Lethal Shards from IVC Filter Killing and Injuring Patients for Years

 

NOVEMBER 2015 - Reports first surfaced in 2005 that the radial arms and struts of medical equipment manufacturer Bard’s Recovery IVC Filter had broken off inside the body of patients. Since that time the U.S. Food and Drug Administration (FDA) has received around 1000 adverse reports involving the filters, primarily regarding the IVC filters fragmenting and embolizing inside the body. Due to these reports, made by both physicians and patients, and extensive research of the filters, the FDA urged physicians to consider the risks before recommending the IVC Filter be installed in patients who are ineligible for anticoagulation therapy. The FDA also recommends that the filters be removed as soon as the risk of Pulmonary Embolism has passed.

Despite the FDA’s warning, Bard’s redesigned IVC Filter has been implanted in more than 65,000 patients. A recent study of 258 IVC filter patients in Ohio indicated that tilting of the filter is a primary cause of failure when retrieving the IVC filter, but the study also mentioned that there was limited proof that "such filters should function as safe, permanent filters." The latest information featured recently on the NBC Nightly News also questions the safety of these deadly devices.

Ethicon Trial in Dallas Reports Testimony on TVM Dangers

NOVEMBER 2015 - Johnson & Johnson's Ethicon Prosima device is the center of a trial in progress currently in Dallas. The testimony stated that although medical professionals were aware that there are safer natural alternatives to the mesh product, doctors proceeded to permanently implant a temporary vaginal support device that may be defective. Ethicon's victims, like Carol Cavness suffered chronic pain, bleeding, tissue erosion, and infections. Patients implanted with Ethicon's Prosima device risked the need for additional surgeries at a higher risk. The testimony also revealed defects in the Prosima mesh, as well as Ethicon's failure to provide sufficient instructions and information regarding the side effects, adverse effects, and potential complications. Ethicon responded in court that the pharmaceutical company is not liable, stating that the injuries were caused by pelvic floor disorder unrelated to the Prosima transvaginal mesh surgery. The previous trial in April 2014 resulted in a $1.2 million verdict. A New Jersey court awarded $3.35 million in 2013 in a similar case.

New Hope for Pradaxa Patients due to Humanized Antibody Fragments

NOVEMBER 2015 - Pradaxa patients may have a better chance of surviving emergency surgeries, due to a recent study using 5g of idarucizumab (humanized antibody fragments). In critical cases, such as patients with uncontrolled bleeding, intracranial hemmorrhage, or severe trauma following an automobile accident, there is a marginally improved chance for the patient to survive invasive procedures. The specific study mentioned that the timing of the treatment is crucial, such as administering the anticoagulant within four hours. Normal results occurred 92% of the time, under controlled circumstances in the study from Boehringer Ingelheim. Results of the study were presented at the European Society of Cardiology Congress 2015.

Xarelto Trial Dates Set in Early 2017

NOVEMBER 2015 - Four trial dates are set for early 2017 for the consolidated multidistrict litigation (MDL) against Bayer AG and a Johnson and Johnson subsidiary regarding injuries sustained by Xarelto patients. U.S. District Judge Eldon Fallon in the Eastern District of Louisiana issued the order for trial dates of February 6, 2017 and March 13, 2017. Mississippi's Xarelto trials will be held on April 24, 2017. In Texas, the Xarelto trial will occur on May 30, 2017. The MDL allows the large number of individual cases of Xarelto injuries to benefit from certain streamlined class action processes, without becoming a class, including pre-trial motions, discovery, and settlement conferences. All plaintiffs will reap the benefits of all of the available evidence. The consolidated lawsuits allege that Xarelto causes severe internal bleeding, serious injuries, and death.

Red Light Runner Injures Cyclist

 

DALLAS TEXAS - Deb Culbertson, 26, was injured when an alleged drunk driver struck her as she was crossing the road on her way home from work at the Santa Fe Trail and Munger Avenue on her bicycle. Power Morcellators Transform Treatable Conditions into a Death Sentence

NOVEMBER 2015 - Surgeries using power morcellators have transformed treatable conditions into a death sentence. For one Texas family, this nightmare became all too real. A mother of three died from cancer that spread after her hysterectomy was performed using power morcellation. It all began when the OB/GYN discovered a possible tumor in the patient's uterus. After the surgery, the tumor was diagnosed as leiomyosarcoma. After three months of chemotherapy, the cancer spread to the abdominal wall. The patient passed away less than a year later. NC Federal Jury Rules in Favor of Mesh Manufacturer

 

NOVEMBER 2015 - On October 16, 2015, in the US District Court for the Western District of North Carolina, the federal jury ruled in favor of Boston Scientific Corp., in a case regarding the risks and dangers of transvaginal mesh (TVM). The Uphold TVM manufacturer was stated to have no liability for flaws in the design. The trial went on for 10 days, where a victim of the Uphold Vaginal Support System testified about her chronic pain and other injuries due to the permanently implanted device. It was found that the doctor who implanted the device did not follow the correct directions in this particular case. A portion of the testimony focused on the polypropylene material used to manufacture the mesh. The case alleged that the material stiffens as it degrades, contributing to the injuries suffered by the plaintiff.

Xarelto Lawsuits Multiply in 2015

 

NOVEMBER 2015 - Additional lawsuits filed this year in Ohio and Pennsylvania allege that the blood thinner drug Xarelto is causing serious injuries and death to patients nationwide. Head-on Collision in Burleson Injures Five

BURLESON TEXAS - Around 7:00 pm on Sunday evening, three adults and two children were critically injured in a head-on crash at the 7011 block of FM 917 and I35W in Johnson County. The two boys, aged 3 and 9, were transported to Cook Children's Medical Center and placed on trauma alert. Two women went to John Peter Smith Hospital, and one man was taken to Texas health Harris Methodist Hospital. Two of the victims were airlifted by CareFlite in critical condition.

Three Injured in Austin when 13-Year-Old Driver Ran Red Light at US 183 and Burleson Road

AUSTIN TEXAS - On Thursday, August 20, 2015, two teenagers were killed around 12:30 pm when the 13-year-old driver of a white 2003 Toyota Tacoma travelling westbound on Burleson Road ran the red light at the intersection with US 183. A 2013 Kenworth tractor-trailer travelling north on US 183 hit the Toyota at the driver's side door. The Toyota spun through the median to also hit the front of a grey 2003 Ford F-150 truck that was stopped waiting to turn eastbound on Burleson Road. The road was blocked during the clean up and investigation until almost 4 pm.
 
Three people from the Toyota were all transported to University Medical Center-Brackenridge, where the two teenagers passed away. The victims included the driver, Johan Maldonado, 13 and Vanessa Maldonado, 16. A 20-year-old female passenger from the Toyota was also seriously injured when she was ejected during the impact. The driver and passenger from the Ford were also injured and transported to St. David's South Austin Medical Center.

Veteran Firefighter Killed in Abilene Crash on I-20

ABILENE, TEXAS - A 51-year-old retired firefighter died in a trucking accident in August, 2015, when an 18-wheeler carrying gravel dumped the load onto I-20 near the Pine Street overpass. The resulting cloud of dust caused numerous accidents, as 14 vehicles collided due to no visibility. Joe Tidwell's car was rear-ended by a westbound tractor trailer. He sustained severe injuries, and his passenger, 42-year-old Shawna Elieff was transported to Hendrick Medical Center in critical condition.

IVC Filter Lawsuits Centralized

Nine Hospitalized after SUV Forces Car into School Bus

HOUSTON TEXAS - On Monday afternoon around 4:20 pm, October 5, 2015, an accident involving a private school bus, a maroon car, and a silver Toyota FJ Cruiser SUV injured 9 people in southwest Houston. Two young children who were passengers in the maroon car were transported to a local hospital, along with the driver of the car. The accident happened in the 7500 block of Rampart near Bissonnet around Braeburn Elementary school and the Energized for Excellence Academy. Witnesses reported that the SUV struck a school bus driven by Elizabeth Carpentir first. Next, the Toyota continued on to hit the back of the maroon car and forced the car into the second school bus, which was operated by Agurcia Delmy Bus Services.

One Injured as One Man Fled from the Scene of Arlington Car Accident

 

ARLINGTON TEXAS - One man was injured as another person fled from the scene of an accident at Lincoln and Washington. A 2011 Honda Ridgeline collided with a 2003 Toyota Matrix, when the driver of the Toyota failed to stop at a stop sign. The resulting wreck caused almost $10,000 worth of damage to the Honda. TN Woman Dies from IVC Filter Complications

COOKEVILLE TENNESSEE - Three months after having an IVC filter implanted in her stomach, a 76-year-old TN woman died from congestive heart failure and blood clots in her legs. The IVC filter was supposed to help with the blood clots. Prior to the surgery, the woman was able to live alone and had mobility. Once the surgery was complete, she suffered severe pain and remain hospitalized on a morphine drip, until she passed away at Cookeville Regional Medical Center in October.

Family of Four Dead in Accident near Conroe

 

CONROE TEXAS - On Sunday afternoon around 1pm, September 20, 2015, four members of the Sedlmeier family died in a wreck that also injured three others on SH 105 near Marina Drive in front of Conroe Fire Station Number 6. Ronald Cooper, 68 of Montgomery, had just left church when he was heading westbound in his 2011 Hyundai Azera sedan alongside the family's 2001 Toyota Echo sedan. His vehicle struck their car and caused it to spin into oncoming traffic. A blue Jeep Wrangler with a 16-year-old male driver and a 15-year-old male passenger heading eastbound hit the family's car, killing everyone in the Toyota. The victims in the fatality accident included Roland Sedlmeier, 49; Melinda Sedlmeier, 42; Harley Sedlmeier, 6; and Sofie Sedlmeier, 4. The two teenagers from the Jeep were treated at Conroe Regional Medical Center.  Mr. Cooper was also injured in the accident. Mr. Cooper had been taking medication for his diabetes and for a blood clot in his brain, but he was not drinking, according to his daughter Angela when she spoke with KHOU 11 News.

Will Praxbind Reign as a Safe Antidote to Pradaxa?

Washington Post Exposes FDA's Questionable Decisions Regarding Praxada

 

OCTOBER 2015 - The Washington Post published an article recently reporting concerns that the FDA did not adequately review the safety and risks of the Pradaxa blood thinner. Denton Driver Charged with Criminally Negligent Homicide in Fatal Crash

DENTON TEXAS - Jorge Ochoa was charged with criminally negligent homicide and injury to a child after a fatal accident hospitalized a five-year-old boy and killed a 22-year-old woman. Mr. Ochoa was allegedly driving in the wrong lane in the 9900 block of Sherman Drive in Denton, when he struck a Ford Focus. Ryland Brown,5, of Aubrey was critically injured in the crash. The boy was taken by CareFlite to Children's Medical Center of Dallas, where he was treated for serious facial and head wounds. A GoFundMe account was setup to help with the boy's medical expenses. The woman, a Brown family friend who was caring for Ryland Brown at the time of the accident, died at the scene.

Hewitt Crossing Guard Heroically Saves Child from SUV

HEWITT TEXAS - On Monday afternoon around 3:30 pm, October 5, 2015, a courageous and dedicated school crossing guard and cafeteria worker placed the safety of a child crossing the road above her own personal safety. Ramp to I-35E Ablaze in Trucking Explosion, 1 Dead

DALLAS, TEXAS - One person died early Monday morning, October 5, 2015, when a semi carrying a load of lumber crashed and exploded in a fire on the ramp from westbound I-20 to southbound I-35. Traffic was blocked for hours following the accident, although the fire was extinguished before 8am. Southbound I-35E was completely closed, but two left lanes were open on westbound I-20. Northbound I035E was reduced to one lane. Another vehicle was also involved in the crash. Burning wood from the semi fell to the ground below the ramp, spreading the fire.

Fatal Trucking Accident Closes US 385 for 12 Hours in Hartley County Texas

 

HARTLEY COUNTY, TEXAS - On Thursday morning, September 10, 2015, around 1:28 a.m., an accident involving a 2015 Freightliner Truck Tractor towing a 2008 Hyundai semi-trailer hit a 2014 Volvo Truck Tractor towing a 2009 Wabash semi-trailer. The resulting crash killed both drivers and a passenger at the scene. The Freightliner crossed over into the southbound lane of US 385 to hit the Volvo head-on. There was a fire with smoke that caused severe visibility issues, closing US 385 for over 12 hours. The three men killed in the wreck were Konnah D. Mannah, 29, of Euless, Texas; Jerome Stephen Hall, 48, from Colorado Springs, CO; and Jesus Salinas, 52 of Refugio, Texas. The accident occurred on US Highway 385 near FM 722 about two miles north of Channing, Texas.

Power Morcellator Investigation Challenges FDA Approval of Dangerous Device

OCTOBER 2015 - U.S. lawmakers are planning to launch an investigation into the FDA regulation of power morcellators. The U.S. Government Accountability Office has agreed to probe into FDA oversight of power morcellators. Although the GAO does not comment on ongoing investigations, it could take some time to complete the probe. Less than a year ago, the FDA stepped up its oversight of the surgical devices, due to the risk of previously undetected cancers spreading, such as uterine sarcoma following uterine surgeries. The investigation is leading some changes in the healthcare industry, such as private health insurers, such as Aetna dropping coverage for any surgeries using power morcellation.

The Food and Drug Administration determined that power morcellators cannot be made safer. Johnson & Johnson, previously the largest manufacturer of morcellators, has pulled their version of the device from the market. Many hospitals are no longer using the device in hysterectomies. Excessive Speed Causes Fatal Trucking Accident

TERRELL TEXAS - On Wednesday morning, September 16, 2015, William Edwards, 66, of Plano, Texas, was killed in an accident that involved four 18-wheelers and one car. Mr. Edwards was driving his black 2009 Nissan on I20 under the eastbound Spur 557 overpass, when a truck driven by Gurwinder Singh, 23 of New Jersey crashed into the Nissan and continued on to hit three other trucks. Two of the trucks lost their cargo, spilling tomatoes and frozen corn dogs all over I20. Mr. Singh's truck continued on to crash into a truck that was driven by Tom Sayavong, 57, from Keller, Texas. The fourth and final collision was when Mr. Singh's truck struck an empty gasoline tanker driven by Craig Barger, 47, from Magnolia, Texas. Although the tanker was empty, the collision caused a large diesel spill. The highway was closed for 10 hours during the cleanup.

Pedestrians Struck by Car in Lewisville

LEWISVILLE, TEXAS - Around 3:40 p.m. on Wednesday, September 9, 2015, two grade school children were hit by a vehicle near Lewisville High School while crossing the road. The accident occurred near Sun Valley Pool on South Valley Parkway in Lewisville. CareFlite responded to take one nine-year-old girl to Children's Medical Center in Dallas. The eight-year-old boy who was hit by the car was talking, responsive, and moving around following the accident, and his grandfather arrived to pick him up at the scene. Their injuries were not described as serious or life-threatening. The 17-year-old Lewisville driver who hit the children stopped and rendered aid.

Houston School Bus Driver Grateful to have Survived Fatal Accident

HOUSTON, TEXAS - Luisa Pachecho drove a Houston school bus for eight years with a clean driving record. On Tuesday morning, September 15, 2015, a 29-year-old HISD teacher named Nikita Allen swerved to avoid another car and collided with the left driver's side of the school bus that Ms. Pachecho was driving. The bus struck a guardrail and plunged off the overpass and onto the frontage road below. A 17-year-old student named Mariya Alyss Johnson passed away at the scene of the accident. A 14-year-old student named Janecia Chatman was hospitalized, but she died later as a result of her injuries from the crash. The driver and two other students were also hospitalized at Ben Taub General Hospital with serious injuries after the accident. Ms. Allen was also injured in the accident. This incident became the first fatal school bus accident for Houston's school district in the past 15 years.

I-635 in Dallas Shut Down for Rush Hour Due to Tanker Crash

DALLAS, TX - Rush hour in Dallas, Texas on the morning of September 11, 2015 was delayed due to a tanker truck that overturned and crashed with multiple vehicles. The entire westbound highway at I-635 and Plano Road was shut down for hours. The tanker was carrying butane, so hazmat workers responded to the accident. Traffic was backed up all the way to I-30.

2 Part NBC Nightly News Investigation into IVC Filters Reveals Alarming Facts

 

SEPTEMBER 2015 - Last week, NBC Nightly News aired a 2-part investigation about the risks involved with IVC filter surgery. The news segment took a closer look at the C.R. Bard company's IVC filters, which have been linked to more than 25 deaths nationwide. Over the past ten years, more than 300 injuries from IVC filter surgery have been reported. The IVC filter is designed to prevent blood clots from entering the heart or lungs when implanted in the largest vein in the body, called the inferior vena cava. This dangerous device is known to fall apart inside the victim's body, where sharp metal pieces of the filter pierce major organs, resulting in severe injury, emergency surgeries, and death. The failure rate of the IVC filter is excessively high.
 
The NBC investigation implied that one IVC filter manufacturer, C.R. Bard, scrambled to hire PR representatives and medical consultants to shift the focus away from the safety of the IVC filter in favor of the company's profits. NBC also suggested that the FDA approval of the IVC filter was questionable, as it took Bard multiple attempts to certify the device with the FDA. One story raises questions about the validity of the signature on the FDA application. The Regulatory Specialist who was contracted with Bard in 2002 was not provided with adequate information regarding safety performance testing prior to her signature being placed on the FDA form. The NBC report strongly urged patients to seek immediate medical assistance with IVC filters that were implanted to prevent blood clots. Two Killed in Four Car Crash in Houston

 

HOUSTON, TEXAS - Jason Dixon was arrested at the scene of a four car accident in west Harris county on eastbound Clay Road on September 1, 2015. He was charged with two counts of intoxication manslaughter, after Vincente DeLeon and Reyualdo Landin were killed in the crash. First, Mr. Dixon ran a red light at the intersection of Highway 6 and the 16200 block of Clay Road. A Ford E35, a Toyota Rav-4, and a northbound Jeep were all hit by his 2009 Kia Sedona in the resulting wreck. Mr. DeLeon died at the scene of the accident, while Mr. Landin passed away at a nearby hospital.

Deadly Rear-End Crash in Nacogdoches Kills 2, injures 3

NACOGDOCHES, TEXAS - Around 7:00 p.m. on August 28, 2015, 54-year-old California truck driver was driving northbound on US Highway 59 near Old Lufkin Road south of Nacogdoches, Texas. The semi-trailer that Rafael Polendo Hernandez was driving was hit from behind by a 2012 Chevrolet Traverse driven by Michael Zambo from Lufkin, Texas. Blaze Zambo, an infant passenger in the Chevrolet, died at Memorial Hospital from injuries suffered in the accident. Two six-year-old children who were also passengers in the Chevrolet were hospitalized following the accident. Six-year-old Richard Lira is still in critical condition at Children's Hospital in Houston. Laura Saldaña, 23, from Lufkin was also a passenger in the Chevrolet. Ms. Saldaña died at the scene of the accident. Michael Zambo was also hospitalized following the crash.

18-Wheeler Crashes on 1-35W Killing 1 and Injuring Woman

AUGUST 2015 - Around 1 a.m. on August 26, an 18-wheeler crashed into a minivan and an SUV on I-35W near Berry and Ripy Streets. One woman was hospitalized, and another person was killed in the accident. The Fort Worth highway was closed for hours during the aftermath of the accident.

Intoxication Manslaughter Charges for Wrong-Way Driver

AUGUST 2015 - Michelle Orduna celebrated her 23rd birthday on August 19, but the joyous occasion turned to tragedy around 2:30 a.m., when she drove the wrong way up the southbound Mano Road exit ramp on I-35 near Airport Boulevard. Her blood alcohol count was 0.17, which is more than twice the legal limit. Her passenger, Megan Mendez of New Braunfels, 23, died at University Medical Center at Brackenridge following the accident.

Clayton Matthew Keller of San Antonio, 26, was driving the Toyota Scion that Ms. Orduna's white Toyota Camry hit head-on. Mr. Keller passed away at the scene of the accident. He was a staff member and crew chief for SXSW. Ms. Orduna was booked and charged by proxy with two second degree felonies for intoxication manslaughter, as she was still hospitalized with critical injuries following the crash. Bail was set at $200,000.

Grandmother's SUV Totalled by Wal-Mart, Initial Settlement Offered at $3,200

AUGUST 2015 - A Midlothian, Texas grandmother took her Ford Expedition to Wal-Mart for a routine oil change. Roberta Slayton's car had 173,000 miles on the odometer and was in good, solid condition. A Wal-Mart employee crashed her SUV into a wall. The employee stated that the SUV's throttle stuck, and that he would have injured his colleague if he hadn't steered toward the wall. The Wal-Mart insurance representatives offered a $3,200 settlement, which does not cover the cost of replacing Ms. Slayton's vehicle. Initially, she was told that it would take 2-3 weeks for Wal-Mart to investigate to determine liability for the accident. She was advised to contact her insurance company to have her totaled SUV towed from the scene of the accident at her own cost. 4 Injured, 1 Dead in Corsicana Car Crash

CORSICANA, TEXAS - Sunday night, August 23, 2015, on North 45th Street in Corsicana, Obryan Keith of Corsicana died and four others were injured in a head-on collision between a Toyota Tundra pickup truck and a Chevrolet Cruze. Corsicana police, Fire Department, EMS, three air ambulances, and DPS responded to the scene of the accident. Among the injured was Danny Lee Drain, who is in stable condition.

T-boned on Lovers Lane

Why was My Transvaginal Mesh Defective?

AUGUST 2015 - Women who received bladder sling and pelvic support products in surgeries have reported severe complications for many years. Recently, a major vaginal mesh manufacturer announced a group settlement upwards of $200 million for the victims of its transvaginal mesh products. There were many root causes of the surgical complications that these women suffered.

Salado Truck Collides with Bridge Killing 1, Injuring 3

SALADO, TEXAS, MARCH 2015 - A truck driver hauling a boom lift ignored warning signs for a bridge on I-35 at FM 2484 and struck the bridge, killing 32-year-old Clark Brandon Davis from Arlington, Texas and injuring three others. The impact with the overpass caused beams to fall onto other vehicles. Three signs prior to the overpass had warned the 41-year-old truck driver for Lares Trucking, Valentin Martinez, that the bridge clearance was 13 feet 56 inches. In fact, the bridge height was over 14 feet, but the warning signs are designed to give some room for error. Oversized vehicles are required to take alternate routes when the low clearance signs are present. All lanes were closed for several hours after the accident. In total, five vehicles were damaged when beams from the bridge fell after the impact. In May, 2015, the DPS report concerning the accident found the truck driver to be at fault due to not paying attention while hauling an illegally oversized load.

Critical Concerns over IVC Filter Dangers and Complications

AUGUST 2015 - A recent study from The Journal of the American Medical Association revealed that the benefits of the IVC filter procedure are not always clear, when examined alongside the risks. The study stated that, "Although retrievable inferior vena cava filters are frequently used in addition to anticoagulation in patients with acute venous thromboembolism, their benefit-risk ratio is unclear... Primary efficacy outcome was symptomatic recurrent pulmonary embolism at 3 months. Secondary outcomes were recurrent pulmonary embolism at 6 months, symptomatic deep vein thrombosis, major bleeding, death at 3 and 6 months, and filter complications." Patients have reported complications, such as blood clots, chest pains, pain in the filter area, and ultimately, death from pulmonary embolism. In some cases, the IVC filter migrates inside the body, and cannot be removed. Lawmakers Expose Massive Public Health Hazards of Power Morcellator Surgical Device

US Senators Elizabeth Warren and Kirsten Gillibrand sent an open letter to the Commissioner of the US Food and Drug Administration expressing urgent concerns about the dangers of power morcellation devices. Prominent lawmakers, including Tennessee senator Lamar Alexander, Bob Casey of Pennsylvania, and Marco Rubio joined a bi-partisan group of senior leaders in the US Senate to increase the public awareness of the risks of power morcellators in hysterectomies and myomectomies. Senator Warren's letter specifically highlighted the need for the FDA to clearly communicate the risks of power morcellation, which could spread undetected cancer. Warren and Gillbrand urged the FDA to put the lives of the patients first, because of the tragic consequences of the 24 year record of power morcellators spreading malignancies during laparoscopic surgeries.

The Food and Drug Administration determined that power morcellators cannot be made safer. Johnson & Johnson, previously the largest manufacturer of morcellators, has pulled their version of the device from the market. Many hospitals are no longer using the device in hysterectomies. Currently, more than 20 lawsuits against the manufacturers of the device have been filed in 16 different federal courts. Additionally more than 300 cases against the manufacturers of power morcellators are currently pending.

Trucking Accident in Texas Kills Infant

AUGUST - 2015 - Nine-month-old infant Sawyer McIntosh died in a crash with an 18-wheeler early this month, when his mother's Hyundai SUV crashed into the truck that was parked in a moving lane on Highway 249 near Tomball, Texas. The truck had stopped and parked in the moving lane to attempt to deliver to a local business. Parking in a moving lane is illegal.

A grand jury will review the case against 44 year old Ruben Jimenez, the Houston truck driver for the Central Transport company, who was not injured in the crash. Carter McIntosh, the baby's mother and driver of the SUV was hospitalized after the crash. She was using her cell phone at the time of the accident. A GoFundMe has been set up for the family.

Repeat Drunk Driver Tyler White Thompson Kills Justin Romo in Pomona, California

Last weekend, a drunk driver in Pomona, California killed an innocent man in a wrong-way crash. The accident occurred after 3a.m. on Saturday morning on the 210 Freeway. Tyler White Thompson, age 24, swerved into the wrong lane and crashed into another car. The driver of that car, Justin Romo was driving with his girlfriend at the time; although his girlfriend suffered moderate injuries, Romo unfortunately did not survive the crash.

Thompson attempted to flee the scene but was later arrested at his home in Duarte, California. On Tuesday, August 12, he was charged with homicide and one felony count each of drunk driving, leaving the scene of the accident and driving under the influence of alcohol causing injury within 10 years of another drunken-driving offense. In 2011, Thompson had been convicted after he injured another victim while drunk driving. Unfortunately for Romo and his loved ones, Thompson repeated his mistake. He is currently being held on $1.1 million bail.

Two Bay Area Men Die at Winters Construction Site

Two construction workers working on a bridge site were killed last Friday morning in Winters, California after falling from a crane. The two men were identified as Marcus Zane Powell, 25, and Glenn Hodgson, 49. The two men were in a basket suspended by a crane when the basket, for a yet unknown reason, suddenly fell 80 feet to the ground, killing the two almost instantly. 

The bridge project that the men were working is part of the city's ongoing effort to replace an older bridge. The city had hired Burlingame-based Disney Construction to construct the new bridge and although the company had not faced problems at this particular site up until Friday, they had faced safety complaints in the past. According to Mercury News, Disney Construction was originally fined $4,500 after four serious breaches of safety regulations were found in 2008. In 2006, the company was hit with five safety violations and was forced to pay $1,500. OSHA is currently investigating this accident.

Actor Tracy Morgan Critically Injured and Comedian James McNair Killed in Horrific 6-Car Tractor Trailer Accident

At 1a.m. on Saturday, June 7th, SNL and 30 Rock actor Tracy Morgan was critically injured after an 18-wheeler operated by Wal-Mart crashed into his limousine. While the actor remains in critical condition, comedian James McNair who was also in the van limousine unfortunately died at the scene of the accident. 

The accident happened on the New Jersey Turnpike when Kevin Roper, 30, the driver of the Wal-Mart tractor trailer, "failed to observe" slow-moving traffic that was ahead of him. He was unable to keep control of the trailer which then crashed into the van limousine, causing it to spin and flip over. Three other passengers were critically injured as well. 

Roper was charged with one count of death by auto and four counts of assault in Middlesex County, New Jersey. Typically in accidents like these, charges are not immediately filed, prompting the question of whether or not Mr. Roper was dozing off at the wheel. According to a spokesperson for the National Transportation Safety Board, the group will be investigating the work/rest schedule of drivers. This comes a week after the U.S. Senate Appropriations Committee passed an amendment that would allow drivers to bypass their weekly time limits.

Tragic 18-Wheeler Accident Takes Lives of Two Texas A&M Basketball Stars, Injures Two Others

On the night of Tuesday, June 4th, four members of A&M Texas' female basketball team were involved in a tragic two-car accident with an 18-wheeler. Two of the women, Aubree Butts of Lewisville and Devin Oliver were both killed in the accident while two other players, La'Tisha Hearne of Richardson and Zenobia Winbush of Schertz, Texas were both critically injured but have since been released from the hospital. 

The accident happened at the intersection of FM1497 and SE Loop 286 in Paris, Texas. The exact cause for the accident is still under investigation and officials do not believe any foul play was involved but according to the eParisExtra, this busy highway intersection has seen 4 fatal crashes in the past few years.

A student-led candlelight vigil took place on the A&M-Commerce campus on Wednesday. A&M-Commerce Athletic Director Ryan Ivey spoke out about the accident, stating: "We continue to mourn the loss of two wonderful individuals. Accidents like this are never easy for anyone involved, and we continue to pray and console everyone who has been touched by these wonderful people. The outpouring of love and support from colleagues and athletic departments from around the country is nothing short of amazing. Transvaginal Mesh Causes Numerous Painful Problems for Many Women

 For many women, pelvic organ prolapse, the medical condition in which the muscles of a woman's "pelvic floor" weakens because of age or trauma, is a common and uncomfortable medical issue. Women who are diagnosed with the condition must deal with embarrassing side effects that occur when organs such as the bladder, uterus and small bowels drop into the vagina.

Although there are several procedures that can either help alleviate or altogether get rid of the problem, one particular procedure has recently caused numerous issues for an increasing number of women. OSHA Finds Serious Violations At Idaho Company After Death of Worker

An OSHA investigation into the death of a worker at Anderson Farms in Heyburn, Idaho that occurred in February has recently concluded. The employee, identified as Antonio Ponce, died on February 11th after becoming entangled in equipment used for cattle feed. After the accident, OSHA found five safety violations, including three serious violations. One of those violations included a failure to establish a lockout/tagout program, a procedure that insures that the proper practices and procedures prevent workers from moving machine parts during servicing and maintenance. According to OSHA, this system prevents approximately 120 deaths and 50,000 injuries a year. Two other serious injuries include a failure to report the death of a worker and failure to keep an OSHA injury and illness blog. Anderson Farms is currently facing a $25,200 fine.

Father Injured and Baby Killed By Pickup Truck in Arlington, Texas Car Crash

Last Thursday morning on May 29th, Daniel Bingenheimer and his 7-month-old son were waiting to cross a busy intersection in Arlington, Texas when a pickup truck hurtled towards them, crushing and killing the young baby, identified as David "Patrick Rebel" Bingenheimer. The driver of the pickup truck, Phat Cao, was attempting to make a left turn at the intersection when he ran into a white sedan and then jumped the curb, hitting Bingenheimer's young son in his stroller. 

Although there are no red-light cameras at this busy intersection, Star-Telegram reports that police are looking into the cellphone records of both of the drivers involved to shed some light on how this tragic accident occurred. A spokeswoman for Arlington police states that traffic engineers, working alongside investigators, are also examining whether the truck driver or the sedan driver had the green light. Freak Saw Accident on Construction Site Injures Female Pedestrian in Hell's Kitchen, New York City

A freak accident occurred this Tuesday morning in New York City that left one female pedestrian severely injured. A massive construction-saw blade came loose at a construction site located in Hell's Kitchen near Ninth Avenue and West 48th Street, and sliced the woman's leg. According to witnesses, the saw disk disconnected from the machine at almost 60 miles per hour, hitting a curb and flying 10 feet into the air before hurting the unnamed female. Although she suffered deep lacerations, she is stable and is expected to make a full recovery. 

An investigation conducted by the city's Department of Design and Construction is investigating how a blade that is used to cut concrete could possibly become disconnected and harm a passerby. Until the investigation is concluded, the site's contractors have been directed to stop using any other saws until all equipment is inspected.

Driver Daniel J. Calhoon Participates in 'Fainting' Game, Injures Several

A seemingly innocent 'fainting' game almost turned fatal this past Sunday in Manning, Portland. 19-year-old Daniel J. Calhoon was driving through the 772-foot-long Dennis L. Edwards tunnel when he decided to participate in the superstitious game in which passengers (not drivers) hold their breath for the length of a tunnel. Calhoon passed out after holding his breath and crashed into an oncoming Ford Explorer that held two passengers, 67-year-old Thomas Hatch Jr and 61-year-old Candace Hatch. Another pickup truck also hit Calhoon and his passenger when it was unable to stop. Four people total were inured with one seriously injured, who was transported to a nearby hospital. After a short investigation where Calhoon was found to have participated in this thoughtless and careless game, he was charged with reckless driving, 3 counts of recklessly endangering another person and assault in the fourth degree.

Metal on Metal Hip Implants Increasingly Causing Problems for Patients

According to Dr. Jay Mabrey, chief of the Department of Orthopedic Surgery at Baylor University Medical Center, approximately 400,000 hip replacements are performed each and every year. While the majority of these replacements are successful, many metal on metal hip implants cause serious problems and constant pain for patients.

Surprisingly, many patients don’t even know the name or type of artificial hip they have in their bodies. Many of Dr. Mabrey’s patients for example, don’t realize that the ‘clicking’ noise they may hear is due to the fact that they have metal on metal hips. These particular hips are often made of chromium cobalt metal and when they grind against one another, they can cause a dangerous condition called metallosis in which the chromium metal debris builds up in soft tissues in the body. This can lead to destruction of ligaments around the hip, neurological toxicity and/or psychological or cardiac toxicity. 

Although hip replacements generally come with a hefty price tag, hip implants in the past 10 years have faced high recall numbers. According to the Safe Patient Project, 578 recalls from six major manufacturers, have occurred in this time. Furthermore, given that these hip implants are approved by the FDA in a shortcut process called 510K, many of them are not rigorously tested by either the manufacturer or the FDA. Increasingly, these manufacturers, including DePuy - which has recently settled a class action lawsuit for $2.5 billion – are facing litigation from rightfully unhappy and unsatisfied patients.

Peter Chen in Critical Condition after being Struck by an Automobile

 

Multnomah County, Oregon -- July 4, 2013

10 year-old Peter Chen of Portland, OR has been hospitalized and is in critical condition after being struck by a vehicle Thursday morning. The Portland Police Bureau indicated that Chen was attempting to cross the intersection located on Center Street and 82nd Street with his family when he was struck by a Honda Civic that failed to yield properly at the cross walk he and his family members were standing on. The vehicle was being driven by a 58 year-old female motorist, whose name has yet to be released to the public, at the time of the accident. Although no other family members were injured, 10 year-old Chen was transported to Doernbecher Children's Hospital with reports of serious injuries. Sources confirm that the motorist was not operating the vehicle under the influence of drugs or alcohol, and was not speeding at the time of the accident. Juan Antonio Garcia- Hernandez Killed By Piece of Iron in Port of Port Arthur

Juan Antonio Garcia-Hernandez, a contract worker from Orange, Texas, was killed yesterday when he was struck by a 10-foot piece of angle iron that fell from 40 feet above him. At the time, Garcia-Hernandez was contracted by Mason Construction on a job site located in the area of the Port of Port Arthur. The area in which the accident occurred was leased by an overseas company called German Pellets.

The accident occurred early Wednesday morning, when contractors were busy building silos. A manlift, operated by JLG Manlift, was also assisting the contractors in building the structure when it became stuck and switched to safe mode. As workers attempted to free the manlift, a piece of angle iron was catapulted from the basket of the manlift and struck Garcia-Hernandez. Workers had roped off a zone for the manlift but the piece of iron had fallen outside of that area when it hit Garcia-Hernandez. He was quickly transported to Christus Hospital – St. Elizabeth but the severe injuries to his upper body were too much and Mr. Garcia-Hernandez unfortunately passed away. Workplace injuries are common, but are especially tragic when a worker dies due to the negligence of others. With an accident like this, we must ask ourselves: who is to blame? Several individuals and companies could be at fault: Mason Constrcution, who contracted Garcia-Hernandez and placed him in unsafe working conditions; German Pellets, who leased the property and who did not ensure safe working conditions; or JLG Manlift, for hiring an incompetent manlift operator. Another question we must ask ourselves is whether the manlift was fully operational and working properly at the time. Why did it become stuck in the first place? Lastly, Mr. Garcia-Hernandez was outside of the zone when the iron struck him. Was the exclusion zone not properly sized?

These are all questions that an attorney can help family members answer in the aftermath of a workplace death. On many construction sites, contractors and property owners skimp out on the proper safety measure because they would much rather have employees working than giving them the time to ensure that safety precautions are made. A smaller exclusion zone could have been put in place in order to give workers more space to work, but in the process, a worker loses protection on a job site.

With so many parties and variables involved, time is of the essence. Felipe Saiz and Juan Manuel Estrada-Duarte, two oilfields workers from Big Springs, were both fatally injured in two different oilfield accidents last week. A day later, Juan Manuel Estrada-Duarte, 59, died after a heater treater rolled over him and pinned him against another treater. Employees at the time were preparing oil for a large transport with the heater treater when the accident occurred. Estrada-Duarte was extracted from the treater, as the company did have the proper extraction equipment on site, but their efforts were too late and the valued employee died from his fatal injuries.

Given that these two accidents occurred within a day of one another, an investigation by OSHA, the Occupational Safety and Health Administration, is expected.

 

Accident Investigation

A number of parties involved can be at fault for both accidents - the respective owners of the oil drilling companies, careless employees, and any company who may have performed faulty maintenance on the oil rig or heater treater that caused these two fatal accidents. An investigation by OSHA is underway and will reveal the full, unbiased details of the accidents.

However, it is important for the families of those fatally injured to seek legal counsel to retain accident reconstruction experts on their behalf. The oilfield companies' insurance will most likely seek to hire their own experts that will be partial to their company in an attempt to interfere with or negate any claims made on behalf of the families of Saiz and Estrada-Duarte.

Legal counsel can also investigate whether or not other employees were at fault. Employees should be properly trained, follow safety regulations, and pay adequate attention while at work. However, it is still the companies' responsibility to provide adequate training and proper supervision in order to prevent fatal accidents from occurring. Therefore, oilfield companies cannot simply place the blame on a careless employee as it is their responsibility to properly train and watch employees in the first place.

The details of both accidents are still unclear, but it is important that family members retain counsel to represent them before the companies' insurance attempt to mitigate and lessen these two unfortunate accidents.

Good Samaritans Brian Jennings, Hollie Boyles, and Shelby Boyles Killed By Driver Ethan Couch in Tragic Burleson Accident

Over the Father’s Day weekend, a tragic car accident occurred that left four victims dead in Burleson. The accident occurred when a pickup truck filled with eight teenagers sped through Burleson-Retta Road and struck a car on the side of the road. Three people had stopped to help the stranded motorist when the pickup hit the car, resulting in the death of all four people. Whistleblower Claims Manufacturer of Actos Downplayed Bladder Cancer Risks

Dr. Helen Ge, a medical doctor and former safety consultant for Takeda Pharmaceutical Company, recently blew the lid on the company after they failed to properly disclose evidence that linked use of Actos to an increased risk of bladder cancer. Dr. Ge knew of the connection but when she tried to report it, company officials resisted and downplayed the number. More than 100 bladder cancers were linked to the use of Actos, but only 72 were reported to the FDA. Not only did Takeda Pharmaceutical Co. fail to disclose an accurate number of bladder cancers related to the usage of Actos, they also failed to accurately report to regulators and proper officials about the hundreds of congestive heart failure cases that were associated with taking the drug.

At all turns, Dr. Ge claims, she encountered resistance from superiors when she attempted to report the truth about the potentially deadly side effects that could result from taking Actos. She was forced to underreport or purposely change her assessments, and ultimately, her contract with the pharmaceutical company was terminated.

As Dr. Ge states, “Takeda’s motivation to fraudulently report and under-report the serious adverse events was driven by an economic desire to falsely enhance Actos’s safety profile and to increase sales.” Unfortunately, this has been true for various pharmaceutical companies whose products have similarly endangered the lives of millions of consumers. Texas Sawmill Cited by OSHA for Violations After Death of A Worker

In December 2012, a worker at Nix Forest Industries Inc. in Timpson, Texas was killed after he was struck by a broken band saw blade. This sparked an investigation by the U.S. Department of Labor’s Occupational Safety and Health Administration (OSHA), revealing that workers were routinely exposed to hazards at the sawmill. Nix Forest Industries Inc. was ultimately cited with 17 safety and health violations, one of which was willful.

Nix Forest Industries Inc. knowingly put the well being of their employees in danger, as indicated by the willful violation, which is a violation that is committed with “intentional, knowing or voluntary disregard for the law’s requirements, or with plain indifference to worker safety and health.” Stephen Boyd, OSHA’s area director in Dallas, states, “Nix Forest Industries failed to take adequate measures to protect workers from a variety of hazards, including being struck-by and caught-between machinery and equipment. Following OSHA standards saves lives. This unfortunate loss of life could have been avoided.” The total proposed penalties total $116,200 but a dollar amount does not replace the unnecessary loss of life that occurred in December.

In this unfortunate situation, the violations committed are clear. Under Texas law the findings of OSHA in this matter would support a jury finding of gross negligence, and a jury award of exemplary damages, in a jury trial of a lawsuit filed by the surviving family of the deceased worker. In fact, due to the gross negligence committed by the sawmill and the extent to which these violations endangered employees, a jury could easily award exemplary damages far in excess of the total penalties proposed by OSHA of $116,200.00. Such an award would serve the purposes of punishing Nix Forest Industries Inc. for its disregard in employee safety that resulted in the worker’s death in this incident, and helping to deter Nix and other employers from committing gross negligence in jeopardizing the safety and lives of workers in the future.

Again, while any monetary damages do not replace the loss of life, employers like Nix Forest Industries Inc. should be held accountable for their wrongdoing. Fastest Motorcyclist in the World Crashes in Texas

238 miles per hour is a pretty good clip for a small airplane. On a motorcycle, it’s insanely fast. 18-Wheeler Accident Wrecks 10 Cars, Delays Hundreds of Drivers

If you’ve travelled in Texas, you probably know that the stretch of Interstate 35 between Dallas and San Antonio is one of the most crowded, dangerous roads in the United States. Just last week, an 18-wheeler driving through Waco and pulling an oversized load slammed on his brakes in the middle of the highway, causing a ten-car pile-up that injured two and causes hundreds of thousands of dollars in property damage.

 

On the surface, the wreck appears to be the result of an 18-wheeler driver paying attention to his surroundings: he came to a sudden stop because he realized that he wouldn’t be able to fit his oversized load underneath an overpass. The reality, however, as an investigation by the Department of Public Safety has revealed, is that the accident would have never happened had the driver continued on his specified route on Loop 340.

One-Third of Mother's Prozac Transferred to Baby via Umbilical Cord

A recent study of the effects of Prozac (sertraline) on babies in the wombs of pregnant mothers found that fetal exposure to sertraline was approximately one-third of maternal exposure. Similar to the way that fetuses are affected by a pregnant woman’s ingestion of alcohol, mothers who continue to take Prozac (sertraline) during pregnancy expose their unborn children to significant amounts of this dangerous drug.

 

Prozac and other SSRIs, particularly when consumed during the first trimester, have been known to increase the risk of a series of birth defects which include such ailments as anal atresia, limb reduction, and omphalocele.
