Common car accident injuries

Even a seemingly minor car accident can lead to severe injuries. While there are any number of ways a person can be hurt in a car accident, there are certain injuries that are the most common. These include:

Traumatic brain injury: Traumatic brain injuries occur when the victim’s brain is damaged or impaired due to a blow to the head. Traumatic brain injuries are more common in side impact car accidents than other types of motor vehicle collisions. Symptoms of a traumatic brain injury include headaches, dizziness, memory loss and seizures.

Spinal injury: More than half of all spinal cord injuries are the result of car accidents. Depending on the severity of the damage, a spinal cord injury can lead to temporary or permanent paralysis.

Back injury: A car accident can also result in damage to the discs that run down your spinal cord. Side-effects of a disc injury include numbness, weakness in the limbs and even paralysis. A second type of back injury commonly suffered in car accidents is a lower back sprain.

Whiplash: Whiplash is the most common of all car accident injuries. The victim’s head is forced violently forward and then backwards. Whiplash can result in damage to the nerves, muscles and joints of the neck.

Other types of common car accident injuries include:

  • Pinched nerves
  • Lacerations
  • Fractures
  • Bruising
  • Strained muscles
  • Scrapes
  • Dislocated arm, shoulder, leg or knee

Day care center van overturns injuring 13 children

A day care center van carrying 20 children was involved in a car accident Monday morning in Grand Prairie, Texas. The van collided with a Chevy Tahoe and flipped onto its side. Thirteen children were sent to various hospitals with non-life threatening injuries. The injured children ranged in age from 3 to 11.

The van, which belongs to the Kids Clubhouse day care center, had a capacity of only 14. The driver of the van, 20-year-old Karissa Acosta of Arlington, Texas, does not have a driver’s license.

When the accident occurred, the day care center van was traveling west on Mayfield Road. Acosta ran a red light after swerving around a car that was stopped at the light. After proceeding into the intersection of Mayfield and Great Southwest Parkway, the van was broadsided by the Tahoe. The force of the impact caused the van to spin. It then struck a curb, causing it to flip onto its side.

Like Acosta, the driver of the Tahoe, 30-year-old Aracel Torres of Grand Prairie, Texas, does not have a driver’s license. Torres’ was carrying two passengers, aged 2 and 4, both of whom were taken to a hospital with minor injuries along with Torres.

Acosta, police say, is likely to face multiple traffic charges, including allowing children to ride without seatbelts and running a red light. Acosta violated a law which went into effect September 1st, requiring all children in 15-seat passenger vans to wear seatbelts.

The day care, which is located in Grand Prairie, Texas, closed voluntarily for the day on Monday. Kids Clubhouse, which has a capacity of 138 children, has been in operation since January 2008. The center has had a total of 48 violations of the 2600 standards required by the state. Officials say the number of violations is consistent with other day care centers of the same size. All of the violations have since been corrected.

Study finds fewer Texas teens using cell phones while driving

Fewer Texas teens are talking on their cell phones and texting while driving – that’s what the results of a study conducted by the Teens in the Driver Seat Center of the Texas Transportation Institute show.

Over the course of two years, researchers surveyed more than 18,000 Texas high school students about their usage of cell phones while driving. Students from both urban and rural schools were included.

The percentage of teens who say they talk on the phone while driving dropped from 52% to 46% for urban teens and from 66% to 52% for rural teens. The percentages also dropped with regard to texting while driving, with the numbers falling from 47% to 42% for urban teens and 58% to 48% for rural teens.

Those percentages should drastically decline as it is now illegal for drivers under the age of 18 to use a cell phone while driving, a law that went into effect on September 1st of this year.

Guard Humvee goes airborne causing fatal six-vehicle accident

Three people are dead after a six-vehicle accident involving a National Guard Humvee. Wednesday morning, a National Guard Humvee traveling on I-35 near Troy, Texas, went airborne and flew over a concrete median.

The Humvee was being driver by a 21-year-old soldier named Altha Gibson. For reasons that remain unclear, Gibson drifted off the road and then recrossed both southbound lanes on I-35 before vaulting over the median.

The Humvee then struck a Toyota Corolla traveling in a northbound lane, killing the driver, 41-year-old Douglas Ashcroft. The Humvee remained airborne after hitting the Corolla and struck the cab of an 18-wheeler, killing its driver as well, 44-year-old Donald Johnson.

The Humvee finally came to a stop after landing upside down in the middle of the interstate. However, the chain reaction it set into motion was not over.

After being struck, the 18-wheeler jackknifed, hitting an unoccupied truck parked on the shoulder of the road along with the SUV it was towing. A trash compactor truck then crashed into the 18-wheeler. The driver of the trash compactor was not injured.

Gibson, the driver of the Humvee, was killed in the accident. The cause of the accident remains under investigation.

Texas car accidents: Proper lookout

One of the most common questions people have about Texas car accident lawsuits is how to determine who is at fault. In Texas, courts use the “proper lookout” standard to help determine whether a driver was negligent.

“Proper lookout” refers to a driver’s responsibility to carefully and intelligently observe the traffic around them and the general circumstances in the vicinity while driving. The proper lookout standard is the duty of all drivers to pay attention to both the road and other drivers and take reasonable steps to guard against car accidents.

If a driver does not meet the proper lookout standard, then they can be found negligent and held legally responsible for the harm caused by their negligence.

5-year-old girl hit by SUV while walking to school bus stop

A 5-year-old girl from Temple, Texas, was struck by an SUV on her way to a school bus stop Tuesday. The girl, Alyson Moreno, is battling life-threatening injuries sustained in the accident. Moreno suffered severe injuries to her face, head, upper body and legs.

At the time of the accident, Moreno was walking to catch the bus to Hector P. Garcia Elementary School along with a group of friends. None of the other children were hurt.

The driver of the SUV was 26-year-old Veronica Magana. Magana hit Moreno as she was crossing East Adams Avenue. Temple police say Moreno was dragged by the car for approximately 50 feet. Magana was not injured in the accident.

Driver charged with intoxication manslaughter in car accident death of Lewisville woman

A Lewisville, Texas, woman was killed when her SUV was rear-ended by a pickup truck early last Friday morning. The driver of the pickup, 31-year-old Larence Carter, was arrested at the scene for intoxication manslaughter.

The car accident victim was 53-year-old Ana-Maria Landa. Landa was pronounced dead at the scene of the accident. Carter suffered only minor injuries.

Both drivers were headed northbound on I-35E when the accident occurred. The force of being struck by the truck sent the SUV skidding across a service road. The SUV came to a stop when it crashed into a concrete abutment under the Fox Avenue bridge.

Police believe that slick roads caused by the heavy rainfall at the time of the accident also contributed to the collision.

New traffic laws go into effect on Sept. 1

A number of new traffic-related laws recently passed by the Texas state legislature will be going into effect on September 1st. Many of these laws are aimed directly at reducing the number of car accidents and accident-related fatalities on Texas roadways.

Here are some highlights from the list released by the Texas Department of Public Safety:

HB 537: More than half of all people killed in car accidents in Texas in 2008 were not wearing seatbelts at the time. Texas lawmakers hope to reduce this number by requiring all occupants of a vehicle to be secured by a safety belt, regardless of where they are sitting.

SB 61: Also addressing restraint usage, this law requires that all children younger than 8 (unless they are at least 4’9”) be restrained in an approved child safety seat.

HB 55: Driver inattention was doubtless a factor in many of the 60,000+ serious injury accidents in Texas in 2008. To help protect children, and to keep driver attention on the road, HB 55 prohibits the use of wireless communication devices in a school zone unless the car is stopped or a hands-free device is being used.

HB 2730: In 2008, 975 people were killed in Texas in car accidents involving a drunk driver. Lawmakers are cracking down on drunk drivers with this law that ups the penalty for driving while intoxicated with a child passenger. Under HB 2730, first-time offenders will automatically have their license suspended, with increased suspension periods for repeat offenders.

Another wrong-way accident kills three in Dallas, Texas

Three people were killed in a car accident caused by a wrong-way driver on Interstate 20 in Dallas, Texas.

Early Friday morning, a black Infiniti sedan was traveling east in the westbound lanes of I-20 when it crashed head-on into a jeep. It is unclear where the driver entered the interstate or for how long he was driving the wrong way before the accident occurred.

Twenty-nine-year old Rimiro Moreno, the driver of the sedan, and his passenger, Ian Edward Pierson, 23, both died at the scene. The driver of the jeep, Karla Rivers, 45, also died at the scene. Rivers was a dispatcher at Baylor University Medical Center.

The accident shut down the westbound lanes of I-20 for around five hours while police investigated the scene and the wreckage was cleared.

Toxicology reports will be needed to confirm if drinking was a contributing factor, but police have said that they located evidence of alcohol in the sedan.

This fatal car accident is the latest in a tragic series of wrong-way accidents that have plagued highways in the Dallas area. In an attempt to reduce the number of wrong-way accidents, the Dallas North Tollway recently implemented signs and lane markings to alert wrong way drivers.

NTTA takes steps to reduce number of wrong-way collisions on Dallas North Tollway

Official are taking action after a recent rash of wrong-way car accidents on the Dallas North Tollway have left four dead and several others critically injured.

Steps are being taken to warn drivers who are headed the wrong way on an exit ramp. One such step is placing reflective buttons, which are laid out in the shape of arrows, on the lanes of each of the tollway’s 47 exits. The arrows will glow red if a driver is driving the wrong way on the ramp.

In addition, 25 new warning signs have been posted that state “wrong way” or “do not enter,” which ups the total of warning signs to 215.

These actions come in response to the five wrong-way car accidents that have taken place on the Dallas Tollway this year. By contrast, there were only three fatal accidents out of 28 in 2003 to 2008.

Other approaches, such as low-hanging warning signs and electronic billboards to alert other drivers to a wrong-way driver, are being considered.

Auto Accidents and Personal Injury Claims and Negotiating with Insurance Adjusters - Top Ten List

As an experienced  personal injury lawyer in the Dallas Fort Worth area, I have come up with this top ten list for people who are considering negotiating on their own with an insurance adjuster for injuries sustained in an auto accident or other type of personal injury case.

Top Ten List - Considerations and Tips for People involved in a Dallas Auto Accident or Personal Injury Accident

1.  Insurance adjusters are not under oath and do not have to be honest with you.  I believe the top tactic in keeping adjusters honest is to hire a lawyer to file suit in your case where adjusters are held accountable and must be truthful.

2.  An adjuster typically deals with you fairly for the most part on property damage claims.  The adjuster tries to capitalize on the average person's lack of knowledge on the bodily injury component of an injury claim. Do not let them take advantage of you.

3.  Insurance adjusters handle thousands of auto accident and injury claims a year.  How many have you handled?  Do you really think you are going to have the upper hand in negotiations with an insurance company?

4.  Do not disclose any information about your health insurance to the auto insurance adjuster!

5.  Do not give the insurance adjuster a medical release authorization for your records.

6.  Do not disclose to the at fault insurance company's adjuster whether you have personal injury protection coverage on your own policy.

7.  Do not give a statement to the insurance adjuster prior to retaining a personal injury lawyer.

8.  Do not hire a lawyer who shows up at your doorstep unsolicited.

9.  Do not sign any releases provided by the insurance company or insurance adjuster.

10.  Seriously consider the benefits of hiring a competent lawyer you can trust and who is knowledgeable.  Hiring a good lawyer will do more than just level the playing field with the insurance company.

State trooper attempts to stop wrong-way driver before car accident near Dallas

Troopers were warned of a wrong-way driver on the Dallas North Tollway before an accident occurred which injured four, says the Texas Department of Public Safety. Ryan Matthew, 27, was speeding and driving south in the northbound lanes all the way from Frisco to Dallas, say authorities.

The accident took place on Sunday, June 21st near the Frankford Road exit. Matthew was driving the wrong way on the tollway for nearly seven minutes and ten miles.

Several callers alerted the authorities to Matthew’s out-of-control driving. DPS, however, says they were unable to stop Matthew, even after positioning a police vehicle in front of him. Matthew, says Lonny Haschel with DPS, simply swerved around the trooper’s vehicle and continued driving.

Eventually Matthew crashed into a vehicle, injuring the two 23-year-old women inside. Both women were taken to Parkland Memorial Hospital for treatment.  Matthew has not yet been charged with any crime.

Why Handling Your Own Personal Injury Claim is a Terrible Idea

Potential clients involved in an accident or injury claim that seek legal help or free advice from my law firm frequently ask this question--If I hire a lawyer and have to pay attorneys' fees, won't I end up getting less money in the end?

Nothing is guaranteed--however, I cannot remember a time when I had a client who, at first, was handling a claim on their own or was just about to settle with the insurance when they came to me with many questions and reservations about hiring a lawyer.  They trusted our law firm, and it proved to be worth it in the end.

A couple of questions should come to your mind (1) if you were in need of surgery, would you try to do the surgery yourself ? , (2) do you really have what it takes to take on Big Insurance and an insurance claims adjuster who handles thousands of claims a year?

Remember, the insurance adjuster is not under oath when they are dealing with you and they are frequently trained to do absolutely everything in their power to deny your injury claim or pay you as little as possible.  If you are thinking if it does not work out, I can always hire a lawyer later--think again. Commonly, people come in after trying to handle their injury claim with the "do it yourself" approach by giving the insurance company a statement unfavorable to their claim and missing crucial damages they are entitled to under the law.

If you have an injury lawyer or law firm who works your claim diligently and aggressively, your decision to hire a lawyer is more often than not worth the time.  While most people are concerned about their property damage, I remind potential clients that vehicles can always be replaced, but you only get one body during your lifetime, if you do not look out for your health, who will?

Abraham Lincoln once said, "A man who represents himself has a fool for a client."  If you have legal questions or need help or need legal advice with your personal injury claim, feel free to email or call me - mn@fnlawfirm.com or 1.866.705-7584.
