Felipe Saiz and Juan Manuel Estrada-Duarte, two oilfields workers from Big Springs, were both fatally injured in two different oilfield accidents last week. On Wednesday at around 10:15am, a drilling rig partially collapsed, killing 40-year-old Felipe Saiz in the process. The rig was owned by Heartland Drilling of Abilene and although it is unknown what caused the accident, it can be assumed that negligence on the part of Heartland can be blamed. Felipe Saiz and Juan Manuel Estrada-Duarte, two oilfields workers from Big Springs, were both fatally injured in two different oilfield accidents last week. The rig was owned by Heartland Drilling of Abilene and although it is unknown what caused the accident, it can be assumed that negligence on the part of Heartland can be blamed. A day later, Juan Manuel Estrada-Duarte, 59, died after a heater treater rolled over him and pinned him against another treater. Employees at the time were preparing oil for a large transport with the heater treater when the accident occurred. Estrada-Duarte was extracted from the treater, as the company did have the proper extraction equipment on site, but their efforts were too late and the valued employee died from his fatal injuries.

Given that these two accidents occurred within a day of one another, an investigation by OSHA, the Occupational Safety and Health Administration, is expected.

 

Accident Investigation

A number of parties involved can be at fault for both accidents - the respective owners of the oil drilling companies, careless employees, and any company who may have performed faulty maintenance on the oil rig or heater treater that caused these two fatal accidents. An investigation by OSHA is underway and will reveal the full, unbiased details of the accidents.

However, it is important for the families of those fatally injured to seek legal counsel to retain accident reconstruction experts on their behalf. The oilfield companies' insurance will most likely seek to hire their own experts that will be partial to their company in an attempt to interfere with or negate any claims made on behalf of the families of Saiz and Estrada-Duarte.

Legal counsel can also investigate whether or not other employees were at fault. Employees should be properly trained, follow safety regulations, and pay adequate attention while at work. However, it is still the companies' responsibility to provide adequate training and proper supervision in order to prevent fatal accidents from occurring. Therefore, oilfield companies cannot simply place the blame on a careless employee as it is their responsibility to properly train and watch employees in the first place.

The details of both accidents are still unclear, but it is important that family members retain counsel to represent them before the companies' insurance attempt to mitigate and lessen these two unfortunate accidents.
