Downtown Pedestrian Struck by Car

A woman pedestrian was walking to work this morning in downtown Houston when a car made a left-hand turn – into her! Fortunately, paramedics were able to respond promptly, securing her head and body and transporting her to a nearby hospital. Still, initial reports suggest that the pedestrian may have suffered a number of injuries, including internal bleeding.

Car accidents involving pedestrians often cause considerable harm and regularly change lives, both the lives of the pedestrian and the driver. Whether you’ve been struck by a car or inadvertently hit a pedestrian, you’re likely facing considerable legal challenges. You need an expert in your corner!

Crane Kills Worker in Occupational Accident

A construction worker in a Houston suburb died yesterday when the metal form of a crane tilted, then broke loose, trapping him underneath. During the accident, a metal strut struck the worker on the head, killing him. The worker, just 28-years-old, was the unintended victim of a construction tool that failed in its obligation to protect him, resulting in his tragic and unnecessary death.

Houston Firefighter Falls 40 Feet to His Death

Last weekend, Steven McShan, a 24-year-old Houston firefighter, attempted to climb from a second floor to a third floor balcony where several children were playing. As McShan was pulling himself up, the railing he was holding onto gave way. McShan wasn’t able to regain his grip on the third floor or his footing on the second and, tragically, he fell 40 feet to his death.

Firefighters face dangers every day in the line of duty. Whether fighting fires or helping children, they frequently encounter risks – and injuries – that are unique. Those unusual risks include noxious smoke inhalation, scalding heat, and dangerous products, such as loose railings. If you have a loved one who works in the fire department, make sure that they talk to a medical and legal expert if they’re injured. Oil & Gas Accident Injures Three

Last month, three workers were injured, one critically, when a pulling unit with a truck-mounted mast collapsed. One of the workers, Sergio Torres, was transported to a Lubbock hospital in critical condition. The Occupational Safety and Health Administration (OSHA) is investigating the accident. In all likelihood, all three workers have not only workers’ compensation claims, but potential legal causes of action against their employer, TEC Well Services, and the owner of the well site, Benners 37 #1.

Bikers Beware: Austin Cyclist Killed in Hit-and-Run Accident

Tragically, Austin cyclist Andrew Runciman was killed in a hit-and-run accident last week by a reckless motorist. As a testament to Mr. Runciman, an estimated 300 friends and fellow cyclists rode their bikes last week as a moving monument to the late Austinite.

Bicycling is more dangerous than many Texans realize. Every year, hundreds of American cyclists die and more than 50,000 sustain injuries; an incredible one in eight biking injuries are traumatic brain injuries.

Victim's Children File Suit Against San Antonio Bar

Lisa Harter, 26, died in January when her intoxicated companion and driver, Marcos Serda, flipped the car. In the wake of their mother’s tragic death, Ms. Harter’s children have filed a wrongful death suit against Mr. Serda and the San Antonio bar, the Flying Saucer, which served Mr. Serda drinks. According to the family’s legal representative, on the night of the accident the Flying Saucer was encouraging participation in the bar’s “U.F.O. Club,” a promotion that asked customers to drink every beer served in the bar.

Ms. Harter’s bereaved family has taken a sensible approach: sue the bar. (Of note, in the law bars and taverns are often known as “dram shops.”) If you or a loved one has been in an accident with a drunk driver, you may have a cause of action against the dram shop where they were drinking. The bar may share in responsible for the damages you incurred and injuries you sustained. Although his mother and brother were able to escape the house fire with only minor burns, Zachary suffered considerable injury before finally reaching safety. Over the last two weeks, he’s undergone skin grafts on his arms, thighs, chest and face.

Between Thanksgiving and mid-March, tens of thousands of Texans travel to the Rocky Mountains of New Mexico, Colorado and Utah. They participate in winter sports and skiing and most have a great time; however, an unfortunately large number succumb to skiing-related injuries. Despite ski facilities’ protestations about the “inherent risk” of skiing and other attempts to disclaim liability, important recent statutes and court decisions in these states have underscored that ski resorts retain liability for park terrain.
