One million dollars sought by Galveston seaman in personal injury lawsuit

A Galveston, Texas, man is seeking damages in excess of $1 million in a personal injury lawsuit after being thrown from a truck bed during a car accident. 

 

The plaintiff is seaman Richard Mendez. In the suit, Mendez accuses both his employer William Wright (A&B Seafood) and the driver of the truck of negligence. Both defendants are blamed for what Mendez is calling “severe and disabling injuries.”

 

Mendez was working as a deckhand for Wright on a commercial fishing vessel named the Alice Mae. The vessel was forced to return to Galveston after four days at sea due to inclement weather.

 

Upon arriving in Galveston, Mendez secured a ride home from Alva Porterfield of Newport, Virginia. Porterfield, the lawsuit alleges, failed to yield to the right of way at a stop sign. The resulting collision with another car caused Mendez to be thrown from the bed of the truck in which he was riding.

Plaintiff Wright is being sued for his failure to ensure Mendez’s safe transport to and from the vessel.

Both Wright and Porterfield are being sued for the “pain and suffering, mental anguish, emotional distress, disability and disfigurement” Mendez claims to have suffered due to the car accident.
