One injured in wreck on Six Flags Drive

One person was injured in a fender-bender today on Six Flags Drive in Arlington.  Authorities say that the accident occurred when a sedan followed to closely to a pickup truck to stop.  The sedan rear-ended the truck, causing injuries to the sedan's passenger.  The roads were wet at the time from recent rains.  Neither driver was injured in the incident.  The passenger is being treated at an area hospital and is expected to make a full recovery.

What is an intentional tort?

Picketers hit by car in Fort Worth, Texas

Two picketers were struck by a car Wednesday morning as they protested outside of a Fort Worth, Texas, Bell Helicopter plant.

The driver was 76-year-old Cullen McNair, a nonunion Bell Helicopter employee. McNair accelerated his vehicle as two picketers were walking between cars, knocking both victims to the ground.

McNair was arrested on charges of aggravated assault with a motor vehicle, a second-degree felony that could land him in prison for up to 20 years.

Approximately 2500 Bell Helicopter manufacturing workers went on strike one month ago at several plants in the Dallas/Fort Worth area. Negotiations resumed for a fourth time on Wednesday.

The victims suffered only minor injuries.

5 injured in 4th of July car accident

Fourth of July fireworks turned chaotic in Amarillo Saturday night after a multi-vehicle car accident that sent five people to the hospital.

A driver of a Grand Am was stopped in the left lane of Bell Street around 7pm, waiting to turn left into John S. Stiff Memorial Park to watch the fireworks. An Explorer traveling at an excessive rate of speed came up behind the stopped Grand Am. The driver of the Explorer swerved to avoid rear-ending the car and wound up crashing into a Corolla.

At this point, the driver of the Explorer completely lost control of the vehicle, rear-ending the Grand Am and then spinning wildly until colliding with a Dodge pickup.

A stream of people continued to arrive to watch the fireworks and found the Bell Street entrance closed for over two hours. Traffic was diverted to a second park entrance, but those entering on foot walked passed the accident on their way into the park.

Three fatal motorcycle accidents in Fort Worth under investigation

Three separate deadly motorcycle accidents that took place on Sunday in Fort Worth, Texas, are under investigation.

 

The first accident involved Dustin Cox, 25, of Forth Worth, Texas. Cox, who did not have a motorcycle license, was killed in a one-vehicle accident. The accident took place in the early hours of Sunday morning in the 6000 block of West FM455.

 

The second accident resulted in the death of 26-year-old Daniel Reed, also of Forth Worth. Reed was traveling northbound on I-35E in the HOV lane along with another motorcyclist when the two came upon a single vehicle accident. Reed was unable to stop and struck the vehicle. The second motorcyclist was not involved in the accident and left the scene.

The third accident took place Sunday afternoon, leaving 38-year-old Brian Mitchell of Fort Worth dead. Mitchell was riding his motorcycle east on FM455 when he crossed over the center line and collided with an oncoming vehicle. Mitchell was not wearing a helmet at the time of the accident.

Personal injury and wrongful death lawsuits against Chrysler and GM to be wiped out in face of bankruptcy

With Chrysler and GM being granted Chapter 11 bankruptcy, hundreds of personal injury and wrongful death claims against the corporation are being dropped – and not by the plaintiffs.The upshot of a government plan to bring GM and Chrysler LLC out of bankruptcy free of debt effectively wipes out the pending suits against them.

Before June 10th, the date on which the company emerged from bankruptcy, Chrysler sold 10 millions vehicles. And now the new Chrysler can’t be held legally responsible for any incidents involving those millions of cars and trucks.

GM is set to emerge from bankruptcy as early as July – and the same rule is likely to apply to the 30 million GM vehicles currently on the road.

The so-called “new Chrysler” is owned by Fiat, which will not be held responsible for liability claims made against Chrysler before the sale. The “old Chrysler” was internally insured. When its assets were vanquished, so too were any funds for legal backing.

Critics are challenging GM’s bankruptcy plan in court, claiming it would essentially deprive consumers of their legal right to pursue a product liability claim. The bankruptcy and sale to Fiat also means that none of the Chrysler vehicles sold before June 10th will ever be recalled for defects.

Experts also say that even consumers who have already won verdicts against Chrysler and GM will likely be unable to collect on their awards.

Three friends die in head-on collision with 18-wheeler

Three young friends were killed when they crashed into an 18-wheeler head on. The car, which contained a total of four people, was driving on Highway 181 in Wilson County, Texas, at 3:25 a.m. Sunday morning, June 7th,. The car drifted into oncoming traffic where it then struck an H-E-B big rig. Officers arrived on the scene and found the car in two pieces.

All four of the individuals in the car were thrown from the vehicle. The accident was so severe that the police have not been able to determine who was driving the car or whether the occupants were wearing seatbelts.

Three of the friends died from their injuries, while the fourth survived with critical injuries. The deceased were 20-year-old Kara Denkewalter, 20-year-old Priscilla Montoya and 18-year-old Orlando Brown.

The survivor is 21-year-old Hector Escuada. Escuada has not yet regained consciousness and remains in the intensive care unit at University Hospital.

Victoria boy struck by SUV while crossing the street on his bicycle

A 14-year-old Victoria, Texas, boy was hit by a car as he was crossing the street on his bike on the evening of Friday, May 22nd. The boy is Joseph Garcia, who was headed back home from a friend’s house when the accident occurred.

The identity of the woman driving the SUV that struck Garcia is not currently available. After striking Garcia, the SUV the collided with a truck being driven by 57-year-old Danny Kearney.

Garcia’s condition is unknown. The driver of the SUV, who had to be extricated from her vehicle, has since been released from the hospital.

Police identify drunk driver who caused three accidents and led police on chase

Police have identified the man responsible for causing a major accident in Weatherford, Texas, on Tuesday, May 26th. The man is 28-year-old Joshua Alvey, who was drunk driving at the time he was involved in three separate accidents.

On Tuesday afternoon, Weatherford police officers responded to calls about a drunk driver on South Lamar Street. As the police were dispatched, more calls came in reporting two hit-and-run accidents involving the same drunk driver. Police later learned the individual was Alvey.

Police spotted the suspect vehicle and attempted to stop the driver. Alvey refused to stop, instead leading police on a winding chase to Hudson Oaks and back into Weatherford. During the pursuit, Alvey struck a Honda Accord, pushing both vehicles into the intersection of Palo Pinto Street and South Bowie Drive where a third car was struck.

The driver of the Honda was a 49-year-old father who was riding with his 8-year-old son. Both father and son suffered critical injuries in the crash and were taken to two different hospitals. The 40-year-old woman driving the third vehicle suffered non-life threatening injuries.

Alvey was transported to a Fort Worth hospital for non-life threatening injuries. Once treated, he was released into the custody of the Weatherford Police Department.  No injuries were reported in either hit-and-run accident.
