Fort Worth police arrested a convenience store clerk today in connection with last Friday’s underage drinking and driving accident. Initial reports suggest that the clerk sold malt liquor to the 17-year-old driver in violation of Texas law.

Lofton v. McNeil - Texas Citizens losing Legal Rights - Miscarriage of Justice by The Fifth Circuit Court of Appeals, The Texas Legislature and Judge Sam Lindsay

In Lofton v. McNeil, Fifth Circuit Court of Appeals Judge Edith Jones crafted what appears to be a terribly written judicial opinion that has essentially eliminated a Texas Citizens' right to successfully bring a failure to warn claim against a Pharmaceutical Manufacturer that produces a drug that kills or harms someone.  Lofton was an individual who died after ingesting a dangerous drug.  Judge Sam Lindsay originally dismissed Lofton's case at the trial level which was in my opinion a miscarriage of justice that sadly undermines every Texans' ability to receive fair access to justice.  

Texans interested in actually having their rights protected should contact their state and federal legislators and ask that they pass rights that protect citizens, not Big Corporations.  Citizens should also vote for and support judicial candidates who actually care about individual rights.  I encourage every Texas citizen to vote for candidates dedicated to peoples' rights--not Big Business--the clear victors that were insulated from liability by tort reform and an extremely draconian interpretation of current law in this Case.   Another sad day for Texas Citizens brought on by what is largely viewed as a preposterous, impractical and poorly reasoned decision from the trial and appellate court. 

BTW--for inquiring minds with Common Sense, guess how often the FDA withdraws a drug from the market for Fraud?  -- ALMOST NEVER.  

I anxiously await the next scholarly train wreck of an opinion. Maybe a better idea is to simply have Corporations be the sole arbiters of the propriety of all failure to warn claims. Yes, that is a great idea!

Is Prozac Linked to Autism?
