A new study shows that Dallas-Fort Worth area drivers endure the longest and most dangerous commutes in the nation.  The study showed that Dallas drivers spend an average of 28 minutes each way in traffic, and lose a total of 53 hours per year each due to congestion and wrecks on the roadways.  With all of that time on the road, Dallas-Fort Worth drivers are especially vulnerable to accidents caused by 18-wheelers and other large commercial vehicles, misuse of prescription drugs, and distracted driving, among other causes.

Man critically injured in wreck with DFW Airport shuttle bus

A man was critically injured in a wreck with a DFW Airport shuttle bus Wednesday morning.  The accident occurred on a flyover bridge at Terminal E.  The bus and the car driven by the victim apparently collided.  The bus was carrying airport employees, none of which was hurt.  The car driver was taken by ambulance to Parkland Memorial Hospital for treatment.

Infant killed in hit and run crash on I-20

An infant was killed in a hit and run crash on I-20.  The accident occurred near the Texas 161 exit.  Authorities report that a GMC pickup traveling westbound crashed into the Chevy Blazer in which the infant was riding.  Three passengers from the Blazer were ejected in the crash.  The infant was not ejected, and was taken to Children's Hospital in Dallas by helicopter, where he later died from his injuries.  The three individuals who were ejected were taken to area hospitals for treatment.

Mother and infant killed in Dallas wreck

A mother and her two year old daughter were killed in a wreck in the Red Bird area on Saturday.  The accident occurred in the 2700 block of W. Ledbetter.  The mother was driving a Chevrolet westbound when the car was struck by a Mercedes traveling at a high rate of speed.  The mother and her child died at the scene.  The driver of the Mercedes is accused of having been drinking, and has been charged with two counts of intoxication manslaughter and with public intoxication.

Four children injured in wreck

Four children were injured in a wreck in Dallas on Saturday.  Authorities say that a woman was driving on Cesar Chavez Boulevard near Grand Avenue when she clipped a guard rail and struck a concrete pillar.  Five children were in the back of the car.  One child escaped injury, but the other four were taken to Children's Hospital in Dallas for treatment. Two of the injured children were in critical condition and two were in serious condition.  Authorities continue to investigate the cause of the accident, and the driver may be charged.

Tractor-trailer wreck on183

One person was injured in a rush-hour tractor-trailer wreck today on 183 the Airport Freeway at 360.  Authorities say that a sedan pulled in front of the commercial truck in heavy traffic and abruptly slowed down.  The truck then hit the sedan despite slamming on its breaks.  The injured person, a passenger in the sedan, was believed to not have been wearing a seat belt, and was taken to an area hospital for treatment.  Neither the driver of the sedan nor the big rig driver were injured.

One killed and three hurt in Kaufman County crash

One man was killed and three others were injured in a crash on I-20 in Kaufman County.  The deceased, Ruben Garcia of Tyler, died at the scene after the car he was riding in entered the median, swerved back into the mainlanes and then flipped and skidded on its roof.  The three injured individuals were also in the vehicle.  Two were taken by helicopter, and one by ambulance, to Parkland Memorial Hospital and Baylor University Medical Center in Dallas.

Skillman Street wreck injures three

Three people were injured in a wreck on Skillman Street in east Dallas today.  Authorities report that a Ford sedan was speeding in the rain when the driver apparently lost control of the vehicle.  The sedan hit a light pole in the median, causing substantial damage to the car and sending its driver and two passengers to the hospital for treatment.  No other cars were involved in this accident.

One killed in wreck with police car

A man was killed when his disabled Jeep Cherokee was struck from behind by a police car early Thursday morning in Dallas.  Authorities say that the victim, 59 year old Terry Glover, was driving his Jeep when it broke down in the center lane of Polk near Camp Wisdom Road.  The police car was traveling on Polk and the officers apparently did not see the disabled Jeep.  They struck the car from the rear, pushing it through a metal fence and into the front yard of a home.  Glover was taken to an area hospital for treatment, but died later that day.

What is subrogation?

Subrogation is a legal term that refers to an insurance company’s ability to seek reimbursement from a third party for the money it paid out on a claim. Specifically, it is the ability of an insurance company to seek reimbursement from the party responsible for the accident that resulted in the claim.

Sometimes a person has to make an insurance claim through their own insurance company even when they weren’t at fault for the accident. The insurance company will pay out on their insured’s claim, but ideally it is the person who is actually at fault for the accident that should be paying for the damages. That’s where the concept of subrogation comes in.

It is the insurance company’s legal right to recover the money they’ve paid out by pursuing a claim against the at-fault party, which typically means pursuing the claim through the at-fault party’s insurance company.

Here’s an example of how subrogation works. John Smith is out driving his car when he is rear-ended by another car (driven by Allan) through no fault of his own. Allan’s insurance company is taking a very long time to process John’s claim.

In the mean time, John needs his car repaired so he can get to work every day. He decides to use his own insurance company to get the money he needs to fix his car. Because John was not responsible for the accident, John’s insurance company can seek reimbursement for the payment from Allan’s insurance company.

Subrogation can come into play in personal injury lawsuits as well. Subrogation allows the insurance company to “step into the shoes” of the person with the legal claim (the plaintiff) to seek reimbursement for money it has paid out to cover the plaintiff’s losses.

For example, suppose that Allan did not have car insurance, so John had to take him to court in order to get financial compensation for the accident. John files a personal injury lawsuit against Allan, and John wins the case. John’s insurance company, which had paid to fix John’s car, has a right to part of the money John was awarded.

Five-car accident on Dallas North Tollway shuts down roadway for hours

A five-car accident shut down both sides of the Dallas North Tollway for nearly three hours on Wednesday morning. Thousands of motorists in rush hour traffic spent hours stuck on the tollway.

The chain of events leading to the five accidents began when a Mustang traveling in a northbound lane struck the front end of a truck. The truck then skidded across four lanes of traffic before landing in a median. The truck’s collision with the median forced a concrete block into the southbound lanes of the tollway.

A second truck, which was traveling in the southbound lanes, struck the concrete block.

The first truck was hauling a generator on a trailer. A car, the fourth vehicle involved in the accident, was traveling in the northbound lanes and hit the trailer which was sitting in the path of traffic.  The fifth car to be involved in the accident was a Volkswagen Jetta that also struck the piece of concrete.

Amazingly, no one was seriously injured.

State trooper attempts to stop wrong-way driver before car accident near Dallas

Troopers were warned of a wrong-way driver on the Dallas North Tollway before an accident occurred which injured four, says the Texas Department of Public Safety. Ryan Matthew, 27, was speeding and driving south in the northbound lanes all the way from Frisco to Dallas, say authorities.

The accident took place on Sunday, June 21st near the Frankford Road exit. Matthew was driving the wrong way on the tollway for nearly seven minutes and ten miles.

Several callers alerted the authorities to Matthew’s out-of-control driving. DPS, however, says they were unable to stop Matthew, even after positioning a police vehicle in front of him. Matthew, says Lonny Haschel with DPS, simply swerved around the trooper’s vehicle and continued driving.

Eventually Matthew crashed into a vehicle, injuring the two 23-year-old women inside. Both women were taken to Parkland Memorial Hospital for treatment.  Matthew has not yet been charged with any crime.
