Passenger, Danielle Ruthstrom, and two other Arlington Youths tragically pass away in Car Crash

Arlington local newspapers reported the tragic deaths of Danielle Ruthstrom, and two other Arlington youths, the Eckel twins in a fiery Arlington Auto Accident.  As a wrongful death lawyer who practices in Arlington and the DFW metroplex, I often am saddened by the impact of the loss of these young lives on the family. Investigation is ongoing, but it is believed that alcohol may have been a factor.  Too often, youths make decisions about drinking without having an appreciation of the magnitude of the risks to themselves and others.  My condolences go out to the families of the youths.  This crash hits close to home, as my younger brother was friends with the twins and is distraught by the loss.

From a legal perspective, the case depends on the underlying facts of the accidents. Our law firm always hires an independent crash reconstructionist to determine what happened and to corroborate what the police findings are. Sometimes we find things that are overlooked or may not be apparent upon an initial investigation.  Questions that need to be answered include where, if any place, were the youths drinking prior to the crash.  Who was driving?  The blood alcohol level of the driver.  From an insurance coverage perspective, the affected families may be able to recover from the auto policy of the owner's vehicle, and any coverage coming from the household in which the youths lived in.  Of course, the insurance companies involved will try to offer a little money and say they will "take care" of it.  Certainly, families who never consult qualified injury lawyers never truly know whether the insurance is telling the truth, as they are not under oath and will stop at nothing to avoid paying out what families are legally entitled to recover. This is why it is important to retain a lawyer.  I have handled multiple death cases where the families had no idea regarding their legal rights.  My heart goes out to the families and I hope they obtain a lawyer to help them through this difficult time.

Texas man files lawsuit over burns suffered in explosion

A Texas man has filed a lawsuit against two Nome residents alleging he was burned in an explosion while on their property.

The plaintiff, James Anderson, says he was at the home of Virgil and Rodney Martel performing yard work on June 23rd. At that time, claims Anderson, he heard some noises coming from a building on the property.

Anderson decided to investigate the sound, and he entered the building where he found 15-year-old Kevin Martel welding a handle onto a container. While Anderson was standing there, the container exploded, causing what the suit describes as “catastrophic injuries” to Anderson.

According to Anderson’s lawsuit, the container had previously contained some type of fuel or diesel and had not been properly cleaned in preparation for the welding.

In his lawsuit, Anderson is seeking an unspecified amount of damages for lost wages, medical expenses, physical injuries and pain, mental anguish, scarring, physical impairment, disfigurement and loss of household services. Additionally, Anderson is seeking pre- and post-judgment interest.
