In the early morning hours of Sunday, August 2^nd, Dallas, Texas, saw its 34^th traffic fatality of 2009.

At around 3 a.m., David Ortiz Aguilar, 22, rear-ended a flatbed tow truck, killing his 24-year-old passenger. The accident occurred on Harry Hines Boulevard, close to the Webb Chapel Extension.

Witnesses say Aguilar was traveling at a very high rate of speed when he struck the tow truck as it was pulling away from a traffic light.

After crashing into the tow truck, Aguilar fled from the scene of the accident on foot. He ran into a nearby wooded area where he was pursued, and apprehended, by the police.

The deceased victim, who was also Aguilar’s roommate, was Fabian Nicholas Perez. Perez was pronounced dead at the scene of the accident.

Aguilar was arrested and jailed on charges of intoxication manslaughter.

A controversial high-speed car chase that took place Monday ended in a car accident that left the suspect in critical condition. The chase lasted 90 minutes, with Dallas County Precinct 2 deputy constables and other law enforcement officers pursuing the suspect through four different cities.

The chase came to a stop only when a truck with a green light proceeded through an intersection and t-boned the suspect’s vehicle. The accident took place near the border between Richardson and Garland.

The man who led the chase was 29-year-old Shane W. Michel, who is accused of forgery. Michel was driving wildly out of control, clipping highway signs and successfully avoided the stop sticks thrown into the road by law enforcement.

Michel was critically injured and spent several days in a hospital before he was transferred to the county jail. The driver of the truck was not injured.

The controversy swirling around the chase is centered on why the chase lasted as long as it did. Lack of communication amongst the various law enforcement agencies pursuing the suspect is being considered one of the top factors that contributed to the length of the chase.

The officers in the Department of Public Safety (DPS) helicopter could hear the frequency but were unable to respond. Telephone was the only means of communication between the two agencies.

Miscommunication was another factor. The Precinct #2 constables mistook an announcement over the radio stating “DPS is in it now” for “DPS is in the lead now.”

These factors combined led to the decision to reenter the chase.

Michael Gothard, the Dallas Constable, has admitted that mistakes were made. He does, however, defend the decision not to back off from the chase. Gothard states that criminals leading police on chases typically do not know that the chase has been called off and continue to run. “Our feeling is, in this situation, if we'd have backed off, that accident would still happen,” Gothard said.

Cristobal Isaac, 20, was killed when the car he was riding in was rear-ended by a speeding Ford Taurus. The Ford Taurus was seen weaving in and out of traffic at speeds as high as 100 mph. The Taurus struck the car, a Honda Element, from behind, causing two of its passengers to be ejected from the vehicle.

After his car was struck, the driver lost control of the vehicle, crashing into a guardrail. The Element then flipped over the guardrail and landed on the nearby access road. Another passenger, 22-year-old Stephen Waid, was also ejected from the vehicle. Waid is in life-threatening condition after he suffered severe head trauma.  After striking the Element, the Taurus then hit a Ford Explorer. No one inside the Explorer was injured.

Police believe the underage driver of the Taurus, 18-year-old Clayton Johnson, was drunk at the time of accident, which took place on SPID on Friday night, June 5^th. The car also held three passengers, all of whom are 16 years old. No one in the Taurus suffered serious injuries.

Johnson was arrested and put in jail. According to police, he will be charged with intoxication assault and manslaughter. The three underage passengers, also believed to have been intoxicated, will be charged in conjunction with alcohol use as well.  Police have not yet released the name of the deceased victim.
