Elderly Lady Dies in Lubbock Accident

Helen Boone, 84, died this week in a two-car accident in Lubbock, Texas. An initial investigation completed today revealed that Boone drove her Lincoln sedan onto a busy street without realizing that a GMC pickup truck had the right of way – or that the driver did not expect Ms. Boone to violate his right of way and pull into his lane. By the time Ms. Boone was too far into Indiana Avenue’s oncoming traffic, the driver of the GMC was committed to going through his green light. The accident was catastrophic, and Ms. Boone died at a Lubbock-area hospital soon after the wreck.

As an attorney specializing in automobile accidents, personal injury, and wrongful death, I watch with concern at the growing number of elderly drivers who are involved in serious – and often fatal – accidents. Like very young drivers, older drivers tend to be responsible for a disproportionate share of accidents across Texas. Older drivers don’t intend to create a dangerous situation, but their decision to drive is often reckless, endangering the property and lives of other motorists.

Drunk Driver Kills San Antonio Motorcyclist

San Antonio motorcycle driver Robert Louis Carter III died in the early morning hours today after he was rear-ended by a hit-and-run driver and subsequent run over by a drunk driver in her 20s. Incredibly, the drunk driver was so out-of-touch with her surroundings that she continued to drive even after her airbags deployed.

Mr. Carter’s death is a tragic reminder that Texas highways can be dangerous, particularly at night and for people driving and riding on motorcycles. As if that’s not enough, reckless and inebriated car drivers make Texas’s heavily travelled roads and highways particularly risky.

Fort Hood Solider Killed in Temple Traffic Accident

Private Gregory Anthony Salas died this week in a tragic automobile accident in Temple, Texas. A member of the 1st Cavalry Division stationed in Fort Hood, Salas was a veteran of Operation Iraqi Freedom and the recipient of several individual and unit citations for his distinguished service. Salas deserved better than to die on a lonely stretch of Texas highway at the hands of a negligent driver.

Every week, dozens of Texans die in automobile accidents that are often as preventable as they are tragic. Alcohol consumption, sleep deprivation, in-car distractions like cell phones and radios, and improper vehicle maintenance are frequent contributors to today’s accidents. These accidents cause property damage, personal injury, and death – and in the process, change the lives of families just like yours.

Motorcycle Accident Takes Life of Lubbock Judge

The Texas legal community is mourning the loss of Lubbock County Judge Rusty Ladd. Judge Ladd was on his way to court last Friday when another vehicle slammed into his motorcycle, sending him to the hospital where he died a few hours later. Judge Ladd’s final acts were in keeping with his long-standing commitment to the fair and efficient administration of law. Fighting through intense pain, Judge Ladd instructed hospital personnel to contact his court so that litigants would know of his absence from court.

Judge Ladd’s accident is tragic, but it’s not as uncommon as many would like to think. Motorcycles are dangerous – and reckless car drivers make motorcyclists particularly prone to catastrophic accidents. Whether you’re dealing with an insurance company or a recalcitrant litigant, it’s important to hire an attorney who fully understands the legal challenges you’re facing. Fortunately for you, Fears | Nachawati specializes in motorcycle accidents and the law that governs these accidents. For your free consultation, call us at 1.866.705.7584 or email mn@fnlawfirm.com. Austin Drivers Worry As Higher Speed Limits Hit I-35

The Texas Department of Transportation announced this week which roads will receive a speed limit increase to 75 miles per hour. At the top of the list is Interstate 35 north of Austin. I-35 is already one of Texas’s most accident-prone roads. Now, the heavily travelled highway will become even more dangerous, as some experts argue that higher speed limits lead to more reckless driving and, as a result, more accidents.

The increased speed limit has Austin-area drivers worried. The Austin area section of I-35 has long been considered one of the most dangerous in Texas. Between January 1991 and December 2000, for instance, 277 people died in automobile accidents on stretches of I-35 in Travis, Hays, and Williamson counties. By comparison, there were just 199 driver fatalities on even busier stretches of I-35 in Dallas County during that time.

If you’ve been in an accident in Texas, there’s only one law firm you should consider for your insurance and personal injury claims. Fears | Nachawati is devoted to protecting drivers who have suffered property damage and pain and suffering in their car wreck. The consultation is free! Hit-and-Run Injures Houston Driver

The driver of a Toyota Camry was flown by helicopter to Memorial Hermann Hospital in Houston, Texas, late last night after the driver of a Nissan Altima slammed into him head-on. According to accident investigators, the injured driver was pinned in his car as a result of the violent collision. Today, he is in serious condition as he fights for his life.

Vehicle accidents happen every day across Texas. From fender-benders to fatal collisions, most Texans are involved in an automobile accident during their lives. Lubbock Truck Driver Injures Police Officer

Today in the west Texas town of Lubbock, a 79-year-old truck driver slammed into a police cruiser after he failed to yield the right of way. The police officer was taken to a local hospital so that doctors could examine his injured arm and check the rest of his body for non-apparent injury, such as a concussion or internal bleeding.

Car accidents can cause thousands of dollars in property damage and much, much more in medical costs. Unfortunately, insurance companies frequently try to haggle with victims, knowing that people who are hurt or out of work may be willing to settle their claims for less than they're worth. It’s a tragic reality, but it happens every day.

Have you been in a car or truck accident? You probably need someone to fight for you. Are You One of the 75,000 Americans Exposed to Transvaginal Mesh Dangers?

Between 1992 and 2010, the FDA approved 85 surgical mesh devices to treat pelvic organ prolapse, and in just the last year more than 300,000 American women underwent surgical procedures to repair prolapsed organs, according to FDA reports. More than a quarter of these operations used transvaginal mesh. For a significant number of these women, the high-risk associated with these devices caused a variety of pelvic-related medical problems.

Fears Nachawati is leading the fight to protect victims of this dangerous medical device. For hundreds of women annually, transvaginal mesh causes considerable harm to their bodies and their futures. If you or a loved one have suffered complications from these medical devices, you need to let us know. For your free consultation, call us at 1.866.545.8364 or email mn@fnlawfirm.com. 18-Wheelers Collide in Wheeler County

On Highway 152, a poorly maintained back road in Wheeler County, a sparsely populated area in the Texas panhandle, two 18-wheelers slammed into each other earlier this week. The results were tragic – and fatal. As the result of reckless driving, one driver was ejected from his cab, killing him. The other driver’s truck was thrown on its side and, sliding across the road, caught fire. Only by good luck was the man able to escape. His injures were non-life threatening, but he was sent to a local hospital.

Thousands of miles of Texas highways are poorly lit and falling into disrepair. The result is that wrecks are more common, including fatal accidents like the one in Wheeler County. Do you regularly travel on these highways? You should be careful!

Two Die in Fatal Houston Crash

A car accident in southwest Houston claimed the lives of a driver and his passenger this weekend. The driver lost control of his speeding Chevrolet Camaro, then jumped a curb and slammed into a light pole and a brick wall. The force of the collision was overwhelming, throwing the driver from the vehicle and killing the passenger.

This tragic accident is horrible for the families of both victims, but it is particularly difficult for the passenger’s loved ones. The passenger didn’t have control over the car and didn’t have the ability to influence the outcome of the fatal accident. Under Texas law, the driver is not only responsible for his own safety, but her safety, too.

Fears | Nachawati helps accident victims and their families recover from the pain and shock associated with a traumatic collision. If a passenger you love was hurt or killed because of a driver’s negligence, he or she should speak with our experts immediately. We can help your family put their lives back together! Single Car Accident in Houston Leaves Bereaved Family Searching for Answers

A 65 year-old man in West Houston died Tuesday morning when he cost control of his car and slammed into a utility pole. The driver, who was travelling at a sufficiently high rate of speed to knock down the pole, may have suffered from a medical condition. Investigators suspect that the condition could have played a part in the accident.

Tragically, the man’s family is now left to search for a way forward. The accident was sudden, and the cause remains in doubt. As a result, next-of-kin don’t know whether to blame the driver, the car, the medical condition, or some combination of these factors. Does this sound familiar? Has your family lost a loved one a car accident? Are you struggling to determine why the car wreck occurred and who might be responsible?

Fatal Accident on Texas Hill Country Backroads

The intersection of FM 1101 and FM 306 near New Braunfels, Texas, was the scene of a fatal car accident Friday night when the driver of a Honda Civic broadsided a GMC Yukon. The late night wreck occurred when the teenager driving the Honda Civic rolled through the intersection. The “t-boned” Yukon became impossible to control, rolling and throwing the driver from the car. Friday night’s accident underscores important realities: SUVs aren’t always safer than cars, and a roll is often fatal.

Your Avaulta Prescription Might Do More Harm Than Good

If you’ve had a pelvic organ prolapse (POP), your doctor might have prescribed an Avaulta Plus, Avaulta Solo, or Avaulta Biosynthetic transvaginal mesh to treat you. Unfortunately, recent FDA research has revealed that these types of surgical mesh may do more harm than good. More than 1,000 patients have reported mesh complications and other problems, the results of which has included such debilitating side effects as infection, pain, vaginal scarring, and urinary and bladder problems.

In addition to these physical side effects, a number of women have also been impacted emotionally and psychologically. For all of these reasons, many of the women suffering from transvaginal mesh-related problems will never be the same as they were before their pelvic organ prolapse (POP). In short, this is a situation where the medicine may do more harm than the ailment.

Fears Nachawati has extensive experience dealing with the kind of pain and suffering – both physical and emotional – that you, your husband, and your family are going through. Let us help you. To discuss your legal options in a free and confidential consultation, call us at 1.866.545.8364 or email mn@fnlawfirm.com. We’re ready to fight for you.

Do You Know the Full Range of Actos Side Effect?

Actos (Pioglitazone) is commonly used to fight Type II diabetes. Doctors and the pharmaceutical industry have communicated some of the drug’s side effects, but do you know their full range? As discussed on this blog in prior posts, Actos has been found to cause bladder cancer, particularly for patients who take Actos for a prolonged period of time. However, Actos is also reportedly a cause of serious health problems such as congestive heart failure, vision problems, bone fracture, and liver disease as well as lesser side effects like swelling of the hands, sore throat, muscle pain, weight gain, breathing trouble, tooth problems, and lethargy.

Fears Nachawati expert attorneys know what it takes to defend your interests and protect your rights, whether at the negotiating table or in a court of law. Have you experienced Actos-related side effects? You should act immediately. Contact us for a free consultation. Just call 1.866.545.8364 or email mn@fnlawfirm.com.

Federal Health Experts Take Aim at Transvaginal Mesh Complications

A surgical mesh used to treat pelvic organ prolapse (POP) is at the center of a developing storm that includes thousands of injured women, doctors, health experts, and the Food and Drug Administration. According to a recently released FDA report, the FDA is considering reclassifying transvaginal mesh products as Class III devices.

What are the implications of this potential reclassification? For the pharmaceutical companies that design, produce, and sell transvaginal mesh devices, it means delay, at least. For victims of transvaginal mesh complications, it’s further confirmation that the large numbers of pelvic mesh problems isn’t simply bad luck, but an unsafe product.

So, what exactly is going wrong with the transvaginal mesh? For thousands of women, the transvaginal mesh has eroded into their vagina, causing pain, bleeding, organ perforation, and recurrence of POP.

Has a doctor prescribed you a transvaginal mesh (also known as a bladder sling or vaginal surgical mesh)? Has it caused discomfort, pain, or hospitalization? If so, you should contact the health device attorneys at Fears Nachawati. We protect victims from the physical and emotional effects of dangerous health products like transvaginal mesh. For your free consultation, call us at 1.866.545.8364 or email mn@fnlawfirm.com

Does Your Physician Still Prescribe Actos for Your Diabetes?

For months, the FDA has warned that Actos (Pioglitazone), a drug designed to combat diabetes, may do more harm than good. Now registered in the thiazolidinedione (TZD) class, health experts now acknowledge that Actos has serious side effects.

Doctors have options besides Actos. Many clinicians are electing to use incretin therapy instead of Actos (Pioglitazone) when metformin no longer works with type 2 diabetes patients. Of course, this raises an important question: is your doctor considering the significant adverse health effects of Actos before continuing your prescription?

Do you have blood or red color in your urine? Do you an urgent need to urinate? Does it hurt to urinate? Have you noticed increased pain or discomfort in your back or lower stomach? These kinds of discomfort are associated with bladder cancer. If you’ve been experiencing these outcomes, it may be past time to abandon Actos.

Need to speak to an attorney who has expertise in dangerous drugs? The experienced, highly qualified lawyers at Fears Nachawati are prepared to give you the attention you deserve. For your free consultation, call us at 1.866.545.8364 or email mn@fnlawfirm.com. We’re ready to help you.

Car Accident Ends in Death for Houston Woman

In the kind of tragedy that happens all too frequently on Texas highways, an out-of-control driver crossed over the median this weekend and slammed into an oncoming car. What caused the reckless driver’s dangerous – and ultimately lethal – drift into head-on traffic isn’t clear. What is clear, however, is that all the safety protections of the victim’s car and all the medical advances associated with a major metropolitan area like Houston weren’t enough to save Rosemary Rogers Olsen, the victim who died at the Memorial Hermann Hospital.

Lethal automobile accidents happen almost everyday in Texas. In all too many instances, these accidents kill and injure without warning and as a result of dangerous decisions – like texting-while-driving and driving drunk – by negligent drivers. Frequently, punitive and exemplary damages are appropriate in accidents where deliberate recklessness contributes to the victim’s injury or death.

Fears | Nachawati attorneys know what it takes to secure the compensation your family deserves in the wake of a lethal automobile accident. You have rights worth protecting! Let us help you fight for them. For a free consultation, call us at 1.866.545.8364 or send an email to mn@fnlawfirm.com. We’re ready to fight for you!

West Texas Man Dies in Rodeo Accident

A rodeo worker in Wheeler, a Texas panhandle town northeast of Amarillo, died this week after horses stampeded over him. The worker, just 24 year-old, was moving horses to the bucking shoot when the animals became spooked, turned abruptly, knocked down the worker, causing severe injuries.

Were the rodeo facilities safe? Was the worker properly trained and supervised? Had the horses been inspected and vaccinated in compliance with Texas law? These are the kind of questions an injured worker ought to ask. They’re the kind of questions the personal injury experts at Fears | Nachawati ask every day.

Don’t let the law or your employer intimate you! If you’ve been in a work-related accident, there are questions you should ask to find out if your employer shares any responsibility for the injuries you’ve sustained. Want to know more? Give us a call at 1.866.705.7584 or send an email to info@fnlawfirm.com. We’re ready to help you!

Sleeping and Driving: A Lethal Combination

Two children are in a Port Aransas, Texas, hospital today, clinging to their lives the driver of an SUV fell asleep at the wheel. These children are the lucky ones, unfortunately. The accident took the lives of two others.

In all, eight children and two adults were injured this past weekend when the driver fell asleep behind the wheel, veering off the roadway and striking a concrete culvert that caused the car to flip. Because several of the passengers weren’t wearing seatbelts, the passengers were thrown around inside the car – and at least one child was thrown out.

Sleeping and driving is just as dangerous – and, in fact, probably more dangerous – as texting and driving or drinking and driving. Unfortunately, the knowledge of that danger doesn’t prevent Texans from driving tired every day.

Have you been in a wreck caused by a tired, sleepy, or sleeping driver? If so, you need the help of the accident and injury experts at Fears | Nachawati. Lubbock Student Dies in Drunk Driving Accident

A Lubbock High graduate who was preparing to enter Texas Tech University after her year-long training with the Army Reserves died earlier this week when the car in which she was riding broke through a guardrail and tumbled down an overpass. The driver, a Texas Tech medical student, and another passenger were seriously injured in the accident. Both passengers weren’t wearing their seatbelts; based on evidence of alcohol found in the car, investigators suspect that the driver may have been drinking.

Drunk driving accidents are unfortunately common in Texas. They often cause severe injury or death due to erratic driving and excessive speeds. Both recklessness and high speeds appear to be involved in the Lubbock accident.

Fears | Nachawati protects drunk driving victims and their families. If you or a loved one have been injured, talking to our personal injury experts could give you the peace of mind and financial security that you need. West Texas Town Passes New Dog Ordinance

This week the Midland, Texas City Council adopted a new ordinance that requires the owners of “dangerous dogs” to purchase $1 million in liability insurance.  The new ordinance is a four-fold increase from the $250,000 policy requirement of recent years. The City’s Animal Services director is responsible for identifying dangerous dogs and does so after an investigation. Of note, the measure passed unanimously.

Dog ordinances are becoming more common for one simple reason: dog bites are more frequent, too. Dog bites – which most often injure children – can change lives forever! If you or a loved one has been hurt by a dangerous dog, give the injury experts at Fears | Nachawati a call. We can provide you with the help you need. Texas Ponzi Scheme Unravels in Beaumont Courthouse

The steadily unraveling, sordid $2.3 million Ponzi scheme perpetrated by a Kansas lawyer has finally reached its inevitable end. In 2007, Clifford R. Roth began pumping a fraudulent investment opportunity supposedly based in Beaumont, Texas. The too-good-to-be-true deal involved early investors receiving funds they thought were dividends but were in fact equity infusions from new investors. Their excitement fueled the money till until earlier this year when the truth finally caught up to Roth and his many victims.

Mr. Roth, who pled guilty on March 14 to interstate transportation of money taken by fraud, was sentenced yesterday in a Beaumont federal court. He’ll arrive in federal prison later this month to begin serving his criminal sentence. In addition to criminal consequences, Mr. Roth is also civilly liable for his financial misdealing.

Elderly Driver Dies in Woodlands Accident

A 71-year-old woman passed away earlier this week after her vehicle, a Volkswagen Beetle, collided head on with a Ford Expedition. It is unclear what the caused the accident, although some speculate that the woman’s age may have contributed to her veering into the lane of oncoming traffic. The woman died at the scene; the driver of the SUV survived with merely a dislocated shoulder.

Accidents like the one in the Woodlands, Texas, this week are tragic. They call into question whether elderly men and women are acting responsibly when they get out on the highway. Given the disparity between the size of the SUV and that of a compact car, they also raise important questions about what kind of liability large-car owners should have.

Fears | Nachawati deals with dozens of automobile accident cases every year. We’re prepared to defend your rights and prosecute the person whose reckless driving caused your accident. Call 1.866.705.7584 or email info@fnlawfirm.com today!

Houston Driver Dies in Tragic Accident

Over the weekend, a Houston driver died when his SUV slid onto a grassy median and then into a tree. Accident investigators attributed the accident to high speeds. Unfortunately, the driver perished at the scene of the collision.

The Texas personal injury lawyers of Fears | Nachawati understands that car accidents are more complicated than they often appear. A combination of factors, including speeding, cell phone use, child distractions, and alcohol, typically contribute to most Texas auto accidents. If you’ve been in a car accident, you need a Texas lawyer who understands how these factors influence responsibility and damages. Hill Country Farms Settles With Workers Over Workplace Violations

Hill Country Farms, a Texas company headquartered in Goldthwaite, Texas, settled their case with several mentally handicapped workers earlier this week. The workers, who were employed in an Iowa City, Iowa, turkey plant, were subjected to below minimum wage and uncompensated overtime, among other violations. All told, the federal judge who presided over the case ordered Hill Country Farms to pay $1.76 million.

Unfortunately, workplace violations are common, particularly during hard economic times. Fears | Nachawati specializes in workplace injuries and work-related contract damages. Six Boy Scouts Injured in Heart Attack-Related Accident

Somewhere on Interstate 10 outside of Kerrville, Texas, a Boy Scout troop leader had a fatal heart attack while driving six Boy Scouts home from summer camp. The heart attack caused the driver to lose control of his SUV and veer off the road. Although all six boys were sent to the hospital, fortunately, all escaped serious injury. One passenger, however, did sustain a broken wrist and required longer care in a nearby hospital.

What kind of liability do Boy Scout leaders, soccer coaches, and Y-Guides parents have when they take responsibility for your children? If your children are in an accident while their under another parent’s care, who is responsible for the hospital bills? These are simple but important questions. Natural Gas Industry Booming--But in the Northeast?

Times are good for natural gas producers. Although high fuel costs hurt consumers, they’re good for suppliers. Traditionally, high natural gas prices have been particularly good news for Gulf Coast states like Texas and Louisiana and particularly bad news for the northeast. This time, however, things are a little different.

The recent discovery of the Marcellus Shale in Pennsylvania and West Virginia is good news for the east coast. The Marcellus Shale is rich in ethylene, a key ingredient in plastics, and close to markets like New York, Philadelphia, and Washington, D.C. Because of its proximity to plastics manufacturers, costs to consumer will be cheaper. Also, West Virginia, Pennsylvania and other “Shale states” will benefit from the additional tax revenue flowing from natural gas extraction. Local economies will boom, too, thanks to the estimated 10,000 new, “Shale jobs.”

There’s just one catch: natural gas production can be dangerous. Every year hundreds of workers and thousands of residents are injured as a result of natural gas leaks and explosions. If you or a loved one leave Texas to work the Marcellus Shale, you should know about the risks of natural gas – and, in particular, ethylene – cracking. Talk to the experts at Fears | Nachawati to learn everything you need to know about the law governing occupational injuries. Call 1.866.705.7584 or email info@fnlawfirm.com

San Antonio Stabbing Victim Pursues Criminal and Civil Actions

In the early morning hours last Saturday a resident of a South Side apartment building in San Antonio, Texas, was stabbed repeatedly in the torso. The bad news is that the unidentified victim in his 40s faces potentially life-threatening injuries. The good news is that he was taken to University Hospital and is now under careful medical observation.

Stabbings happen all to often in Texas, as many residents know. What many crime victims don’t know, however, is that violent crime, such as a stabbing or shooting, give rise not only to a criminal cause of action pursued by law enforcement, but also a civil cause of action that victims may pursue to recovery monetarily. In some cases, civil damage awards can exceed a million dollars!

If you or a loved one have been injured as a result of a violent act, you need to speak not only to local police, but also to personal injury experts at Fears | Nachawati. Our experience and expertise can provide you and your loved ones with the justice you want! For a free consultation, call 1.866.705.7584 or email info@fnlawfirm.com

Did Abortion Clinic Inflict Emotional Distress on Patients?

The Texas Commission on Environmental Quality (TCEQ) concluded recently that Whole Women’s Health of Austin, a health clinic in North Austin, improperly disposed of aborted fetuses. Whole Women’s Health of Austin sent fetuses along with other medical waste for steam disinfection and then on to a landfill. Under Texas state law, steam disinfection is an approved treatment method if followed by internment. State law prohibits the disposal of human body parts, fetuses or products of abortion from being disposed in a landfill.

Whole Women’s Health of Austin faces stiff penalties from the TCEQ. Experts are asking, however, whether the patients have a cause of action against the clinic. For many, knowing that their aborted child is in a landfill somewhere in the Texas hill country is an understandably disturbing thought. Should Whole Women’s Health of Austin be held accountable for that distress?

Has a health provider, doctor, or health clinic injured you? What kind of injuries “count” under the law and what should you do? Take your first step today by contacting Fears | Nachawati. Call 1.866.705.7584 or send an email to info@fnlawfirm.com. We can help!

Current trends suggest that 75 percent of Texas adults will be obese by 2040. The obesity trends are particularly severe for minorities, with 75 percent of African-Americans and 71 percent of Hispanics overweight or obese.

What’s the reason for our growth? According to a new study in the New England Journal of Medicine, more than anything else, it’s the potato chip. Studying the diet and lifestyle of more than 120,000 people for two decades, researchers found that on average participants gained 17 pounds during the twenty year period. They found that each one ounce serving (roughly 15 chips, 160 calories) led to 1.69-pound increase. Compared to a serving of sweets (0.41 pounds), an alcoholic drink (0.41 pounds) or watching one-hour of TV (0.31-pound increase), the potato chip was far-and-away the biggest contributor to our nation’s growing average belt size.

Of course, you probably knew that potato chips were bad for you, but did you know that they were this dangerous? Some experts have speculated that potato chip companies ought to be held more accountable for the health risks their product imposes. Cigarette companies have had to warn about the dangers of their product for years. They’ve had to educate the public, too. By comparison, potato chip companies have gotten off scot-free – and all the while our society has been gaining almost a pound per year!

Texas Living Through Worst Wildfire Season in Years

In 2011, Texas has experienced the most intense and costly season of wildfires in memory. Out-of-control blazes have destroyed more than 5,000 square miles of land from the semi-desert of west Texas to the east Texas piney woods. It’s no surprise: the National Interagency Fire Center reports that 71 percent of Texas is in exceptional drought, the most severe category, and 21 percent of Texas is in extreme drought.

The summer fires this year are unique not only because of their size and severity, but also where they are starting. Homes in the Austin suburbs, lakefront property near Fort Worth, communities across the Gulf Coast, and the McDonald Observatory, a leading astronomical research facility, in far west Texas, are just some of the usually safe areas that have been threatened by this year’s extreme conditions.

With parts of Texas new to the threat of wildfires – and to the necessity of negotiating with tight-fisted insurance companies – many Texas policyholders need the help of experts to secure the compensation they deserve. If you or a loved one is a victim of Texas wildfires, contact the insurance experts at Fears | Nachawati. For a free consultation, call us at 1.866.705.7584 or send an email to info@fnlawfirm.com

Traffic Stops Put Officers at Risk

According to the Bureau of Labor Statistics, more than 900,000 Americans are dedicated to a noble calling: fighting crime. Tragically, the Police Officers Safety Association reports that about 150 police officers die in the line of duty every year. To the surprise of many, the vast majority of these deaths isn’t caused by gunfire, but traffic stops. In fact, since 2001, 154 officers have lost their lives during otherwise routine traffic stops. In Texas alone, 22 officers have died during traffic stops since January of 2010.

Does your loved one serve in a local police department? If so, he or she needs to be aware of the risks they face in the line of duty, including the very real threat they incur during traffic stops. If they’ve been injured, they should call the personal injury experts at Fears | Nachawati. Years of experience and committed expertise have taught us how to best defend their legal interests. El Paso's Elephant Butte Lake Home to More Than 80,000 Campers

Within a two-hour drive from El Paso, Texas, is Elephant Butte Lake, the preferred destination for 80,000 Memorial Day campers. Over the course of the summer, Elephant Butte Lake will host hundreds of thousands of visitors. However, for Texans attending Elephant Butte Lake or one of the many lakes across Texas, it’s important to remember the risks of camping and state parks. Gusty winds can cause fires; lakes are frequently home to water moccasins, water-borne diseases, and the risk of drowning. And, of course, boating presents a multitude of dangers, including boating-while-under-the-influence.

If your summer turns out to be a lot less fun than you imagined because someone injured you or your loved ones during a camping trip, it’s important to call the personal injury experts at Fears | Nachawati. Memorial Day Marks Beginning of Drowning Risk for Kids

This summer, tens of thousands of Texas kids will go swimming. Tragically, more than a hundred may drown before Labor Day. According to the Texas Department of Family and Protective Services, accidental drowning is a leading cause of death for children 5 years old and younger. In fact, in 2011 twenty-seven Texas children died before the summer season even began!

Fears | Nachawati understands the injury risks that your children face and is prepared to help you determine who may be responsible in the event that a member of your family is injured. For a free consultation, call us at 1.866.705.7584 or send an email to info@fnlawfirm.com

Drunk Driving Victim Slated to Receive New Nose

More than a decade has passed since Jacqui Saburido was involved in a drunk driving accident that left her entirely body severely burned. Ironically, the accident that took the Austin native’s face has led her to become the face of an anti-drunk driving campaign across Texas. To date, Ms. Saburido has undergone 120 surgeries and is slated to have one of her most important – a nose reconstruction surgery – this summer in Brazil.

Drunk driving changed Ms. Saburido’s life forever. If you’ve been in a drunk driving accident, it’s likely to change your life, too. GLBT Community Increasingly Fights Harassment in Schools

Members of the GLBT – gays, lesbians, bisexual and transgender – community are putting pressure on the Texas legislature to pass an anti-bullying statute that would make it easier for schools to punish students who harass fellow students on the basis of their sexual orientation. For many, changing the law is an effort to protect teenagers who might otherwise commit suicide in response to being bullied about their sexuality.

Has your child been bullied in school? Has he or she been harassed as a result of his or her sexual orientation? If so, they might have a viable cause of action rooted in anti-bullying legislation designed to protect them against precisely the kind of mistreatment they are currently experiencing. Little League Umpire Jailed for Sexual Assault of A Child

Donald Leeroy Ballard, a Little League umpire near Houston, Texas, lured a 16-year-old child into his residence with the promise of food and video games. Once inside the home, Ballard sexually assaulted the child. Given Mr. Ballard’s relatively high interaction with teenage boys throughout Liberty County, the Liberty County Sheriff’s Office was concerned that Ballard might have sexually assaulted other children as well.

Ballard will be subject to criminal charges, however, he also will likely face tort allegations, too. Victims deserve their day in court and they need legal advisors capable of defending their rights. If you or a loved one has been the victim of a crime such as battery, theft, or sexual assault, contact the legal advisors at Fears | Nachawati. Does Change in Texas Law Change Liability Standards?

For many Texans, the answer to a victim with an airway obstruction – most commonly, a fellow diner who chokes on food – is the Heimlich maneuver. In fact, for the last 22 years Texas law has required that restaurants display a poster advising customers and workers how to proper perform the life-saving procedure. However, Texas law is expected to soon change. In keeping with new American Red Cross standards, the new preferred technique is to slap a choking victim on the back repeatedly, up to five times.

Some restaurant owners and would-be good Samaritans are asking: should I still follow the decades-long advice of using the Heimlich maneuver? If the old poster remains hanging in the restaurant, should I adhere to posted instruction? Will I be held legally responsible for any harm stemming from the use of the older, “wrong” technique?

These are all good questions. If you want to know their answer, contact the personal injury law experts at Fears | Nachawati. As the law changes, we can provide you with the advice and direction you need. Call us at 1.866.705.7584 or send an email to info@fnlawfirm.com. Let us help you!

Houston Area Adult Charged with Sexual Assault of a Child

Sexual assault is always painful, tragic and unfortunate. However, it’s particularly difficult when the victim is a child and the perpetrator is a trusted adult in the community. This week, residents of Katy, Texas, are grappling with the reality that Robert Paul Gentry, 28, had sex with a 15-year-old who was in his care at a residential treatment facility. The facility is designed to care for teens with emotional disorders.

If your child is verbally, physically, emotionally or sexually victimized by an adult, you need to take action. The perpetrator who injures your child should not simply face criminal charges, but civil allegations, too. Find out how to protect your family and seek justice within the justice system by contacting the personal injury experts at Fears | Nachawati. Lubbock County Man Dies After Vehicle Rollover

A 21-year-old man, Colby Galland, died last weekend in Wolfforth, Texas, on FM 179 after his 2004 Ford pickup truck rolled. Preliminary investigation by the Texas Department of Public Safety confirms that Mr. Galland was not wearing a seat belt. Investigators have yet to conclude whether alcohol or excessive speed might have contributed to the deadly roll.

Trucks like Mr. Gallands are twice as likely to roll than passenger cars. Moreover, nearly half of all highway fatalities are the result of rollovers. For truck drivers, the risks are real and the consequences can be deadly. If you or a loved one have been involved in a rollover, contact the personal injury experts at Fears | Nachawati. Texas Investors Defrauded by Get-Rich-Quick Insurance Scheme

Retirement Value, a New Braunfels-based insurance company, is the latest fly-by-night financial firm to defraud hundreds of Texas investors. Offering a financial product known as a “life settlement”, Retirement Value claimed to connect financially distressed, elderly life insurance policyholders with investors looking for a high-return vehicle. In theory, the elderly policyholder would assign the value of the insurance policy to the investor in exchange for the investor assuming the premium obligations. In practice, however, Retirement Value absconded with investor funds, overstated the likely returns and saddled investors with millions in premium payments.

Have you been injured by Retirement Value or the dozens of other Texas insurance firms peddling unregulated financial products like life settlements? If so, contact the injury experts at Fears | Nachawati. We can help you recover what you’ve lost through fraud and abuse. Call us at 1.866.705.7584 or send an email to info@fnlawfirm.com

Texas Lawmakers Stand Up for Student Athletes

As a result of changes to University Interscholastic League (UIL) policy, high schools will be prohibited from letting student athletes practice or complete on the same day that they sustain a concussion. This change in policy was approved by the UIL’s legislative council in October of last year and received final approval from Texas Commissioner of Education Robert Scott late last month. The guidelines will go into effect August 1, 2011.

What does this mean for you? Texas law now gives greater protection to your children when they compete in school sports. If you suspect that their coach is disregarding state law by playing them after their head injury, you have the power to fight back. If you need help communicating with your child’s coach or school administrators, talk to the personal injury professionals at Fears | Nachawati. Austin Man Killed in Occupational Hazard

An Austin repairman was killed while working on a pistachio auger earlier this month. Tragically, while the 30-year-old was making repairs, someone in the pistachio plant turned on the equipment used to shred pistachios seeds from their shell and grind pistachios. Unable to escape from the underground apparatus, the repairman was killed.

Occupational fatalities are all-too-common and always unfortunate. Thankfully, Texas lawmakers have created a legal mechanism – a wrongful death lawsuit – that allows survivors to find justice for themselves and their loved one. If you’ve lost a loved one in an occupational accident, talk to the personal injury experts at Fears | Nachawati. Call at 1.866.705.7584 or send an email to info@fnlawfirm.com. Let us help you!

Houston Motorcyclist Killed by Drunk Driver

Last weekend a motorcyclist, Carlton Neal Bare, died suddenly and tragically when a drunk driver failed to yield, turning directly into Mr. Bare. The drunk driver, Carlos Loris Lengua, blew a breathalyzer over the legal limit when police officers arrived at the scene of the accident.

Drunk driving kills nearly 15,000 Americans every year. In fact, at more than 1,500 drivers every year Texas is the leading state in drunk driving fatalities. Thousands more are injured – sometimes altering the rest of their lives – because of drink driving.

Central Texan Gets 75 Years in Prison on Criminal Charges

A jury in Georgetown, Texas, sentenced Kenneth Wade Davis to 75 years in prison for aggravated assault, aggravated assault on a public servant and burglary. Davis’s sentence stems from an April, 2010 altercation in which he broke into Bobbie Rigsby’s home and, when she unexpectedly returned, shot her, puncturing her lung. Later that night, Davis also shot a Round Rock police officer, Jack Johnson. Fortunately, both have recovered.

Criminal court isn’t the end of the line for Mr. Davis. The burglar-turned gunman-turned convict also faces civil charges for the medical and emotional damage he caused. Tort law is an important field and nobody knows it better than the experienced, expert attorneys at Fears | Nachawati. If you’ve been injured by a criminal act, you may also have a civil claim. Is Texas's Foster Care System Unconstitutional?

According to a class action lawsuit filed in state court, Texas’s foster care system is unconstitutional and requires reform. The suit, filed in Corpus Christi, alleges that the rights of children are being impaired, sometimes significantly, as they endure poor treatment, including risk of abuse, poor health care and separation from loved ones such as brothers and sisters. Of Texas’s 12,000 foster children, those who have been in the state’s custody for more than three years have lived in an average of 11 different homes.

Class action lawsuits are an important and effective way for impaired groups to defray the costs of litigation while nevertheless securing the full benefits of America’s justice system. If you’re suffering from a bad product, sub-standard service or other widely shared malady, a class action lawsuit may be what you need. Flash Fire Kills One, Injures Three at Port Arthur Chemical Plant

A flash fire at the KMTEX Chemical Plant last week took the life of Johnny Williams, 58, as well as injuring three others. The fire began when pipeline workers welding a pipe made contact with an extremely flammable solvent, coal tar naphtha. Coal tar naphtha is a byproduct of refined crude oil and can be ignited by heat, sparks and open flames. The explosion was so powerful that witnesses a mile away reported feeling the shock.

Butane and Hydrofluoric Acid Leak at Texas City Refinery Scares Public

Earlier this week a butane and hydrofluoric acid leak at Marathon Oil’s Texas City refinery prompted a shelter-in-place order. A shelter-in-place order is a common emergency procedure used to minimize the risks of outside, dispersing contaminants. Marathon and other refineries contend these orders are essential in protecting the public.

However, some question the effectiveness of shelter-in-place orders. In a situation like Marathon’s butane and hydrofluoric acid leak experts worry that residents will not follow the order; alternatively, if the public does follow the order, they won’t be adequately protected in the event of a worst-case scenario. Residents and observers also question Marathon’s public relations approach to shelter-in-place orders. When confronted with questions by news outlets and citizens about the order, Marathon provided a brisk, non-informative statement: “The source of the release has been located, and crews are working on isolating it. There has been no off-site impact.” For residents worried about their health and the safety of their children, Marathon’s approach isn’t helpful.

Are you worried about shelter-in-place orders and refineries which impose risks on the public without appropriately consulting or informing local residents? If so, direct your questions and concerns to the personal injury experts at Fears | Nachawati. Premises and community liability are important legal issues. Beauty Queen Returns to Throne

Late last week a Texas jury restored Miss San Antonio, Domonique Ramirez, to her rightful place among beauty royalty when they ruled that pageant officials had unfairly stripped the possible Miss Texas contender of her crown. Even after the trial, speculations remained as to the real motivation behind Ramirez’s dismissal. Some believe that pageant officials removed the teenage star for gaining excessive weight and refusing to “get off the tacos.” Others remain convinced that Ms. Ramirez was unduly difficult, chronically late and frequently rude.

Financially, the Miss San Antonio, Miss Texas, and Miss America awards can mean college scholarships and product endorsements, among other benefits. As a result, the courtroom battle between Miss Ramirez and Miss San Antonio officials addressed significant tort and contract law disputes.

Have you been unfairly terminated from your job? If so, you may have valid tort and contract law claims. Guest Dies at Houston Livestock Show and Rodeo

A 46-year-old man died on the last day of this year’s Houston Livestock Show and Rodeo when he fell from a roller coaster, the HiMiler. Despite the on-the-scene efforts of emergency medical personnel, the man died in a Houston-area hospital soon after the accident. At its highest point, the HiMiler is 53 feet high, although last weekend’s victim’s fatal was reportedly only about 28 feet.

Roller coasters are a hallmark of spring and summer fun in Texas. Unfortunately, too often men, women and children are injured by poorly designed and improperly maintained facilities. In the wake of the tragic accident, the safety measures in place at the time of the accident on the HiMiler have come under severe scrutiny.

If you’re injured on a roller coaster at a carnival, rodeo or amusement park, you should immediately contact the personal injury experts at Fears | Nachawati. Man Arrested for Boating While Intoxicated

As spring and summer approach, Texans across the state will take to local lakes just like 60-year-old Joel Manjarris. Hopefully, they’ll make better decisions than the Austin-area man who allegedly got drunk on wine and Jim Beam.

Boating while intoxicated is a serious offense. Just the first offense can result in up to 180 days in jail. Multiple convictions of BWI can result in up to ten years in prison and fines stretching into the tens of thousands of dollars. Moreover, BWIs result in death. Hundreds die every year in alcohol-related boating accidents and thousands more are injured, sometimes seriously.

If you are the victim of a BWI accident this summer, contact the personal injury experts at Fears | Nachawati. With years of experience and professional expertise, we prepared to help you. Just call 1.866.705.7584 or send an email to info@fnlawfirm.com

Texas Lawmakers Take Dead Aim at Texting-While-Driving

Texas legislators currently meeting in Austin are considering several variations on the same theme: Texas law should forbid texting while driving. In fact, the only real debate it seems is whether the definition of “texting” should include reading emails on a cell phone. Senate Bill 119 and House Bill 103, for instance, prohibit reading, writing or sending text messages while driving; the more expansive Senate Bill 46 and House Bill 243 target phone-based text communication and specifically include emails.

Have you been in an accident with a distracted driver? If so, the liability they face may be greater than they would otherwise. Conroe, Texas Battleground for Toxic Water Fight

After a pitched, five year battle, TexCom Gulf Disposal LLC still hopes to open an injection well near a Conroe residential community. According to the plan, the well would bury nonhazardous, liquid commercial waste thousands of feet below the surface.

However, some members of the community worry that the waste could include benezine and other hazardous chemicals. Moreover, given Conroe’s history of oil exploration – and seams left in the ground from improperly plugged 1930s era drilling – the possibility exists in the minds of some EPA officials that injected waste could seep into the municipal water supply through these underground seams.

Regardless of local and EPA concerns, the Texas Commission on Environmental Quality (TCEQ) approved the permit for TexCom’s injection well. This approval came in spite of problems with similar waste disposal wells in Winona, Texas, in 1997 and Chico, Texas, in 2005. The next stop for this expensive and potentially injurious conflict are the courts.

Home Day-Care Center Responsible for Negligent Homicide?

Last week, a kitchen fire at Jackie’s Child Care, a home day-care center, became dangerous and deadly, killing three children and injuring four. At least two of the injured children remain in critical condition, fighting for their lives.

The Texas Department of Family and Protective Services has just initiated it investigation, but already information has emerged that Jackie’s Child Care was in violation of state law. Despite regulations limiting no more than six children under pre-school age in registered child-care homes, Jackie’s Child Care hosted seven children at the time of the fire. The oldest children at the center were just three years old.

The negligence demonstrated by Jackie’s Child Care is unconscionable. Tragically, however, it’s just the tip of the iceberg. Child-care homes across the state of Texas regularly violate Texas Department of Family and Protective Services regulations every day. If you’re children attend a child-care facility, you need to ask questions about their quality of care. Don’t know which questions to ask? Let the legal experts at Fears | Nachawati advise you. Fort Worth Teacher Attacks Elderly Couple

A Fort Worth teacher, Brenda Jones Stafford now faces a felony charge of injury to the elderly after she allegedly choked and pushed a 71-year-old woman and, when her 73-year-old husband attempted to intervene, shoved, hit and choked him, too.

Texas law recognizes the elderly as a special class of citizen and specifically provides special protections for Texans over the age of 60. See Tex. Hum. Res. Code Ann. § 102.003. Notably, elderly individuals have the right to be treated with dignity and respect for the personal integrity of the individual. Id. at § 102.003(b).

Oil Field Worker Dies in Accident, Raising Questions about Workplace Safety

Last week, a pair of oil field workers in Midland County, Texas were working on a rig when pipe fell, pinning Mariano Pruenda’s leg. As his co-worker, Ronnie Lynn May, worked to rescue him, another piece of the rig fell, crushing and killing May.

The Occupational Safety and Health Administration (OSHA) has launched an investigation into the accident and into the safety practices of May’s employer, Tulsa-based oil contractor, Helmrich and Payne.

Working in the oil fields is dangerous. However, oil rigs become inappropriately and unnecessarily dangerous when employers fail to adhere to worker safety regulations. If you or a loved one work in the oil field and think that the workplace is unsafe, it may be time to call the professionals at Fears | Nachawati. We can investigate your employer’s safety practices and, if necessary, defend your right to safe workplace! For a free consultation, call us at 1.866.705.7584 or send an email to info@fnlawfirm.com

Mentally Ill Patient Dies at the Hands of So-Called Caregivers

Late last year a mentally ill teenager, Michael Keith Owens, died at the hands of Daystar, the residential treatment center where he was placed by the Texas Department of Family and Protective Services (TDFPS). TDFPS paid $650 per day for Owens’ care, however, that sum only purchased Owens a space in a double-wide trailer shared with six other teens and two adult staffers. Moreover, Owens’ death represents the fourth death of a patient at Daystar and one of only 250 confirmed incidents of abuse.

The mentally ill are incapable of protecting themselves and too often their caregivers fail to provide them with anything like the fiduciary care they deserve. If you or a loved one has been in a hospital or mental institution recently, it’s worth asking whether you received the care you deserved. If not, it may be time to bring those ‘caregivers’ to task. Entities like Daystar should not be permitted to harm the defenseless!

Texas Child Faces Recovery from Burns

Zachary Pope, 6, is recovering steadily in a Lubbock, Texas hospital after sustaining serious burns to his face and upper body. Although his mother and brother were able to escape the house fire with only minor burns, Zachary suffered considerable injury before finally reaching safety. Over the last two weeks, he’s undergone skin grafts on his arms, thighs, chest and face.

Fires cause burn injuries to thousands of Texans every year. Tragically, in many cases these fires are preventable and would not occur but for the negligence of landlords. If you’re apartment has caught fire recently, you may have a cause of action against the owner of the facility for unsafe premises. To find out more about what your next steps should be, contact the personal injury professionals at Fears | Nachawati. Give us a call at 1.866.705.7584 or send an email to info@fnlawfirm.com. Texas Legislature Poised to Liberalize Handgun Laws

The Texas legislature is on the verge of passing legislation that would permit college students and professors to carry concealed handguns on campus. Texas’ 38 colleges and 500,000 students could soon be armed. Whether campuses will be more or less dangerous is the subject of considerable controversy.

Some say that shooting catastrophes like those at Virginia Tech and Northern Illinois will be less likely as a result. State Senator Jeff Wentworth (R-San Antonio) explained, “It’s strictly a matter of self-defense.” Others argue that more handguns could lead to greater violence, not less. Confronting a similar proposal in his state, Oklahoma Chancellor of Higher Education Glen Johnson recently countered, saying, “There is no scenario where allowing concealed weapons on college campuses will do anything other than create a more dangerous environment for students, faculty, staff and visitors.”

Shootings are always tragic and usually the subject of criminal investigation. However, they are also frequently the subject of civil disputes as well. If you or a loved one has been involved in a shooting, you need a legal advisor who can address the complex legal issues related to gun activity. Texas Hospital Denies Care to Suffering Illegal Immigrant

John Sealy Hospital in Galveston, Texas, seems to understand the Hypocratic Oath to mean, “First, do no harm, provided that the patient is a U.S. citizen.”

According to patient Maria Sanchez, her stay at John Sealy Hospital was terminated when her doctor told her to return to Mexico to have surgery on her growing spinal tumor. The hospital discharged her later that day, despite the fact that delaying her medical care would have probably permitted her medical condition to further deteriorate.

Just as health care is important for patients, medical liability is an important area of the law. If you’ve recently been released from a hospital and felt that the quality of your care was poor, you should contact the health law experts at Fears | Nachawati. We can help you find justice. Should Texas Legislators Pass Mandatory Dog Insurance?

Texas motorists are required to carry automobile insurance. Should the Texas legislature require dog owners to carry insurance against their pets, too?

Rep. Ruth Jones McClendon (D.-San Antonio) thinks so. In fact, McClendon has introduced a bill that would require any Texan who owns a male dog which weighs 20 pounds or more and is not neutered to have an insurance policy covering injuries or damage caused by that dog when it is off the leash or out of the dog’s yard.

Dog bites are more common than most Americans realize. Americans own 74.8 million dogs according to the American Pet Products Manufacturers Association (APPMA) and a study by the Center for Disease Control and Prevention (CDC) determined that roughly 2 percent of Americans, 4.7 million people, are bit annually. In fact, roughly 800,000 require medical attention and 368,000 send victims to the emergency room.

Perhaps most importantly, serious dog bites are on the rise. The Department of Health and Human Services reports that in the last 16 years the number of dog bites resulting in hospitalization have increased 86 percent, from 5,100 in 1993, to 9,500 in 2008. The average cost of treatment was more than $18,000 per patient and the majority of patients were under 5 or over 65. In fact, U.S. dog attack victims suffer more than $1 billion in monetary losses every year!

Family Files Wrongful Death Suit Against Beaumont, Texas Doctor

Close may count in horseshoes and hand grenades, but it certainly doesn’t count in medical diagnoses. Dr. Ede, the attending physician to the late Judy Gregory, is learning this lesson the hard way.

Despite abnormal EKG readings, Dr. Ede discharged Ms. Gregory from the hospital after a mere cursory diagnosis of arthritis and acute bronchitis, among other minor injuries. Tragically, within nine hours Ms. Gregory died of a fatal dissecting thoracic aneurysm. According to Ms. Gregory’s wrongful death lawsuit, Dr. Ede negligently failed to admit Ms. Gregory for continuous cardiac monitoring and proper diagnosis.

By definition, wrongful death lawsuits are the product of tragedy and loss. Fortunately, however, lawyers have the ability of fighting the injustices perpetrated against a decedent, just like Ms. Gregory. If your loved one suffered an untimely and unnecessary demise you should speak with the wrongful death lawyers at Fears | Nachawati. We can help you find justice. Texas Attorney Serves Notice on University of Mississippi in Wrongful Death Suit

On February 19, 2010, Bennie Abram, a walk-on football player at Ole Miss, died unexpectedly during conditioning drills. Although UM athletic director Pete Boone claims that “the well-being of our student-athletes has and always will be our highest priority,” Mr. Abram’s attorney argues that Abram’s workout at Ole Miss was “recklessly intense” and in violation of NCAA guidelines. Tragically, the deaths of student-athletes—and, in particular, student football players—has become an all-too-common phenomenon. Routinely, football coaches and teams overwork their players.

If your son plays football, he is at increased risk of a wide range of health issues. Houston Accident Victim Secures $1.5 Million in Compensation

A worker in Houston, Texas, tragically and unnecessarily lost his leg recently when his employer’s trash compactor malfunctioned, crushing his leg above the knee. When negotiations failed, the victim’s attorney filed suit against the man’s employer and the manufacture of the compactor. Last week, the employer settled with its former employee, providing $1.5 million in recognition of the firm’s negligent work environment and in order to compensate the employee for his loss.

The fight against the employer wasn’t easy—and the battle against the manufacturer of the faulty compactor remains—but the lesson is clear: a talented, hard-working, knowledgeable attorney can secure the compensation that accident victims deserve. If you’ve been injured at work, contact the personal injury experts at Fears | Nachawati. With our experience and expertise, we can win for you. Natural Gas Pipeline Explosion Kills One, Injures Seven

A worker was killed and seven others injured when a faulty gas pipeline exploded recently near the Johnson-Somervell county line. The explosion was caused when James Robert Neese, an employee of C&H Power Line Construction Co., used a high-pressure digger to drill a vertical hole and, in the process, pierced an underground pipeline with his auger. A report by the Texas Railroad Commission concluded that the explosion and ensuing damage resulted from the pipelines owner’s – Enterprise Products – failure to adequately mark the buried line in violation of the Texas Utilities Code.

Oil and natural gas pipelines cross much of Texas, including in heavily trafficked, urbanized areas. Unfortunately, accidents are all too common and, in many cases, cause serious injury and death. If you work in the oil and gas industry, you may be exposed to these dangers. If you’re injured in your work, workers compensation may not be enough. Talk to the personal injury experts at Fears | Nachawati today for full understanding of you case. For a free consultation, call 1.866.705.7584 or send an email to info@fnlawfirm.com. Road Debris a Major Cause of Concern for Texas Motorists

A Fort Bend county sheriff’s deputy, John Norsworthy, died recently when a piece of road debris obstructed his car’s path and forced him to take evasive action. Responding to an emergency call, Mr. Norsworthy approached a four-foot square board of thick material used for buffering sound. Mr. Norsworthy veered to avoid the debris, lost control of his car, crashed into a ditch, hit a tree and flipped. Unfortunately, Mr. Norsworthy passed away as a result of his injuries.

Texas Department of Public Safety reports show that objects such as those that led to the death of Mr. Norsworthy are a significant threat to drivers’ safety. In the last five years, road debris has caused 2,728 accidents, including 756 injuries and 19 fatalities. If you’ve been involved in an automobile accident and road debris was involved you should contact the personal injury lawyers at Fears | Nachawati.
