According to the National Transportation Safety Board (NTSB), more than 3,000 Americans died last year in motor vehicle crashes attributed to the use of cell phones, text messaging, and similar distractions. Some states have taken action. The state of Texas, for instance, has already passed legislation prohibiting teenagers from using cell phones and similar devices while driving and restricts adults from making cell phone calls or sending text messages while driving in school zones. However, as a result of Governor Perry’s veto this year, Texas law stops short of providing a complete prohibition on all drivers from texting-and-driving.

Whether a complete prohibition on in-car cell phone use is appropriate may be subject of continuing debate, but whether cell phone use imposes risk on drivers and contributes to the number of accidents on U.S. highways is beyond dispute.
