More recently, a significant number of women and theirs families have brought lawsuits against various manufacturers after doctors used laparoscopic power morcellators during their hysterectomies. These individuals allege that these devices were responsible for spreading undiagnosed cancers and that they were not adequately warned about the potentially deadly risk.

Laparoscopic power morcellators have been used during hundreds, if not thousands, of minimally invasive laparoscopic surgeries. More specifically, the device functions by grinding up the uterus and uterine fibroids during hysterectomy and fibroid removal procedures. Unfortunately, during these procedures, the device has been connected to the spread of aggressive and previously undiagnosed uterine cancers. Many women, after undergoing such a procedure, soon find themselves diagnosed with late-stage cancers. Additionally, this means that such a diagnosis reduces long-term survival for many women. 

The Food and Drug Administration has determined that power morcellators cannot be made safer. Johnson & Johnson, previously the largest manufacturer of morcellators, has pulled their version of the device from the market. Similarly, many hospitals are no longer using any iteration of the device in their hysterectomies. Currently, more than 20 lawsuits against the manufacturers of the device have been filed in 16 different federal courts and more than 300 are currently pending.

The complications caused by these devices have led to several cases where undiagnosed cancer was spread after a surgical procedure. According to the FDA, as many as 1 in 350 women is suspected of having undiagnosed uterine sarcoma that can be spread during morcellation. Over the weekend, a group of friends who formed a bachelorette party were leaving a vineyard tour when a devastating accident occurred. The accident happened around 5pm on Saturday afternoon in Long Island, New York, when the eight women piled into a black limousine they had rented for a bachelorette party. The limousine attempted to make a U-turn on Route 48 in Cutchogue when a red Dodge Dakota pickup truck crashed into the side of the limousine.

The impact nearly ripped the limo in half and unfortunately, killed three women instantly. Another woman died shortly after at a nearby hospital. Two more were critically injured. Authorities state that the man driving the pickup truck, identified as Steven Romeo, was driving while intoxicated. He was also injured in the crash but had attempted to flee the accident on foot. He was arraigned from his hospital bed at a $1 million bond with a DUI charge. According to prosecutors, that charge is likely to be upgraded as a more thorough investigation is conducted.

Yesterday afternoon, in Vicksburg, Mississippi, a log truck and minivan collided in a deadly accident. The accident happened around 3p.m. in the afternoon near Highway 611 and Washington Street when the minivan attempted to enter the roadway from the street and collided with the log truck. The minivan was carrying five people. Unfortunately, one passenger, identified as 63-year-old Mary Wright, was killed. The driver, 32-year-old Danielle Johnson, was airlifted to nearby UMMC. The three other passengers, as well as the driver of the log truck, were taken to River Region. 

An official noted that this was a particularly difficult intersection since vehicles have to cross the path of traffic. One of the reasons for this, as one witness claims, is that the intersection is at a hill, making it difficult for drivers to slow down in time. Currently, it is unknown who is at fault but the Mississippi Department of Transportation (MDOT) is investigating the accident.

The holidays are always a dangerous time to be on the road and this Fourth of July weekend was no different. An unfortunate accident involving a drunk driver and his passenger occurred early on Saturday, July 4th in Milwaukee, Wisconsin. The accident happened near the intersection of 63rd and Appelton Avenue when the driver, who was found to be driving drunk, hit a tree. According to a witness, the driver was driving at a high speed and lost control before slamming into the tree. The impact of the accident caused the car to flip over on its side. 

Unfortunately, the driver’s decision to drive drunk resulted in the death of his 32-year-old passenger. The driver was rescued by witnesses who saw the accident happen. He was tended to by first responders but it is unclear whether he was transported to the hospital or what injuries he sustained. He was arrested for OWI homicide. According to officials, his case will be taken to the District Attorney’s Office in the next few days.

Another transvaginal mesh manufacturer has agreed to settle with injured plaintiffs. This time, the company is Covidien, which has agree to settle some of the 11,000 claims that are currently being made against them. Covidien has supplied C.R. Bard with mesh products, specifically Bard’s Avaulta pelvic mesh. In 2013, Bard was ordered to pay Donna Cisson almost $2 million in punitive damages after a Bard Avaulta Plush mesh that was implanted in her body caused her chronic pain. 

Covidien has identified that they supplied transvaginal mesh products to C.R. Bard. So far, Bard has requested to delay its transvaginal mesh trial, but Judge Goodwin has denied this request. Bard faces three large waves of cases in 2015. The last set of cases include 298 cases that involve problems with many of Bard’s Avaulta Plus and Solo mesh products. These continued settlements point to an increased willingness to provide proper and timely compensation to women who have been injured by mesh products.

Last week, two accidents occurred that involved one careless truck driver. The first accident happened on Wednesday, June 24th in Wildwood, Florida when Benjamin Scott Brewer sideswiped a truck while he attempted to pass. Brewer bumped the other truck and both trucks pulled over. Luckily, no one was injured in the accident and Brewer was issued a citation for careless driving. Brewer was employed by Cool Runnings Express Inc. and was driving for the company at the time of the accident. 

Unfortunately, Brewer was at the center of an accident that happened the next day on Thursday night. He was driving his truck on I-75 in Chattanooga when he approached eight vehicles that were stopped in the road due to construction. His tractor trailer plowed into them and Brewer and his female passenger failed to stop. In total, 18 people were injured: six died at the scene of the accident, six were injured and six others did not need medical attention. Police officials tested Brewer for drugs and alcohol but he was not placed in custody. An investigation into what caused Brewer to drive into stopped traffic is ongoing.

Judge Joseph Goodwin, the federal judge in charge of overseeing multidistrict litigation involving transvaginal mesh and sling products, has moved to consolidate more than a dozen such lawsuits for jury trial this November. The decision came on June 12th, when he consolidated 26 transvaginal mesh lawsuits into a single trial which is set to begin on November 2nd of this year. All of these cases involve Ethicon’s Gynecare TVT Mesh. The plaintiffs at the center of these 26 cases allege that the product caused them serious injuries and complications, including surgical removal of the mesh. 

Ethicon, a subsidiary of Johnson & Johnson, opposed the decision. Judge Goodwin, however, determined that the 26 cases were similar enough to try in front of a jury. Additionally, considering that there are more than 23,000 lawsuits currently pending against Johnson & Johnson, a consolidation was warranted. By consolidating these cases into one, all parties involved can also save time and money. For the individuals who have suffered after having a mesh product implanted, a timely decision would come as a relief. So far, Ethicon has failed to settle cases with plaintiffs.

Xarelto, a relatively new prescription blood thinner, was first approved by the FDA in 2011 for patients who were at risk of developing blood clots as a result of knee or hip replacement surgeries. The marketers of the anticoagulant, Janssen Pharmaceuticals, aggressively marketed the drug as a "one-size-fits-all" drug. Given that, doctors readily prescribed the drug because it didn’t require them to monitor their patients as much as other traditional anticoagulants required. Recently, however, several studies have criticized Xarelto for the various dangerous side effects that patients have developed after taking the drug.

One such study, published by the British Medical Journal, suggests that using Xarelto may double the risk of gastrointestinal bleeding compared to the traditional anticoagulant, warfarin. The researchers of this study monitored more than 45,000 patients with the goal of comparing the side effects that develop from taking rivaroxaban (the generic version of Xarelto) and warfarin. Other studies have also suggested that patients who have taken or are taking Xarelto are at a higher risk of internal bleeding. Furthermore, unlike warfarin, Xarelto does not yet have an antidote, meaning that patients who experience internal bleeding must get medical treatment immediately.

Yesterday, truck driver Mark Tipton faced charged after causing an accident that involved several cars and left 14 injured. Tipton, originally from Crossville, Tennessee, was driving on the northbound lanes of I-55, south of First Avenue in Forest View, Illinois. He was driving a white Freightliner tractor-trailer when he failed to stop and caused a chain-reaction crash. In all, 12 vehicles were involved in the chain-reaction crash. At least five people had to be taken to a hospital and nine others were treated at the scene. Luckily, none faced life-threatening injuries.  

Tipton admitted that he fell asleep at the wheel after driving for more than 14 hours straight and he had failed to stop and render aid. He was issued six traffic citations after the crash, including one for driving more than 14 consecutive hours and a Class 4 Felony of Driving While Fatigued. Additionally, he was charged for braking out of adjustment, automatic slack adjusters required, false report of duty status and failure to reduce speed to avoid a crash.
