The Dallas Area Rapid Transit (DART) authority didn’t mean to put its passengers in harm’s way, but that’s exactly what happened earlier this week when an 18-wheeler rammed into the back of stopped DART bus. Thursday afternoon, most of Tania Enamorado’s classmates had gone home for the day. Enamorado, however, was cruising around Dallas with her friend and her teenage cousin. Early morning commuters travelling to Dallas from Rockwall, and Greenville were delayed this morning because of a motorcycle accident that seriously injured two people. A Houston motorcycle owner woke up this morning to a legal and financial reality that he never considered when it was just a highly unlikely probability. As he relaxed at home the night before, his life was changing on Houston’s North Freeway. So were the lives of three others.

What was the motorcycle owner’s fateful decision? It was a simple enough act: he let his friend borrow his motorcycle. Unfortunately for everyone involved, however, the friend had very little motorcycle experience.

Early yesterday morning an Arlington driver had car trouble. The driver, Kolawole Grando, made the mistake of coming to a stop in an eastbound lane of I-20. Tragically, it was one of the last mistakes Mr. Grando would make.

The driver of a Mazda minivan lost control of her car today and was involved in an accident with an unlikely defendant: McDonald’s. According to the National Transportation Safety Board (NTSB), more than 3,000 Americans died last year in motor vehicle crashes attributed to the use of cell phones, text messaging, and similar distractions. In other words, more people died last year on American highways as a result of commonly carried distractions than the number of people who died in the September 11^th attacks on the World Trade Center and Pentagon.

Some states have taken action. What happens when an F-350 makes a left-hand turn in front of an oncoming motorcycle? The results are painful and tragic, as Jimmy Gamble can attest after he watched helplessly as careless pickup driver “gunned” her engine and made a turn into his friend’s lane. The driver hoped that she could slip across the highway before Carl Barnett, the man driving the oncoming motorcycle, crossed her path.

In the early hours of Monday morning, a Fort Worth trucker, Billy Moore, was involved in a fiery crash on a Pennsylvania backroad that allegedly occurred when the driver of a Chevrolet Monte Carlo crossed into the oncoming lane, slamming head-on into his big rig. The forceful accident caused the Monte Carlo to catch on fire. Although the driver was trapped inside the burning car, the coroner subsequently concluded that driver died on impact and that blunt force trauma, not smoke inhalation or burns, caused his death.

Initial reports indicate that the driver of the Monte Carlo was at fault for the accident and that the Fort Worth trucker, who sustained no injury, was free of any liability. Of course, with many trucker drivers undertrained and under the duress of long hours, this is often not the case.

Accidents involving drivers from different states – such as here, a Texas trucker and a Pennsylvania driver – raise two important legal questions. These questions relate to a court’s jurisdiction and the procedural and substantive rules that the court should apply.

First, procedurally, what laws will govern how the case is litigated? Because the litigants are from different states, federal court – not state court – will be the appropriate place to file a cause of action. Likewise, federal procedural law will govern things like when litigants must file actions and what kind of notice they must give. Additionally, in a situation such as two drivers who were involved in an accident in Pennsylvania, a Pennsylvania federal court (rather than a Texas federal court) is the right place to file.

Second, substantively, what state’s law – Pennsylvania or Texas – will govern the dispute? This vexing area of the law, known as choice of law, determines which set of substantive laws will apply to a conflict. The general rule, however, is that the state in which the injury occurs (Pennsylvania) will govern, rather than the substantive law of a particular disputant (Texas).

So, what’s your take away? If you’re in an accident in another state (i.e. a foreign jurisdiction), such as the truck driver in the situation discussed above, you may have complex jurisdictional issues to consider. Multiple people were rushed to a Rio Grande Valley-area hospital after an 18-wheeler driver lost control of his big rig and slammed into a Cadillac travelling on eastbound Expressway 83 near Weslaco, Texas. Kimberly Huckabee is one of the latest victims of a commercial trucking industry that puts profits ahead of the safety of other drivers and the firefighters, police, and EMTs who respond to accidents.

In the early hours of Thanksgiving Day, Huckabee, a volunteer firefighter in Pinewood, Texas, responded to the scene of a violent 18-wheeler accident. Alcohol played a central role in the injury of two police officers late last week when an 18-wheeler slammed into their vehicles. Despite the fact that it was clear that the officers were addressing a traffic problem, the big rig driver failed to use caution as he approached. This morning Dallas drivers were forced to creep around the wreckage of a damaged car hauler and its destroyed cargo on their way to work. The wreck occurred when the car hauler, transporting a van, attempted to pass underneath an overpass on I-30. An Arlington woman spent last night in a Mansfield jail pending charges of intoxication manslaughter and child endangerment. In addition to these criminal charges, she almost certainly faces an impossible-to-escape negligence claim in civil court.

Not only did the Arlington driver drive under the influence of alcohol and the wrong way down Interstate 35, a police office also witnessed the woman driving with her hands behind her head. Nicole Lalime should have celebrated her sweet-16 birthday this year. Tragically, her family is instead preparing to mourn the third anniversary of her untimely, unnecessary, and heartbreaking death early next month. If there’s been any relief since that horrible day when a drunk driver took her life, it came this week when the Lalime family was awarded a judgment of $6.5 million against John Winne, the man who killed her.

Neil and Leslie Craddock left their home in Thirroul, Australia, with the dream of coming to Texas and riding the endless backroads of the American southwest on the back of a Harley-Davidson. Instead, the Craddocks have spent nearly all of their vacation to Texas at Parkland Hospital, recovering from a motorcycle accident that caused severe injury and has required several surgeries.

An accident on Interstate 10 in west Houston caused severe delays—and severe damage—as a result of careless truck driving. The accident occurred in the mid-morning on Monday, held up traffic on the Katy Freeway for most of the day, and required Texas Department of Transportation crews to conduct extensive repair work. Nearly 500,000 motorcycle riders converged on Galveston this weekend in what was intended to be a celebration of motorcycling in America. The event had tragic consequences for three riders, however. In each of these wrecks, none of the reckless riders wore a helmet—and all of them paid the highest price for their love of this dangerous and potentially lethal pastime.

According to Gastonia, North Carolina local news reports, Eric Fitzgerald Lee tragically passed away after a fiery crash involving two 18 wheelers on October 13, 2011 near mile marker 16 on Interstate 85 at approximately 1:47 a.m.  Early reports indicate that Mr. Lee's rig crashed into another Big Rig driven by Tomas Herrera of San Benito, Texas.  Investigations indicate that the impact pierced one of the fuel tanks on Mr. Lee's 18 wheeler causing a fiery explosion.  Our law firm's sincere condolences go out to the Lee family.

It is important that an independent investigation and crash reconstruction is performed in this case as soon as possible. Local news reports reflect that Mr. Lee crashed into Mr. Herrera's Big Rig.
