Johnnie Lee Lott, 77, of Childress, TX Dies; Wife June Hall Lott Critically Injured in Wreck on U.S. Hwy 287 Near Clarendon, TX

 On Monday, August 12, 2013 at approximately 4:00 P.M., 77 year-old Johnnie Lee Lott of Childress, TX was killed on U.S. Highway 287 when his 2012 Cadillac SRX was rear-ended by the driver of a 2005 Ford F-250, driven by Pampa, TX resident Teddy Joe Atwood, Jr. According to DPS, Lott was stopped in an eastbound lane of U.S. Highway 287 approximately two miles east of Clarendon, because of road visibility problems due to heavy rain when Atwood’s pickup truck struck Lott’s SUV from behind. Johnnie Lott was pronounced dead at the scene, while his wife June, also 77, was transported to Northwest Texas Hospital with internal injuries and is listed in critical condition. Although it has not been stated exactly how fast Atwood was driving when he hit the Lott’s vehicle, the posted speed limit for that portion of U.S. 287 is 75 mph. Both of the Lotts were wearing their seatbelts at the time of the accident. Below is a map depicting the area in which the accident occurred:

According to the National Safety Council, over 2.5 million rear-end collisions are reported each year; making them the most common kind of car accident.

Legal Commentary

Although inclement weather played a significant role in the cause of this accident, the victim’s family could still very well possibly pursue a claim against the driver who caused this wreck. Considering the death and injuries that the Lotts sustained, despite that both were wearing their seat belts at the time of the accident, suggests that the driver who caused the wreck was driving negligently, and possibly speeding when the collision occurred. Furthermore, if the weather was severe enough that it was prompting motorists to slow down and/or stop on the highway, there is no reason why the driver at fault should have been traveling at speeds high enough to cause such extensive damage to another vehicle on the highway. This wreck indicates that Atwood was driving irresponsibly by failing to exercise proper caution during inclement weather, and as a result, one man has lost his life, while his wife is fighting for hers in a hospital.  It would be in the best interest of the victims’ families to consult with an attorney to ensure that they recover as best as possible after such a tragic accident, and allow someone else to handle the insurance companies and extensive paperwork so that they can spend more time with family and coping after such a difficult loss.
