Texas man files personal injury lawsuit against hit-and-run driver

A Texas man has filed a personal injury lawsuit against the man who struck his vehicle and then fled from the scene of the accident.

The plaintiff in this Texas personal injury lawsuit is James Edward Mathews. On February 17th, Mathews filed his suit against alleged hit-and-run driver Jeremiah S. Freeman.

Texas men file personal injury lawsuit against Toyota after car accident

Three Texas men have brought a lawsuit against Toyota after they were injured in a car accident earlier this month. The men were riding in a Camry when it suddenly accelerated and crashed into a telephone pole.

The lawsuit, which accuses Toyota of negligence and product liability, was filed last Thursday in Bexar County District Court.

Named as defendants are Toyota Motor Corp. as well as Alamo Toyota, the dealership that sold the 2009 Camry involved in the accident.

The car accident occurred on February 4th when 30-year-old James Martinez was driving his boss' Toyota Camry.

According to Martinez, he applied the brakes as he approached a stoplight but the vehicle continued to accelerate. To avoid colliding with other vehicles, Martinez steered the Camry off the road, smashing into a telephone pole.

Last month, Toyota recalled more than 2 million vehicles in response to complaints of unwanted acceleration.

While Toyota linked the unwanted acceleration problems to sticking gas pedals, the police report of Martinez's accident indicates that a malfunction with the throttle control was the cause of the accident.

According to their lawyer, Bob Hilliard of Corpus Christi, Texas, Martinez suffered back and shoulder injuries as well as a concussion. The two passengers in the Camry suffered back and neck injuries.

A Texas woman is leading the charge in a campaign to ban texting and talking on cell phones while driving.

Jennifer Smith, from Grapevine, Texas, founded “FocusDriven,” an organization whose mission is to raise awareness about the dangers of distracted driving. Specifically, FocusDriven is dedicated to getting legislation passed that will ban talking on cell phones and texting while operating a motor vehicle.

FocusDriven is the first national nonprofit organization devoted specifically to raising awareness about the dangers of distracted driving.

Smith lost her mother in a car accident caused by a man who ran a red light while talking on a cell phone. Ever since her mother’s car accident death, this Texas native has been actively raising awareness about the dangers of using a cell phone while driving.

Grapevine man killed in pedestrian accident on Texas highway

A 72-year-old man well-known to Tarrant County residents was killed in a pedestrian accident early Monday morning.

The victim, Leslie Scribner, was regularly seen around Grapevine pulling a toy cart filled with stuffed animals.

Scribner died after being struck by a car while he was crossing Texas 26. The accident occurred near the highway’s intersection with Mustang Drive, but Scribner didn’t cross at the intersection and investigators are unsure why.

A man in his 40s was driving the gold Infiniti FX35 that struck Scribner. Police say the man has been cooperative, and they don’t expect to file any charges against him.

Fort Worth man killed in one-vehicle car accident

A Texas man was killed Friday night when he lost control of his pickup truck and his vehicle flipped into oncoming traffic.

The victim was 52-year-old Charles McAfee of Fort Worth.

McAfee was traveling northbound on U.S. Highway 287 near Turner Warnell Road shortly after 11:00 p.m. For reasons that are unclear at this time, his truck crossed the median and flipped into the lanes of southbound traffic.

McAfee was found lying in the road when officers arrived on the scene. Police believe he was ejected from his vehicle during the accident.

Six injured in a multi-vehicle accident in Fort Worth

A total of six people were injured in a three-vehicle accident early Tuesday in Fort Worth, Texas. The accident took place at around 8 a.m. on West Bailey Boswell Road, about a quarter of a mile east of Boswell High School.

Those injured in the accident include one adult, four teenagers and an 11-year-old girl.

According to investigators, two vehicles – a black Corvette and a silver Mercury – were traveling westbound on West Bailey Boswell Road. The Corvette was in the left lane, and the Mercury was in the right lane.

The driver of the Mercury changed lanes to the left, causing the Corvette to take evasive action and cross the center lane of traffic. The Corvette was struck on the passenger side by a gray Honda that was traveling on eastbound West Bailey Boswell.

As all this was happening, the driver of the Mercury overcorrected and drove off the roadway, crashing into a brick wall.

Three teens killed, three more injured in one-vehicle car accident

Three teenagers were killed and another three were injured in a one-vehicle car accident that took place shortly before midnight on New Year’s day.

The accident occurred when the car struck a traffic barrier in the 1800 block of North Loop 288 in Denton, Texas.

Right before the accident occurred, a state trooper clocked the car traveling at 78 mph in a 60-mph zone. The trooper was preparing to stop the car when it crashed into the traffic barrier head-on.

Toxicology tests are being performed. However, Captain Lenn Carter of the Denton police department says there is no signs that drugs or alcohol were involved. According to Carter, no determination has been made on whether charges will be filed.

This accident marks the second fatal collision on North Loop 288 in the past 30 days. Two 21-year-old men were killed in an early-morning car accident on December 6th.

Police officer, motorist injured in Fort Worth car accident

A car accident in Fort Worth, Texas, ended with two injured drivers.

On Wednesday afternoon, an on-duty police officer was involved in a collision with a gold four-door Oldsmobile Cutlass.

The officer, whose name has not been released, was responding to an emergency call. He was headed eastbound in the 1800 block of East Lancaster Avenue.

The driver of the Cutlass, whose identity has also not been released, was traveling northbound in the 2300 block of Riverside Drive. The cutlass and the police vehicle collided in the intersection.

Both individuals were taken to the hospital for treatment. According to police, the officer was released from the hospital the same day, but the condition of the second motorist was unknown.

Police investigate fatal Christmas Eve car accident

Fort Worth police are continuing their investigation into a Christmas Eve car accident that resulted in a fatality.

The victim was 44-year-old Timothy Head of Fort Worth. Head was fatally injured when his 2003 Hyundai was sandwiched between two pickup trucks in a chain-reaction car wreck.

Head was stopped at a red light behind a Dodge pickup truck, apparently waiting to turn left onto the intersecting street.

A Chevrolet pickup truck approached Head’s car from behind. The driver of the pickup truck, according to Fort Worth police spokesman Sgt. Chad Mahaffey, “failed to control his speed, entered the left turn lane, and struck the back of (Head’s) vehicle.”

The impact slammed Head’s car into the back of the Dodge pickup that was stopped in front of him. Head later died at a hospital of injuries he sustained in the accident.

No arrests have been made.

Four dead after car crashes into Southlake pond

Four people are dead after the car they were in crashed through a fence and landed upside down in a Southlake pond.

Shortly before 11:30 a.m. on Saturday morning, a Toyota Avalon ran a stop sign, smashed through a fence and bounced off of a tree before ultimately landing upside down in a six-foot-deep pond outside a Southlake home.

Two of the four victims, 56-year-old Monty Hardy and 35-year-old Hadassah Vance, died at a Grapevine hospital within an hour of the accident. The two remaining victims, 38-year-old Wendy Akion and 56-year-old Sharon Ransom, died overnight at the hospital.

According to Officer Roderick Page, a spokesman for the Southlake Department of Public Safety, traffic investigators have yet to determine whether the car accident was caused by driver error or a vehicle malfunction.

The possible vehicle malfunction being referred to is a stuck accelerator, a problem that forced Toyota to recall over 4 million vehicles this year. The Toyota Avalon is one of the models subject to the recall.

According to the National Highway Transportation Safety Administrations, the floor mats can interfere with the functioning of the accelerator pedal, causing the throttle to stick open.

Richardson teen killed in one-vehicle accident

A one-car accident at a Texas shopping center has left one teen dead and three others injured. The accident occurred at around 4 p.m. on Tuesday afternoon.

Robert Tucker, 16, was killed in a one-vehicle accident in a Richardson, Texas, shopping center parking lot on Plano Road. Tucker was a passenger in a white Ford pickup truck that crashed behind a SuperTarget.

Three others were injured in the accident, but their names have not been released because they are juveniles.

Richardson police investigator Jonathan Wakefield says that initial evidence indicates that the driver of the truck may have been speeding and lost control of the vehicle. The truck rolled over and struck a tree.

Texas teen killed in single-vehicle rollover accident

A Texas teenager was killed in a car accident early Sunday when she struck a guardrail on Northeast Loop 820. The impact caused her vehicle to roll over.

The victim, an 18-year-old whose identity has not been released, was pronounced dead at the scene.

The accident took place at around 3 a.m. in the 2500 block of Northeast Loop 820. The victim was traveling eastbound on the highway in a Ford Focus when she attempted to enter a ramp to head north, striking a guardrail instead.

The teen was not wearing a seatbelt, and she was partially ejected from her vehicle during the rollover.

Two killed in Dallas car accident

A car accident on LBJ Freeway in Dallas, Texas, claimed the lives of two people out for a birthday celebration.

The accident took place at 4:30 a.m. on Friday morning on Interstate 635, just north of downtown Dallas near the High Five interchange.

The deceased victims are 33-year-old Hugo Perez and 26-year-old Juan Balderas. The two were in a Volkswagen Jetta that was rear-ended by an SUV while the Jetta was parked on the shoulder of the freeway.

Police believe the driver of the SUV, a Nissan Xterra, was not paying attention to the road when it struck the Jetta.

The impact of the collision smashed the Jetta into the guardrail. The Xterra rolled over at least once. The driver was not injured.

A spokesman for the Dallas police says a charge of criminal negligence is expected against the driver of the SUV.

A 5-year-old girl, a passenger in the Jetta, was critically injured in the accident. She was riding on the lap of the right rear passenger.

Teacher injured when pickup truck plows through donut shop

A high school teacher was injured when a pickup truck crashed into a Grand Prairie donut shop.

The driver of the pickup, a 78-year-old man and a regular customer at the shop, mistakenly hit the gas instead of the brake. His vehicle then smashed through the shop.

Three teachers from Crosswinds High School were dining in the donut shop at the time of the accident. Two of the teachers were able to get out of the way of the truck, but the third was hit and taken to Arlington Memorial Hospital, possibly with a broken hip.

The driver of the pickup truck was uninjured. Police say they do not expect to bring any charges against him.

The owner of the building, Michael Zimmerman, estimates that the accident resulted in at least $5,000 worth of damage to the shop.

One-car accident on I-20 kills one, injures another

A 24-year-old Arlington man is dead after a one-car accident on Interstate 20 Sunday night. His female passenger was injured in the accident.

The accident took place sometime around 10:30 PM near Green Oaks Boulevard. The car, a Ford Mustang, had veered off the Interstate and smashed into a guardrail after the driver lost control of the car.

The driver of the vehicle was pronounced dead at the scene. The female passenger was taken to John Peter Smith hospital in Fort Worth with nonlife threatening injuries. The identities of the victims has not been released.

The exact cause of the accident is not known at this time. However, the police believe slick roads from the rain may have been a contributing factor. Police also say the driver was speeding at the time of the accident, which is according to witness statements.

Two other car accidents occurred as a result of the traffic caused by this crash. Neither of those crashes resulted in any serious injuries.

Pet boa constrictor missing after car accident

A boa constrictor is missing after a single-vehicle car accident last week.

Last Thursday, a woman, whose name officials will not release, was in a one-vehicle rollover accident in Troup. And she lost more than just control of her car…she lost her five foot-long pet boa constrictor.

When officials arrived at the scene, they found the woman walking down the road with her vehicle turned upside down in some nearby trees.

The woman told responders from the Troup Volunteer Fire Department that she was transporting the snake in an aquarium and that she could not locate the snake after the accident.

The woman was treated for nonlife-threatening injuries, and warns that the snake may bite.
