid addition system while on the job at Equistar Chemicals. The jury found that the Dallas, Texas, company Occident Chemical Corporation was negligent in its design of the acid addition system.

In his workplace accident lawsuit, Jenkins alleged that the system lacked a pressure indicator and that it did not properly vent pressure. As a result, the pressure vented near Jenkins’ face, causing him to lose most of his vision in one of his eyes.

Both Occidental and Equistar were found responsible for the accident. Jenkins was also found to be 5% responsible.

Two-car accident kills mother and son, injures infant daughter

A Friday morning car accident ended in the death of a Denton county woman and her 4-year-old son. The accident took place in Frisco at the intersection of U.S. Highway 380 and Dallas Parkway.

The woman was 30-year-old Kavari Gael Gray. Her son was named Klein. A third victim, Gray’s infant daughter, is in critical condition and is being treated at Children’s Medical Center in Dallas.

Gray was traveling east on Highway 380 on Friday morning at around 9am. The accident was caused by Gray turning left in front of a Dodge pickup truck headed west on 380. Jose Hernandez, the driver of the truck, was not injured.

Gray’s Honda SUV flipped over a trailer being pulled behind Hernandez’s truck, eventually landing on its wheels in a nearby ditch. The truck, which was hauling Bobcat heavy equipment, wrapped around a light pole. The equipment fell from the trailer onto the ground upon impact with the pole.

Investigators have determined that the traffic headed in both directions had a green light at the time of the accident. Gray failed to yield to the right of way when she turned out in front of the oncoming truck.

Fort Worth, Texas, car accident ends in two deaths

A one-car accident in Forth Worth, Texas, killed two women in the early hours of Friday morning.

The fatal accident took place at approximately 3am on the exit ramp leading from westbound Highway 121 to southbound Interstate 35W.

The vehicle collided with a guard rail, causing the driver to lose control of her Honda sedan. Police are not entirely sure at this point, but it does appear that the driver was speeding at the time of the accident. Overnight wet weather may also have been a contributing factor.

Also, several containers for alcoholic beverages were found in the vehicle. The two victims, both in their 20s, were not wearing seat belts.

Picketers hit by car in Fort Worth, Texas

Two picketers were struck by a car Wednesday morning as they protested outside of a Fort Worth, Texas, Bell Helicopter plant.

The driver was 76-year-old Cullen McNair, a nonunion Bell Helicopter employee. McNair accelerated his vehicle as two picketers were walking between cars, knocking both victims to the ground.

McNair was arrested on charges of aggravated assault with a motor vehicle, a second-degree felony that could land him in prison for up to 20 years.

Approximately 2500 Bell Helicopter manufacturing workers went on strike one month ago at several plants in the Dallas/Fort Worth area. Negotiations resumed for a fourth time on Wednesday.

The victims suffered only minor injuries.

Six injured in head-on collision

A two-car head-on collision near Denison, Texas, sent six people to the hospital on Thursday afternoon. Two of the victims had to be transported by helicopter to nearby hospitals.

The car accident took place on Richerson Road, just east of Denison, at about 4:00 pm. One of the cars was driven by 19-year-old Brittani Barnett; the other driver, also 19, was Rex Morgan. The other four injured victims ranged in age from 9 to 17 years old.

The two vehicles were traveling down the center of a narrow road when they collided head-on. One of the cars burst into flames upon impact. The door had to be cut off one of the vehicles in order to free a passenger.

According to police, possible factors contributing to the accident may be speed and a failure to yield to the right-of-way.

Man driving in HOV lane with mannequin causes multi-car accident

After causing a four-car accident, a man driving alone in a Houston, Texas, HOV lane with a well-dressed mannequin got caught trying to circumvent the law.

Traffic in Houston can get bad, which tempted the driver of a pickup truck, 54-year-old Michael Hooper, into dressing up a male mannequin in a Ralph Lauren shirt, even going so far as to a put a pen in the mannequin’s front pocket. Hooper was clever in making the mannequin look as real as possible – he reinforced its neck so that it wouldn’t slump over in the seat.

At around 7:00 am in the inbound 290 HOV lane near Fairbanks, Hooper rear-ended the car in front of him, which resulted in a chain reaction of car accidents. Two people were trapped inside the first car Hooper struck and had to be cut out of the vehicle. No one was seriously injured.

The driver of the pickup truck was given a $175 citation for violating the HOV laws by riding solo. Police say they catch people driving in the HOV with mannequins about once a month. The most common ploy is putting a baby doll in a car seat.

Driver loses control of 18-wheeler, smashes into train tracks

An 18-wheeler traveling just outside of the Forney, Texas, city limits on Highway 80 veered off the highway, causing serious damages to a set of rail road tracks.

The driver lost control of his vehicle and busted through a protective cable that separates the highway from the nearby service road. The 18-wheeler continued barreling down the embankment at a high rate of speed, plowing through bushes and uprooting trees. The truck finally came to a stop when it struck a set of train tracks.

The driver was ejected from the truck upon impact. Reportedly, the impact caused the train track to move approximately two inches out of line.

The driver of the tractor trailer was seriously injured and had to be transported to a hospital by Care Flight.

75-year-old Arlington man killed in hit-and-run car accident

A 75-year-old Arlington, Texas, man was killed in a hit-and-run accident on Tuesday afternoon. The Arlington police are asking for the public’s help in locating the driver of the maroon four-door car that caused the accident.

The victim of the car accident was John Price. Price died from the injuries he incurred when his van, which was traveling along Interstate 20, was overturned. The two passengers in Price’s van were also injured.

The accident occurred when the maroon vehicle hit the van, causing it to skid across the highway, strike a concrete median and flip over. The driver of the maroon car fled the scene.

Price was taken to a nearby hospital where he died five hours later.

Police are asking anyone with information about the accident to phone the Arlington police department at 817-459-5667.

NTTA takes steps to reduce number of wrong-way collisions on Dallas North Tollway

Official are taking action after a recent rash of wrong-way car accidents on the Dallas North Tollway have left four dead and several others critically injured.

Steps are being taken to warn drivers who are headed the wrong way on an exit ramp. One such step is placing reflective buttons, which are laid out in the shape of arrows, on the lanes of each of the tollway’s 47 exits. The arrows will glow red if a driver is driving the wrong way on the ramp.

In addition, 25 new warning signs have been posted that state “wrong way” or “do not enter,” which ups the total of warning signs to 215.

These actions come in response to the five wrong-way car accidents that have taken place on the Dallas Tollway this year. By contrast, there were only three fatal accidents out of 28 in 2003 to 2008.

Other approaches, such as low-hanging warning signs and electronic billboards to alert other drivers to a wrong-way driver, are being considered.

Company may face negligent homicide charges in construction site accident

According to an Austin, Texas, police search warrant, the scaffolding that collapsed, killing three construction workers was improperly assembled.  The story was previously posted in our blog here

If the claim of negligence is substantiated, then the construction company who put the platforms together could be facing charges of negligent homicide. Criminally negligent homicide is a felony which can result in 2 years of jail time and a fine of $10,000.

The warrant was issued last week, enabling police to seize parts of a mast climber, which is a platform scaffold used by workers to scale the outside walls of buildings. According to the warrant, the device which was seized was constructed by American Mast Climbers of Whitney.

General Metroplex Interiors, the subcontractor hired to handle the building of stucco and frame work, hired American Mast Climbers to install and maintain the scaffolding.

The pieces of scaffolding were seized by investigators in order to determine what caused the equipment failure that ultimately led to the collapse. OSHA investigators, after examining the equipment, informed police that some of the components that made up the mast climbers were faulty. The use of this faulty equipment, says OSHA, may be enough to warrant a charge of criminally negligent homicide.

One killed, three injured in car accident with 18-wheeler

An Irving, Texas, woman was killed Saturday night after the car she was riding in ran a red light and collided with an 18-wheeler. Three others were injured in the accident.

The victim was 64-year-old Blanca Benavides. Benavides was riding in the backseat of the Toyota SUV when it struck the 18-wheeler.

The car accident took place at around 8pm on West Irving Boulevard near the 2200 block. The SUV was being driven by a 38-year-old Irving woman whose name has not been released.

The driver and two other passengers, a 3-year-old and an 8-year-old, were taken to Dallas-area hospitals. The driver of the 18-wheeler was not hurt.

Fort Worth man hit and killed by SUV after van runs out of gas

A Fort Worth, Texas, man was killed in a car accident Sunday night after being hit by an SUV.

The victim, 78-year-old Floyd Boortz, was standing outside his van on the service road of Interstate 30 putting gasoline into the vehicle’s tank along with a 20-year-old male, one of the van’s passengers. A Kia sports utility vehicle exited the freeway and struck the two men as well as the van.

The 20-year-old man, whose name has not been released, was critically injured. A 20-year-old female and a 2-year-old boy were also inside the van. Neither was injured.

Before the accident occurred, a good Samaritan driving a Dodge sedan stopped to help and parked in front of the van. After striking the two men and the van, the SUV then smashed into the parked Dodge. The driver of the Dodge was not hurt.

$16 million settlement reached in wrongful death lawsuit over death of Cleburne woman

A settlement has been reached in the wrongful death lawsuit brought by the family of a Cleburne, Texas, woman who was killed when gas well equipment from a passing vehicle smashed into her car.

The testimony was stopped after witnesses gave conflicting statements during the trial on Thursday morning. A settlement was offered to the family later that day.

Pioneer Drilling, the company that employed the driver responsible for the accident, settled the wrongful death lawsuit with the family for $16 million.

The victim was 41-year-old Rhonda Kay Henson. Her family sued both Pioneer Drilling and the driver of the truck, charging the defendants with negligence and a wrongful death claim.

Forth Worth car accident involving public transit bus kills one, injures three

A Forth Worth public transit bus rear-ended two vehicles on Friday, killing one and injuring three others in a chain-reaction multi-car accident.

The 5-vehicle accident took place in the eastbound lanes of Interstate 820 shortly before 6pm. According to the Fort Worth Transportation Authority operations manager, a vehicle stopped short in front of the bus, which was a one of Fort Worth’s “T” special needs buses, a bus that is outfitted specifically to transport the disabled and elderly.

The bus rear-ended the vehicle, which then slammed into a second car. All three vehicles went up in flames.  

Two people were taken to Dallas area hospitals in critical condition. A third was taken to a Forth Worth hospital in stable condition.

The driver of the bus, 34-year-old Ronnie Ware, incurred minor burns on his arms and hands while helping the bus’s single passenger to safety. The passenger was not injured.

Truck kills three after plowing into motorcycle fundraiser

Three people are dead after a pickup truck swerved head-on into a group of motorcycle riders. The motorcyclists were participating in a charity ride to benefit the dance team of Corsicana High School in Navarro County, Texas.

The three victims killed in the accident were Corsicana High School science teacher, Leslie Tahamia McCluney, 34, her 61-year-old father Terry Paul Nelson and 54-year-old real estate agent David Edmond Coley.

The driver of the truck was 54-year-old Will Jack Lindsey, Jr. Lindsey was driving his Ford pickup eastbound on FM709 when he swerved into the westbound lanes, colliding head-on with Coley and Nelson’s motorcycles. McCluney was riding on Nelson’s motorcycle when the accident occurred.

After striking the two motorcycles, Lindsey’s truck overturned, striking two more motorcycles in the process.

What caused Lindsey to swerve into the westbound lanes remains unclear.

More than 30 motorcycles were participating in the 90-mile charity ride when the accident occurred on Saturday morning.

Rider and passenger killed in Texas motorcycle accident

A motorcyclist and his passenger are dead after colliding with an SUV on Tuesday night in Clute, Texas. The two victims were 24-year-old Alexander Reyes and 23-year-old Erin Anthony.

The accident occurred at 10pm when a 2002 Ford Escape SUV pulled in front of the motorcycle’s path. Reyes struck the SUV, and both he and Anthony were ejected from the motorcycle. Neither Reyes nor Anthony were wearing helmets at the time of the accident.

The SUV was being driven by a 75-year-old woman from Lake Jackson, Texas. She was driving eastbound on Plantation Drive when she turned left in front of Reyes’ motorcycle. The woman was taken to a hospital for her injuries where she was treated and released.

Authorities say the driver of the SUV will likely receive a citation, but they are not yet sure what the citation will be.

Together the Clute Police Department and the Texas Department of Public Safety will recreate the accident, and then the case will be referred to a grand jury, say police.  To read more on the story click here.

Texas worker killed on the job, local residents protest

The waste-processing worker who was severely burned in an on-the-job accident has died. His death has sparked a series of protests from Houston, Texas, citizens who live near the plant, CES Environmental Services.

The victim, who officials have declined to publicly identify, was cleaning a tank, which had been carrying ethanol, when the accident occurred. The accident took place when the lantern the employee was using to examine the tanker caused an ethanol flash. The Harris County Medical Examiner’s Office says that the worker suffered third-degree burns over most of his body as a result of the explosion.

This worker’s death was actually the third fatal on-the-job accident at a regional CES operation since December. The two other accidents did not take place at the same operation where Tuesday’s explosion took place. Other incidents, however, have occurred there in the past nine months, including one fire and two explosions.

Back in January, Houston sued CES Environmental Services after two explosions at the operation shook the ground and sent debris flying into the yards of nearby homes. The lawsuit sought to have the facility temporarily shut down. A settlement was reached in February.

Since the time of the lawsuit, both OSHA and the Texas Commission on Environmental Quality has alleged numerous violations of safety regulations against CES.

Family files suit over inmate's death

The family of an inmate who died at Potter County Detention Center last year filed a lawsuit in federal court in Amarillo this week.

 

Marvin and Diane Dick, parents of the deceased inmate Michael Dick, allege that their son was denied proper medical care while in custody. The suit named Potter County, members of the medical staff and several jailers as defendants. The family is seeking burial expenses, punitive damages and damages for Dick’s pain and suffering.

 

Dick was arrested for a violation of his probation in July of 2008. Ten days later, on July 19th, Dick was found dead in his cell. The suit alleges Dick died from peritonitis, a condition caused by the inflammation of the thin membrane that lines the abdominal wall.

 

The suit alleges violations of both the American with Disabilities Act and Dick’s 14th Amendment rights. According to the suit, the jailers and medical staff deliberately ignored the signs of Dick’s illness, left his medical condition untreated and denied Dick his prescription Xanax, used to treat panic and anxiety.

Punitive damages in wrongful death cases

Texas is among a limited number of states that allows for punitive damages in wrongful death cases. Punitive damages are essentially a means of punishing the defendant. In order to collect punitive damages in a Texas wrongful death case, the defendant’s behavior must have been either intentional, malicious or reckless.

Punitive damages are sometimes also referred to as exemplary damages. This is because punitive damages can serve as a way to warn others against engaging in reckless acts.

Family brings wrongful death lawsuit against oil drilling company for fatal wreck

In September of 2008, 41-year-old Rhonda Kay Henson was killed after a piece of oil field equipment fell off of a passing tractor-trailer, crushing the driver’s side of her car.

Henson’s family filed a wrongful death lawsuit against the driver of the tractor-trailer, Daniel Armstrong, 21. The suit also names the company for which Armstrong worked, Pioneer Drilling Company, as a defendant. The suit alleges that both defendants were negligent.

Testimony in the trial began Tuesday in the 413th District Court in Cleburne, Texas.

The 15-ton piece of equipment was secured with only two chains, while state and federal laws require four. Because the equipment was not properly secured, says the family’s lawyer, it slid around until it eventually fell from the truck onto Henson’s Ford Explorer.

Also, according to the plaintiffs’ attorney, Armstrong had a suspended license and was not qualified to drive the tractor-trailer. His records, the attorney says, were forged and fabricated by other employees of the company.

Henson’s husband, Thomas Henson, was riding in the passenger seat at the time of the accident. He was not seriously injured.

Texas worker is seriously injured on the job in chemical explosion

An explosion at a chemical processing plant left a Houston, Texas, worker severely burned.

The worker was cleaning a tank at a chemical processing plant located on Griggs Road in Houston when the accident occurred. For reasons that remain unknown, the tank blew up, seriously injuring and severely burning the worker.

Truck driver strikes motorcyclist, flees with victim dying in truck bed

The 17-year-old driver of a pickup truck struck a motorcyclist then fled the scene of the accident with the injured victim in the bed of the truck.

The black Chevrolet pickup truck struck the motorcycle from behind, which caused the motorcyclist to flip and land in the truck bed. The truck driver then immediately fled from the scene while the motorcyclist lay dying in the back of the truck.

After leaving the scene of the first accident, the driver then struck three more vehicles, including a furniture store truck. Police say the scene was “chaos.”

The motorcyclist was pronounced dead at McAllen Medical Center. At least four other people had to be taken to local hospitals for treatment. Two are in critical condition. The suspect was among those taken to a hospital. He is in stable condition.

The driver of the pickup truck could face charges of failure to stop and render aid and fleeing the scene of an accident.

Man killed in hit-and-turn motorcycle accident

A motorcycle rider who was the victim of a hit-and-run accident died at a fire station before he could be airlifted to a nearby hospital.

The motorcycle accident victim was 38-year-old Juan Antonio Contreras. Police found Contreras lying next to a 2008 Harley Davidson with serious injuries. The accident took place shortly after 11pm on Sunday night.

Contreras was transported to the fire station by ambulance where the Southwest Medivac service would have airlifted him to a hospital.

El Paso, Texas, sheriff investigators believe that the motorcycle collided with a vehicle, which may have been a pickup truck. The driver of the vehicle fled the scene of the accident.

The investigation into the accident is ongoing.

5 injured in 4th of July car accident

Fourth of July fireworks turned chaotic in Amarillo Saturday night after a multi-vehicle car accident that sent five people to the hospital.

A driver of a Grand Am was stopped in the left lane of Bell Street around 7pm, waiting to turn left into John S. Stiff Memorial Park to watch the fireworks. An Explorer traveling at an excessive rate of speed came up behind the stopped Grand Am. The driver of the Explorer swerved to avoid rear-ending the car and wound up crashing into a Corolla.

At this point, the driver of the Explorer completely lost control of the vehicle, rear-ending the Grand Am and then spinning wildly until colliding with a Dodge pickup.

A stream of people continued to arrive to watch the fireworks and found the Bell Street entrance closed for over two hours. Traffic was diverted to a second park entrance, but those entering on foot walked passed the accident on their way into the park.

UT football player crashes into apartment, resident hires attorney to seek damages

UT linebacker Sergio Kindle crashed into an Austin apartment complex in the early morning hours of Wednesday, July 1st when his car veered off the road. Kindle was sending text messages when his car struck a curb, causing him to lose control of his vehicle. The car then crashed into one of the apartments located in the Jefferson West complex on Rio Grande street.

 

Kindle suffered a concussion. The car was also carrying a passenger who was not injured.

A representative for Kindle contacted the apartment’s management company later Wednesday morning and stated that Kindle would cover the $8,000 worth of damages.

Austin police are considering filing the charge of leaving the scene of the accident against Kindle, which is a misdemeanor. According to Cpl. Scott Perry of the APD, simply leaving a note at the scene would have relieved Kindle of any wrongdoing.

Ashley Zapata lives in the apartment struck by Kindle. Zapata’s bedroom was damaged in the accident. She has since hired an attorney to help her recover compensation for the damage to her personal property, which includes personal belongings and furniture.

Zapata’s attorney is hopeful that the matter can be resolved outside of court.

In July of 2007, Kindle, who is widely considered to be the Longhorn’s top returning defensive player, was arrested for driving while intoxicated.

Farm worker hit by truck while on the job

A 23-year-old farm worker was hit by a truck while working in a field in Lubbock, Texas.

The on-the-job accident took place on Wednesday as the victim, John Ybarra, was picking zucchini in a south Lubbock field.

The driver of the truck was 53-year-old Bill Green. Authorities say that Green was driving on East 82nd street when he drove into the field where Ybarra was working. Green then began driving in circles, eventually striking Ybarra.

Green refused to exit his vehicle, forcing authorities to break a window and forcibly remove him from the truck. He was then arrested. The district attorney’s office is waiting on toxicology reports to determine whether Green was drunk at the time of the accident.

Ybarra was taken to a hospital in critical condition. He is now expected to fully recover and is being treated for a broken breast bone, ribs and collar bone. Ybarra will be left with a scar on his face due to the truck running over his head. His condition has been downgraded to serious.

90-minute police chase ends in car accident, Dallas County constable admits mistakes were made

A controversial high-speed car chase that took place Monday ended in a car accident that left the suspect in critical condition. The chase lasted 90 minutes, with Dallas County Precinct 2 deputy constables and other law enforcement officers pursuing the suspect through four different cities.

The chase came to a stop only when a truck with a green light proceeded through an intersection and t-boned the suspect’s vehicle. The accident took place near the border between Richardson and Garland.

The man who led the chase was 29-year-old Shane W. Michel, who is accused of forgery. Michel was driving wildly out of control, clipping highway signs and successfully avoided the stop sticks thrown into the road by law enforcement.

Michel was critically injured and spent several days in a hospital before he was transferred to the county jail. The driver of the truck was not injured.

The controversy swirling around the chase is centered on why the chase lasted as long as it did. Lack of communication amongst the various law enforcement agencies pursuing the suspect is being considered one of the top factors that contributed to the length of the chase.

The officers in the Department of Public Safety (DPS) helicopter could hear the frequency but were unable to respond. Telephone was the only means of communication between the two agencies.

Miscommunication was another factor. The Precinct #2 constables mistook an announcement over the radio stating “DPS is in it now” for “DPS is in the lead now.”

These factors combined led to the decision to reenter the chase.

Michael Gothard, the Dallas Constable, has admitted that mistakes were made. He does, however, defend the decision not to back off from the chase. Gothard states that criminals leading police on chases typically do not know that the chase has been called off and continue to run. “Our feeling is, in this situation, if we'd have backed off, that accident would still happen,” Gothard said.

Five-car accident on Dallas North Tollway shuts down roadway for hours

A five-car accident shut down both sides of the Dallas North Tollway for nearly three hours on Wednesday morning. Thousands of motorists in rush hour traffic spent hours stuck on the tollway.

The chain of events leading to the five accidents began when a Mustang traveling in a northbound lane struck the front end of a truck. The truck then skidded across four lanes of traffic before landing in a median. The truck’s collision with the median forced a concrete block into the southbound lanes of the tollway.

A second truck, which was traveling in the southbound lanes, struck the concrete block.

The first truck was hauling a generator on a trailer. A car, the fourth vehicle involved in the accident, was traveling in the northbound lanes and hit the trailer which was sitting in the path of traffic.  The fifth car to be involved in the accident was a Volkswagen Jetta that also struck the piece of concrete.

Amazingly, no one was seriously injured.

Mother of Waco man killed in struggle with two security guards brings wrongful death lawsuit

A wrongful death lawsuit has been filed by the mother of a Waco man who was killed in a struggle with two security guards. The struggle, which took place in December of 2007, involved Richard Renschler Jr. and Thomas W. Renschler, brothers who own Texas Star Security.

 

The plaintiff is Sandra Marie Lockhart, of Waco, Texas. Her wrongful death lawsuit is being brought against the security guards over the death of her son, Orlando Gamble.

 

According to allegations made in the lawsuit, Gamble died as a result of “traumatic asphyxia and blunt-force injures associated with restraint.”

 

The suit alleges that the restraint and blunt force trauma was perpetrated by the two Renschler brothers, who are referred to in the suit as “John Doe 1” and “John Doe 2.”

 

Waco police reports describe the incident this way: Gamble drove up to the Parkside Apartments on the night of incident. There he was met by two security guards who asked him what he was doing there. Gamble responded that he was there to see a friend but could not give the security guards a name.

 

One of the guards claims to have seen drugs in Gamble’s car, at which point he asked Gamble to step out of his vehicle. Gamble exited his vehicle and began to run towards the apartment complex. He was then tackled by the guards. After the brief struggle, the guards report that Gamble “just went limp.”

 

Gamble later died of his injuries at the hospital.

 

Defendant Richard Renschler has stated that it is the job of his security company to prevent trespassers from entering the property.

The case was referred to the McLennan County district attorney’s office. No arrests have been made. The matter is still awaiting presentation to a grand jury which will decide if any further criminal action should be taken.

Wrongful death lawsuit against Dallas County jail to move forward

A judge has given the go-ahead on a wrongful death lawsuit brought by the family of a mentally ill woman who died in the Dallas County jail. The ruling comes two years after the initial suit was filed in 2007. 

 

The wrongful death lawsuit centers of the death of Rosie Sims, and is being brought by her three children: Tosha Sims Lee, Melissa Lomack and Archie Sims Jr.

 

According to the federal judge overseeing the case, Sidney A. Fitzwater,  there is enough evidence to pursue at least one of suit’s claims – that Sims was punished in violation of her 14th Amendment rights given the deplorable conditions of the Dallas County jail. Several other of the plaintiffs’ claims were thrown out by Fitzwater.

 

The lawsuit alleges that Sims did not receive medical treatment or routine examinations during the time she was in custody. Guards found Sims lying on the floor in her own waste in November of 2005, according to the suit, but did not take her to be examined.

 

The conditions of the Dallas County jail were found to be so poor around the time of Sims’ death that the federal government became involved and continues to oversee improvements.

 

To date, the county has lost one neglect lawsuit and settled another. The two payouts totaled nearly $2 million.

Waco strip club being sued for negligence over parking lot stabbing

Two men stabbed outside a Waco, Texas, strip club two years ago are suing the establishment, claiming the topless dancers manipulate male patrons and create a dangerous atmosphere.

On June 26th, 2007, two men, Aaron Moreno and Michael Gutierrez, were patronizing the Waco exotic nightclub Two Minnies. Later that night, both men were stabbed outside in an altercation that began inside the club.

The suit names Two Minnies and the club’s owners, James W. Scarborough and Carol A. Scarborough, as defendants.

The altercation allegedly began when a third man became upset that a particular dancer was spending too much time at Moreno’s table. The man, the suit claims, assaulted Moreno inside the club and the altercation continued outside when Moreno was pushed through an exit door into the parking lot. The exit door, the suit alleges, was then locked by the club’s employees, “leaving plaintiff Aaron Moreno outside and unprotected.”

Gutierrez went outside to attempt to help Moreno and was stabbed twice.

The lawsuit alleges that the nightclub was negligent because it failed to train employees in safety procedures, provide security guards or stop the assaults. In addition, the nightclub is accused of being negligent for allowing customers to carry weapons into the bar and for encouraging its dancers to promote the excessive consumption of alcohol.

In addition to the claims of negligence, the lawsuit further alleges that the nightclub is responsible for the plaintiffs’ injuries because the “defendants’ female dance employees are trained by defendants to manipulate male patrons in a manner that produces behavior and conduct that results in patrons’ safety being compromised.”

Head-on collision kills motorcyclist

A head-on collision with an SUV killed a motorcycle rider. The accident took place on FM 2483 in Morgan’s Point on Saturday morning.

The motorcyclist was 55-year-old Alan McClure of Temple, Texas. According to police, it appears that McClure was not wearing a helmet at the time of the accident.

The accident was caused by the driver of the SUV turning left onto FM 2483 and into the path of the oncoming motorcycle. The motorcycle and the SUV collided head-on.

McClure later died of his injuries at Scott & White Hospital.

The driver and two passengers in the SUV have not been identified. None of the three were injured.

The fatal motorcycle accident remains under investigation. Police say the driver of the SUV will be charged with failure to yield right of way.

Baylor student dies in 3-car accident in Waco, Texas

A 21-year-old Baylor University student was killed Monday morning in a head-on collision in Waco, Texas. The victim, Emily Ann Stuller of Dallas, Texas, drifted into oncoming traffic while traveling on North Martin Luther King Blvd.

 

Stuller was driving a 2004 Volkswagen Jetta when she crossed over the double yellow lines on the Brazos River Bridge. Stuller, who was traveling northbound, veered into the oncoming southbound traffic.

 

First Stuller’s Jetta hit a Ford pick-up truck. The truck’s driver, 43-year-old Cirilo Zamarripa of Waco, Texas, saw Stuller headed into his lane and attempted to avoid the accident by pulling over to the right.

 

Stuller struck Zamarripa’s vehicle on the left side and continued to travel northbound in a southbound lane. She then collided head-on with a second truck. The driver of the second pickup was Juan Lopez, a 31-year-old man also from Waco, Texas.

 

Officials pronounced Stuller dead at the scene of the accident. Lopez was treated for injuries to his leg and back. No medical attention was sought by Zamarripa.

Texas theme park redesigns roller coaster that spawned dozens of personal injury lawsuits

The Rattler, a rollercoaster at the Fiesta Texas theme park in San Antonio, Texas, has undergone design changes. Park owners hope that the ride will be safer for park goers…resulting in fewer personal injury lawsuits that have bankrupted one of the builder’s subsidiaries.

 

The Rattler has an infamous history, a history that’s chockfull of personal injury lawsuits. Industry experts, such as Andrew Jakes, a certified safety consultant out of California, blames the rush to be the biggest, the best and scariest coaster. In the push to set a world record, parks sometimes open rides to the public before a sufficient number of tests have been performed.

 

By end of the first season of The Rattler’s being open to the public, park workers received hundreds of complaints of alleged injuries.

Randal Jackson, an attorney who has represented dozens of plaintiffs in their personal injury lawsuits against Fiesta Texas is highly critical of The Rattler. "If you had to design a device that injured people's necks and backs, you couldn't have done any better than the Rattler," says Jackson.

The majority of riders who later complained of injuries claimed they were hurt on the first drop of the coaster. The common complaints were of head, back and neck injuries. The first drop was initially a 166-foot fall. It has since been shortened to122 feet.

Michael Black, who is president of the contracting company that helped build the coaster defends the ride while admitting that the amount of force exerted by the ride was greater than the builders expected.

Says Black, "You got to look at it this way, a million people a year were riding that ride. (Fiesta Texas) got way less than 1 percent, maybe less than half a percent, of people complaining that they either got a sore neck or something worse from riding the ride. That's an extremely small portion."

That small portion, however, has spelled big trouble for Fiesta Texas and Michael Black’s subsidiaries declared bankruptcy in 1996 after being hit with more than 50 personal injury lawsuits.

Diver hired to retrieve golf balls drowns in industrial accident

A 27-year-old man diving for golf balls in water traps around a golf course drowned last Wednesday. The death is being considered an industrial accident.

 

The Las Colinas Country Club golf course hired Christopher Logan to retrieve the golf balls. Logan is scuba certified and worked for the golf course part time.

 

When Logan had not returned by closing time at 8 p.m., an employee went looking for him.

 

Logan’s breathing apparatus was found floating in the water near the 18th hole. The pump which supplies air to Logan was not running. His body was later discovered submerged in the water. The death was ruled an accident due to drowning and carbon monoxide effects by the Dallas County medical examiner.

 

Because the drowning is being considered an industrial accident, it is being investigated by OSHA.

One million dollars sought by Galveston seaman in personal injury lawsuit

A Galveston, Texas, man is seeking damages in excess of $1 million in a personal injury lawsuit after being thrown from a truck bed during a car accident. 

 

The plaintiff is seaman Richard Mendez. In the suit, Mendez accuses both his employer William Wright (A&B Seafood) and the driver of the truck of negligence. Both defendants are blamed for what Mendez is calling “severe and disabling injuries.”

 

Mendez was working as a deckhand for Wright on a commercial fishing vessel named the Alice Mae. The vessel was forced to return to Galveston after four days at sea due to inclement weather.

 

Upon arriving in Galveston, Mendez secured a ride home from Alva Porterfield of Newport, Virginia. Porterfield, the lawsuit alleges, failed to yield to the right of way at a stop sign. The resulting collision with another car caused Mendez to be thrown from the bed of the truck in which he was riding.

Plaintiff Wright is being sued for his failure to ensure Mendez’s safe transport to and from the vessel.

Both Wright and Porterfield are being sued for the “pain and suffering, mental anguish, emotional distress, disability and disfigurement” Mendez claims to have suffered due to the car accident.

Oilfield worker killed in on-the-job accident

An oilfield worker is dead after an industrial workplace accident on Wednesday morning. The fatal accident took place at around 10:30 a.m. near County Road 1040 and East County Road 120 at an Endeavor resource well.

 

The victim was 24-year-old Esau Villerial DelaRosa. DelaRosa was working with Excel Well servicing on a pulling unit at the location.

 

The accident occurred when a swivel swung around and struck the worker in the head. The worker was pronounced dead at Midland Memorial Hospital from massive head injuries.

Three fatal motorcycle accidents in Fort Worth under investigation

Three separate deadly motorcycle accidents that took place on Sunday in Fort Worth, Texas, are under investigation.

 

The first accident involved Dustin Cox, 25, of Forth Worth, Texas. Cox, who did not have a motorcycle license, was killed in a one-vehicle accident. The accident took place in the early hours of Sunday morning in the 6000 block of West FM455.

 

The second accident resulted in the death of 26-year-old Daniel Reed, also of Forth Worth. Reed was traveling northbound on I-35E in the HOV lane along with another motorcyclist when the two came upon a single vehicle accident. Reed was unable to stop and struck the vehicle. The second motorcyclist was not involved in the accident and left the scene.

The third accident took place Sunday afternoon, leaving 38-year-old Brian Mitchell of Fort Worth dead. Mitchell was riding his motorcycle east on FM455 when he crossed over the center line and collided with an oncoming vehicle. Mitchell was not wearing a helmet at the time of the accident.
