Passenger, Danielle Ruthstrom, and two other Arlington Youths tragically pass away in Car Crash

Arlington local newspapers reported the tragic deaths of Danielle Ruthstrom, and two other Arlington youths, the Eckel twins in a fiery Arlington Auto Accident.  As a wrongful death lawyer who practices in Arlington and the DFW metroplex, I often am saddened by the impact of the loss of these young lives on the family. Investigation is ongoing, but it is believed that alcohol may have been a factor.  Too often, youths make decisions about drinking without having an appreciation of the magnitude of the risks to themselves and others.  My condolences go out to the families of the youths.  This crash hits close to home, as my younger brother was friends with the twins and is distraught by the loss.

Legal Commentary - Author - Wrongful Death Lawyer - Majed Nachawati

From a legal perspective, the case depends on the underlying facts of the accidents. Our law firm always hires an independent crash reconstructionist to determine what happened and to corroborate what the police findings are. Sometimes we find things that are overlooked or may not be apparent upon an initial investigation.  Questions that need to be answered include where, if any place, were the youths drinking prior to the crash.  Who was driving?  The blood alcohol level of the driver.  From an insurance coverage perspective, the affected families may be able to recover from the auto policy of the owner's vehicle, and any coverage coming from the household in which the youths lived in.  Of course, the insurance companies involved will try to offer a little money and say they will "take care" of it.  Certainly, families who never consult qualified injury lawyers never truly know whether the insurance is telling the truth, as they are not under oath and will stop at nothing to avoid paying out what families are legally entitled to recover. This is why it is important to retain a lawyer.  I have handled multiple death cases where the families had no idea regarding their legal rights.  My heart goes out to the families and I hope they obtain a lawyer to help them through this difficult time.

Passenger, Brandon Hambrick, tragically passes away in Arlington Auto Accident

According to local news reports, a young man was killed early Friday in an Arlington auto accident.  Brandon Hambrick was pronounced dead at the scene at approximately 5:30 a.m.  The tragic crash occurred near the 4200 block of North Collins Street in Arlington, Texas.  Speed is believed to have been a factor in the crash.

The driver survived and was transported to John Peter Smith Hospital in Fort Worth.  The investigation is continuing and further details are not yet available.

Legal Commentary:

An independent accident reconstruction should be performed as soon as possible to corroborate the police investigation.  For the better part of the last decade handling accidents involving fatalities, I routinely hire experts to conduct an independent investigation so the family of the victim feels comfort in knowing as much as possible about what happened.  In this case, witness statements from the driver, as well as the other individuals in the other vehicle are vital to this investigation before it becomes a cold case. Because two vehicles were involved, multiple insurance companies may be required to tender the full insurance policy arising from the fatality. This could include the driver of the other vehicle, the driver of the vehicle that landed in the pond, and possibly any policy that the young man had or any policy that anyone in his household may have had.  The most important thing to remember is that insurance companies are not to be trusted and will misrepresent coverage and try to avoid paying under the policy whether it is the at fault person's insurance carrier or the carrier of the people or family of the loved one who lost their life.  One common tactic the insurance carriers use is to offer a payout, which is usually much less than what the family of the loved one is entitled to receive.  Of course, the family never finds out what their true rights are unless they obtain an independent opinion from an injury lawyer handlling fatality cases prior to talking to the insurance companies.  Our condolences go out to the family of the young man.

Driver traveling at 100 mph killed after rear-ending 18-wheeler

A driver traveling at a high rate of speed was killed after rear-ending an 18-wheeler. The accident took place in Arlington, Texas, early Sunday morning.

The deceased victim, 41-year-old Bradley Larson, was driving a Honda Accord eastbound on Interstate 30 at speeds up to 100 mph. He then rear-ended an 18-wheeler and struck an Interstate median.

Larson died on the scene, but the 18-wheeler driver was unhurt.

Because alcohol was found in the Honda, police believe intoxication may have been a contributing factor.

Police are currently seeking information on a second vehicle that was possibly involved in the accident. Witnesses describe seeing a “small blue car” traveling at high speeds near the Honda shortly before the accident occurred.

Anyone with information about the second car is asked to call Arlington police at 817-459-5635.
