Three injured in wreck near Love Field

Three people were injured in a wreck on Mockingbird Lane in Dallas, near the Dallas Love Field airport.  Authorities say that the injured individuals were in a car that was sideswiped by another car at a moderate rate of speed.  The first car was pushed into the median and struck a traffic light pole.  The driver and two passengers of the first car were taken to area hospitals for treatment.

Infant killed in hit and run crash on I-20

An infant was killed in a hit and run crash on I-20.  The accident occurred near the Texas 161 exit.  Authorities report that a GMC pickup traveling westbound crashed into the Chevy Blazer in which the infant was riding.  Three passengers from the Blazer were ejected in the crash.  The infant was not ejected, and was taken to Children's Hospital in Dallas by helicopter, where he later died from his injuries.  The three individuals who were ejected were taken to area hospitals for treatment.

Two killed in tractor-trailer wreck

Two people were killed in a wreck in rural Johnson County involving a tractor-trailer rig.  Authorities report that a pickup truck struck the back of a Peterbilt tractor-trailer at the intersection of county roads 904 and 1017.  The pickup truck wound up under the big rig and the top of the truck was sheared off.  The pickup truck driver and passenger were pronounced dead at the scene.

Four children injured in wreck

Four children were injured in a wreck in Dallas on Saturday.  Authorities say that a woman was driving on Cesar Chavez Boulevard near Grand Avenue when she clipped a guard rail and struck a concrete pillar.  Five children were in the back of the car.  One child escaped injury, but the other four were taken to Children's Hospital in Dallas for treatment. Two of the injured children were in critical condition and two were in serious condition.  Authorities continue to investigate the cause of the accident, and the driver may be charged.

Three children hurt in SUV wreck

Three children were injured in a single-car crash involving an SUV in Dallas.  Authorities say that the SUV hit a light pole Thursday night.  The force of the accident caused one child, a five year old girl, to be ejected from the vehicle.  Three other children were also in the vehicle, and two of them were injured.  The driver, who is believed to be the father of at least one of the children, fled the scene and is now sought by authorities.  Two of the injured children were taken to an area hospital for treatment for head injuries.

One person was injured in a two-car wreck on I-635 in Dallas today.  The incident occurred on the westbound lanes of the highway near the Preston Road exit.  Investigators report that a car was traveling slowly in the left center lane when a car came up behind it at a high rate of speed.  The second car failed to stop in time and crashed into the first car.  The driver in the first car was injured in the incident.

Tractor-trailer wreck on183

One person was injured in a rush-hour tractor-trailer wreck today on 183 the Airport Freeway at 360.  Authorities say that a sedan pulled in front of the commercial truck in heavy traffic and abruptly slowed down.  The truck then hit the sedan despite slamming on its breaks.  The injured person, a passenger in the sedan, was believed to not have been wearing a seat belt, and was taken to an area hospital for treatment.  Neither the driver of the sedan nor the big rig driver were injured.

SMU student struck near campus

An SMU student is hospitalized with injuries to her hips and legs after she was struck by a car driven by another student.  The accident occurred on Airline Road near Fondren, near the university campus.  Authorities believe that the accident is partly attributable to driver inattention and partly attributable to the victim's failure to use a crosswalk.  Authorities do not believe that charges will be filed, and the victim's injuries do not appear life-threatening.

Woman killed by Forest Hill crash

A Dallas woman has died as a result of injuries sustained in a wreck on Forest Hill.  The woman, Marcella Anderson, a paraplegic, was trapped in her wrecked vehicle in the 5300 block of SE Loop 820.  She had been traveling in a van when the van struck a wall.  Anderson was taken by paramedics to a Fort Worth hospital where she died.  Authorities are investigating the wreck to determine the cause, and also to find out whether any other vehicles were involved.

Driver injured in firey crash on Dallas North Tollway

A Cadillac was stalled in traffic on the northbound lanes of the Dallas North Tollway near the Trinity Mills Road exit when another vehicle crashed into its rear.  The Cadillac was pushed into a retaining wall and burst into flames.  A Dallas police officer was near the accident and is credited with saving the driver of the Cadillac.  The officer broke the passenger side window and pulled the driver out of the burning car to safety.  The driver, who is expected to survive, was taken to an area hospital for treatment.  No word on injuries in the other car.

One killed in three-car wreck on Stemmons Freeway

One man was killed in a recent three-car wreck on I-35E / Stemmons Freeway in Dallas.  The accident happened when an SUV struck the concrete retaining wall in the middle of the freeway and spun to face northbound traffic in the southbound lanes of the highway near the Market Center Boulevard exit.  The driver of the SUV left the vehicle in the highway and walked away.  Meanwhile, a Honda Civic struck the SUV head-on, and was itself struck from the rear by a Pontiac Solaris.  The second collision started a fire that ungulfed all three vehicles.  The driver of the Civic died at the scene, while the Solaris driver was taken to Parkland Memorial Hospital for treatment.  Authorities are investigating why the SUV driver left his vehicle on the highway.

Wreck spills pipe over overpass

A wreck on an I-35W overpass near that highway's intersection with I-20 caused pipe to spill from 35 onto the main lanes of 20, below.  The overpass was closed and blocked by the wrecked truck and its spilled road.  A school bus ran into some of the pipe and the big rig spilled, but fortunately no children were on the bus at the time.  Two ambulances were dispatched to the scene.  No word yet on injuries.

Two killed when pickup crashed into bus stop

Two men were killed when a pickup truck crashed into the bus stop in the 5300 block of Harry Hines Boulevard.  The driver, Julian Cadena Cerda, may have been drunk when the wreck occurred, and is being held in a Dallas County jail with intoxication manslaughter charges pending.  Cerda appears to have hit a tree before he crashed into the bus stop.  The victims, who may have been homeless men who were sleeping in the bus stop, were pronounced dead at the scene.

Two injured in wrong-way wreck on Stemmons Freeway in Dallas

Two people were injured in a wreck that occurred after a suspected drunk driver drove the wrong way for approximately 8 miles on northbound Stemmons Freeway, I-35E, in Dallas.  The driver, Jose Chavez, crashed head on into another car near Market Center Boulevard.  Chavez and the driver of the other car were injured.  Both were taken to Parkland Memorial Hospital for treatment.  The other driver has since been released.  Chavez has been transported to the Dallas County Jail.

Two injured in wreck on I-30 in downtown Dallas

Two people were injured early Wednesday morning in a wreck on eastbound I-30 near downtown Dallas.  Investigators report that the two cars were traveling in the far left lane of the highway when the front car suddenly stopped.  The rear car slammed into the front car, injuring the driver and passenger in the front car.  Noone in the rear car as injured.  Investigators believe that rainy conditions may have played a part in this accident.

Dallas accident injures two

Two people were injured today in a wreck with a box truck on Lovers Lane.  The individuals were riding in a Ford Taurus and were in the left hand turn lane of Lovers on the overpass of Central Expressway / U.S. 75, preparing to turn onto the southbound feeder road of the highway, when a box truck was traveling alongside.  The truck sideswiped the Taurus, forcing the car to the left.  Four people were riding in the car when the accident occurred.  Two escaped injury.  The two victims were taken to an area hospital for treatment.

One killed in wreck with police car

A man was killed when his disabled Jeep Cherokee was struck from behind by a police car early Thursday morning in Dallas.  Authorities say that the victim, 59 year old Terry Glover, was driving his Jeep when it broke down in the center lane of Polk near Camp Wisdom Road.  The police car was traveling on Polk and the officers apparently did not see the disabled Jeep.  They struck the car from the rear, pushing it through a metal fence and into the front yard of a home.  Glover was taken to an area hospital for treatment, but died later that day.

Motorcyclist dies in Fort Worth wreck

A motorcyclist was killed in a recent west Fort Worth wreck involving his motorcycle and a Ford Escape.  The accident occurred on the exit ramp leading from southbound West Loop 820 to eastbound I-30.  The motorcyclist, Geoffrey Daily, 32, of Fort Worth, was traveling in the right hand lane when the Ford Escape entered his lane.  Witnesses report that Daily took evasive action, but struck the metal railing and wrecked.  Daily was wearing a helmet.  He died approximately five hours after the wreck in the ICU at Texas Health Harris Methodist Fort Worth Hospital.

What is subrogation?

Subrogation is a legal term that refers to an insurance company’s ability to seek reimbursement from a third party for the money it paid out on a claim. Specifically, it is the ability of an insurance company to seek reimbursement from the party responsible for the accident that resulted in the claim.

Sometimes a person has to make an insurance claim through their own insurance company even when they weren’t at fault for the accident. The insurance company will pay out on their insured’s claim, but ideally it is the person who is actually at fault for the accident that should be paying for the damages. That’s where the concept of subrogation comes in.

It is the insurance company’s legal right to recover the money they’ve paid out by pursuing a claim against the at-fault party, which typically means pursuing the claim through the at-fault party’s insurance company.

Here’s an example of how subrogation works. John Smith is out driving his car when he is rear-ended by another car (driven by Allan) through no fault of his own. Allan’s insurance company is taking a very long time to process John’s claim.

In the mean time, John needs his car repaired so he can get to work every day. He decides to use his own insurance company to get the money he needs to fix his car. Because John was not responsible for the accident, John’s insurance company can seek reimbursement for the payment from Allan’s insurance company.

Subrogation can come into play in personal injury lawsuits as well. Subrogation allows the insurance company to “step into the shoes” of the person with the legal claim (the plaintiff) to seek reimbursement for money it has paid out to cover the plaintiff’s losses.

For example, suppose that Allan did not have car insurance, so John had to take him to court in order to get financial compensation for the accident. John files a personal injury lawsuit against Allan, and John wins the case. John’s insurance company, which had paid to fix John’s car, has a right to part of the money John was awarded.
