Three people were injured in a multi-vehicle accident in the intersection of Greenville Avenue and Mockingbird Lane.  Authorities say that an SUV ran a red light on Mockingbird and collided with a sedan that was traveling southbound on Greenville.  The sedan's driver and two passengers were injured in the wreck.  The victims were taken to an area hospital for treatment.  Authorities are continuing to investigate whether prescription drugs may have played in a role in this accident.

Woman killed by hit and run driver on North Central Expressway

A woman has died from injuries she sustained when she was hit by a hit and run driver on North Central Expressway.  The woman was hit by a pickup truck when she was trying to cross the highway near its intersection with Plano Road.  The pickup driver did not stop.  He was caught a few miles further up the highway, and has been charged with failure to stop and render aid.  The woman was taken to an area hospital for treatment where she later died from her injuries.

Two killed in tractor-trailer wreck

Two people were killed in a wreck in rural Johnson County involving a tractor-trailer rig.  Authorities report that a pickup truck struck the back of a Peterbilt tractor-trailer at the intersection of county roads 904 and 1017.  The pickup truck wound up under the big rig and the top of the truck was sheared off.  The pickup truck driver and passenger were pronounced dead at the scene.

Mother and infant killed in Dallas wreck

A mother and her two year old daughter were killed in a wreck in the Red Bird area on Saturday.  The accident occurred in the 2700 block of W. Ledbetter.  The mother was driving a Chevrolet westbound when the car was struck by a Mercedes traveling at a high rate of speed.  The mother and her child died at the scene.  The driver of the Mercedes is accused of having been drinking, and has been charged with two counts of intoxication manslaughter and with public intoxication.

14 year old killed in SUV rollover accident

A 14 year old girl from Arlington was killed in an SUV rollover accident.  Authorities say that the girl's boyfriend, also 14, had been drinking and was driving the family SUV when he crashed through a guard rail and rolled down an embankment.  The boy took the SUV without his parents' permission.  The girl died after she was ejected from the vehicle.  The driver and another teen were injured in the wreck.

Tractor-trailer wreck on183

One person was injured in a rush-hour tractor-trailer wreck today on 183 the Airport Freeway at 360.  Authorities say that a sedan pulled in front of the commercial truck in heavy traffic and abruptly slowed down.  The truck then hit the sedan despite slamming on its breaks.  The injured person, a passenger in the sedan, was believed to not have been wearing a seat belt, and was taken to an area hospital for treatment.  Neither the driver of the sedan nor the big rig driver were injured.

Stranded driver critically injured by taxi

A stranded driver was critically injured this weekend when a taxicab carrying seven passengers broadsided the driver's SUV.  The wreck occurred in downtown Dallas.  The accident pushed the SUV into the man, who was filling the vehicle with gas.  The taxi driver and the stranded driver were both injured in the accident, and were taken to area hospitals for treatment.  Some of the taxi's passengers suffered minor injuries.

One injured in wreck at 183 and Loop 12

One person was injured in an accident today that occurred on Highway 183 near the intersection of Loop 12.  Authorities say that the accident was a moderate speed fender bender that occurred because the rear car was following the front car too closely.  One person riding in the rear car was injured, and was taken to an area hospital for treatment.  Traffic was backed up to Empire Central.

Two injured in wreck on I-30 in downtown Dallas

Two people were injured early Wednesday morning in a wreck on eastbound I-30 near downtown Dallas.  Investigators report that the two cars were traveling in the far left lane of the highway when the front car suddenly stopped.  The rear car slammed into the front car, injuring the driver and passenger in the front car.  Noone in the rear car as injured.  Investigators believe that rainy conditions may have played a part in this accident.

Dallas area family in Hillsboro crash, one killed, 12 injured

A six month old child was killed and 12 other family members were injured in a crash in the Hill Country region of Texas.  The family hails from the Dallas area and was traveling to Mexico on vacation.  Authorities report that a tire blew out on the van the family was riding in, causing the van to roll over several times in I-35E about six miles north of Hillsboro.  The infant, who was not riding in a child safety seat, was killed instantly.  The victims were taken to several area hospitals for treatment.

What is subrogation?

Subrogation is a legal term that refers to an insurance company’s ability to seek reimbursement from a third party for the money it paid out on a claim. Specifically, it is the ability of an insurance company to seek reimbursement from the party responsible for the accident that resulted in the claim.

Sometimes a person has to make an insurance claim through their own insurance company even when they weren’t at fault for the accident. The insurance company will pay out on their insured’s claim, but ideally it is the person who is actually at fault for the accident that should be paying for the damages. That’s where the concept of subrogation comes in.

It is the insurance company’s legal right to recover the money they’ve paid out by pursuing a claim against the at-fault party, which typically means pursuing the claim through the at-fault party’s insurance company.

Here’s an example of how subrogation works. John Smith is out driving his car when he is rear-ended by another car (driven by Allan) through no fault of his own. Allan’s insurance company is taking a very long time to process John’s claim.

In the mean time, John needs his car repaired so he can get to work every day. He decides to use his own insurance company to get the money he needs to fix his car. Because John was not responsible for the accident, John’s insurance company can seek reimbursement for the payment from Allan’s insurance company.

Subrogation can come into play in personal injury lawsuits as well. Subrogation allows the insurance company to “step into the shoes” of the person with the legal claim (the plaintiff) to seek reimbursement for money it has paid out to cover the plaintiff’s losses.

For example, suppose that Allan did not have car insurance, so John had to take him to court in order to get financial compensation for the accident. John files a personal injury lawsuit against Allan, and John wins the case. John’s insurance company, which had paid to fix John’s car, has a right to part of the money John was awarded.
