Austin Drivers Worry As Higher Speed Limits Hit I-35

The Texas Department of Transportation announced this week which roads will receive a speed limit increase to 75 miles per hour. At the top of the list is Interstate 35 north of Austin. I-35 is already one of Texas’s most accident-prone roads. Now, the heavily travelled highway will become even more dangerous, as some experts argue that higher speed limits lead to more reckless driving and, as a result, more accidents.

The increased speed limit has Austin-area drivers worried. The Austin area section of I-35 has long been considered one of the most dangerous in Texas. Between January 1991 and December 2000, for instance, 277 people died in automobile accidents on stretches of I-35 in Travis, Hays, and Williamson counties. By comparison, there were just 199 driver fatalities on even busier stretches of I-35 in Dallas County during that time.

18-Wheelers Collide in Wheeler County

On Highway 152, a poorly maintained back road in Wheeler County, a sparsely populated area in the Texas panhandle, two 18-wheelers slammed into each other earlier this week. The results were tragic – and fatal. As the result of reckless driving, one driver was ejected from his cab, killing him. The other driver’s truck was thrown on its side and, sliding across the road, caught fire. Only by good luck was the man able to escape. His injures were non-life threatening, but he was sent to a local hospital.

Thousands of miles of Texas highways are poorly lit and falling into disrepair. The result is that wrecks are more common, including fatal accidents like the one in Wheeler County. Do you regularly travel on these highways? You should be careful!

Gregg County Inmate Dies Unexpectedly

Michael Aaron Garner, a thirty-year old prison inmate in Gregg County jail, died unexpectedly last week. County Sherriff Maxey Cerliano reported that Mr. Garner’s body showed no signs of trauma and that toxicology reports remain outstanding. Although previous reports suggest that Mr. Garner had a history of heroine and methadone use, Mr. Garner’s mother, Cheyenne Smith, stated that her son had no health issues and had communicated serious concern about prison conditions.

Garner’s untimely death raises important questions about the safety of not only the Gregg County jail, but county and state prisons across Texas. If you or a loved one are imprisoned – for an hour, a day, or longer – you are placed under the care of the local or state government. You still have rights! The attorneys at Fears | Nachawati understand the extent to which civil liability stretches to the premises of government-run facilities. If you notice things that don’t add up, talk to us. Lubbock County Man Dies After Vehicle Rollover

A 21-year-old man, Colby Galland, died last weekend in Wolfforth, Texas, on FM 179 after his 2004 Ford pickup truck rolled. Preliminary investigation by the Texas Department of Public Safety confirms that Mr. Galland was not wearing a seat belt. Investigators have yet to conclude whether alcohol or excessive speed might have contributed to the deadly roll.

Trucks like Mr. Gallands are twice as likely to roll than passenger cars. Moreover, nearly half of all highway fatalities are the result of rollovers. For truck drivers, the risks are real and the consequences can be deadly. If you or a loved one have been involved in a rollover, contact the personal injury experts at Fears | Nachawati. Are Private Ambulances Taking Unnecessary Risks?

San Antonio area EMS director Jeff Fincke has asked city officials in Kendall County to impose tougher regulations on private ambulances speeding to nonemergency calls. Specifically, Fincke wants Kendall County cities to pass city ordinances, modeled after the one passed by San Antonio, that require ambulances to receive permission to run “hot” – that is, use lights and sirens – in response to requests for help.

Have you or a loved one been in an accident with an ambulance? If so, it may be time to ask the question: was the ambulance speeding out of necessity or because it was trying to beat another ambulance to the scene of concern. Find out the answer to these questions by enlisting the help at the experts at Fears | Nachawati. Call 1.866.705.7584 or send an email to info@fnlawfirm.com. We can help you!

Oil Field Worker Dies in Accident, Raising Questions about Workplace Safety

Last week, a pair of oil field workers in Midland County, Texas were working on a rig when pipe fell, pinning Mariano Pruenda’s leg. As his co-worker, Ronnie Lynn May, worked to rescue him, another piece of the rig fell, crushing and killing May.

The Occupational Safety and Health Administration (OSHA) has launched an investigation into the accident and into the safety practices of May’s employer, Tulsa-based oil contractor, Helmrich and Payne.

Working in the oil fields is dangerous. However, oil rigs become inappropriately and unnecessarily dangerous when employers fail to adhere to worker safety regulations. Road Debris a Major Cause of Concern for Texas Motorists

A Fort Bend county sheriff’s deputy, John Norsworthy, died recently when a piece of road debris obstructed his car’s path and forced him to take evasive action. Responding to an emergency call, Mr. Norsworthy approached a four-foot square board of thick material used for buffering sound. Mr. Norsworthy veered to avoid the debris, lost control of his car, crashed into a ditch, hit a tree and flipped. Unfortunately, Mr. Norsworthy passed away as a result of his injuries.

Texas Department of Public Safety reports show that objects such as those that led to the death of Mr. Norsworthy are a significant threat to drivers’ safety. In the last five years, road debris has caused 2,728 accidents, including 756 injuries and 19 fatalities. 18-wheeler crash kills Frisco mom and two kids, injures more

A Frisco woman and her two young children were killed, while her husband and the children's father was critically injured, in a wreck on I-20 in Kaufman County this weekend.  The family was traveling in heavy traffic in an SUV when an 18-wheeler struck them from behind.  The force of the impact was enough to push their SUV into another car, which in turn was pushed into another 18-wheeler and into the highway median.  The SUV then caught fire.  The driver of the first truck was injured, as were the driver and passengers in the second car.
